By commissioning Kala (or anyone she collabs with) in any kind of way, you are agreeing to the terms of service below. Any statement can be bound to change if discussed prior to the commission. 1 .General Please write in a clear and nice manner. Provide neat references. Not a wall of text unless it's a custom. Any ill behavior will not be tolerated and your commission will be canceled if it occurs. Follow the rules provided in the commission channel you are commissioning from. If you fail to follow the rules provided Kala has the right to decline your commission. Please be mindful of her work schedule. She tries to get things done as soon as she can. Please credit Kala or anyone Kala works with as the creator/designer, if you use Toyhou.se you can credit the accounts there (can ask for TH names). 2. Payment All commissions must all be paid in full after lines are given. Unless otherwise stated. I.E. If stated she is taking payments beforehand. The currency accepted is USD. Do not pay until your commission has been accepted. Payment has to be sent within 24-48 hours (unless discussed prior). Payment will be made through Paypal or Ko-fi. These are digital goods with no address needed when sending! No refunds on adopts/customs/Commissions once paid for. If payment plans are cancelled you will receive no refund, Please think before buying! (edited) 3. Process Kala will try to finish as soon as possible but please do not rush her! WIPs will be provided, but after approval there will be no changes. Also please be mindful of how many changes you ask for. The time for your commission to be completed can be up to 3+ months depending on many factors such as; Health, order of commission, complexity, burnout. 4. CUSTOMER SATISFACTION Kala will do everything she can to make her customers happy. After a commission is finished, only small changes are allowed to be made. Such as small coloring/marking mistakes. Any great changes will come with an extra charge. Such as an outfit change, outfit addition or subtraction, background change or anything that makes Kala have to redraw it completely. Commissions will not be redone! If your reference was unclear to start with, then you are not allowed to do minor changes without a fee. Make sure to be clear in your order! Once complete please save files and artwork! Kala is not responsible for lost files! (edited) 5. Credit and Commercial Use Please credit Kala or anyone she works with as the creator/designer, if you use Toyhou.se you can credit the account(s) there. (Please ask for usernames!) If you wish to use your adopt/art for commercial purposes this can be discussed. Kala, the artist, holds every right to the produced drawing, not the commissioner. - Therefore she is allowed to use the copyrighted artwork to; Promote herself within any place or site. Publish books with. Display it anywhere to her liking. Post it to social media. - The commissioner are allowed to; Use the copyrighted artwork for personal use only unless agreed otherwise. Print the art, and claim the right of their character(s) but not the drawing itself. Use the art to promote themselves with proper credit given to the artist. If you break the copyright infringement in any way, every right you had to the drawing will be retracted. - The following is considered Copyright infringement: Reproducing/using the copyrighted artwork commercially. (Meaning making money of it in any way) Taking Credit for the creation of the artwork. Removing any watermarks/signatures. altering the artwork without consent. A Purchase of Commercial rights to the artwork will always be 100% of original price, and 150% for designs. With commercial rights you are allowed to make any sort of merch with the artwork. Use it in books, covers, as Props, change it to your liking and promote your own brand with. Credit is still required for usage of the artwork, even if altered or edited. You may not repost anywhere without proper credit. (edited) 6. CANCELING/REFUNDING POLICY Kala has the right to cancel and refund the money for your commission at any time. You have no right to cancel or demand a refund from the artist under any circumstances after payment is received. If money has not been sent yet the commissioner has the right to cancel the commission. If you file a chargeback against Kala or anyone she works with, your right to everything ever made for you will be retracted and Kala has the right to sell the copyrighted artwork to new buyers. - Your name will be publicly posted everywhere for others to watch out for. - Kala (or anyone she works with) also has every right to file a complaint and has all the right to the money you have given. Adopts/ Customs You can give the adoptable new outfits and such if you like or give them alternate forms/ etc to make them fit into your universe If you edit the artwork on adoptable(s), please write that you have done this when posting. If you wish to use the design/ art for commercial purposes rates for this can be discussed. Only the owner of the adopt is allowed to use it. Kala & anyone she works with retains all copyrights to artwork and designs. Do not claim as your original design. Do not trace/ copy /steal the art. The adopt is only for personal use (non-commercial purposes unless commercial rights bought). You may redesign/ modify purchased adopt however you like You may gift, or trade adopt after purchase, but you must note/DM who the new owner is. Can only resell for original buy price (unless extra art is provided). Credit for the design is required. NSFW pieces can not be sold to anyone under the age of 18 Breaking the rules puts buyer on blacklist, adoptable will be taken back without refunding. Payment plans & Holds can be discussed.
