Terms of Service (Commissions & YCH)

Posted 1 year, 9 months ago by Bananapop

I. Payment

  • I require full payment up front, via Invoice on PayPal.
  • I charge 6% sales tax (IDAHO, US), as I am legally required to. (Included in the price)
  • All commissions must be paid in USD. PayPal automatically converts currencies.
  • Clients that ordered under a former T.O.S. revision will not be expected to adhere to the updated Pricing and Terms for the remainder of that order. New orders from said client will be bound to the new Terms and Pricing.

II. Timeline & Work Process

  • The final completed piece will be delivered within One (1) Month of starting unless otherwise noted by the artist.
  • Once a commission has been accepted, the artist will ask a few questions about the subject of the piece in order to gain a better understanding.
  • The artist will deliver at least One (1) sketch Work in Progress (WIP) for client approval before proceeding with the final piece. (I give wips at Sketch, Lines, and Final)
  • I work in order of my queue from start to finish before starting next in queue.
  • Unexpected delays can and will happen, however I as the artist will ensure all clients are kept updated if I anticipate or experience a delay.

III. Revisions

  • Upon delivery of the sketch, the artist will ask the client to specify or point out any changes or revisions they would like made to the piece BEFORE approving the sketch for final work.
  • Small tweaks (if line shape looks odd) and fixes (missing details) are always free at any stage.
  • Once the sketch has been approved, no MAJOR changes (pose, props) will be made to the commission piece for free
  • If major changes are wanted or if you want me to restart AFTER the sketch was approved, you'll be charged a $10 fee minimum

IV. Refund policy

  • Not Started: 100% Refund
  • Sketch Started: 50% Refund; No further progress will be made, and the sketch will be repurposed or scrapped.
  • Lines or Color Started: No Refunds. Piece will be completed and delivered as agreed.
  • Commission Cancelled by the Artist: 100% Refund

V. Artist & Client Rights

The artist Reserves the Right to:

  • Post the completed commission work in online portfolios, commission sheets, and business-related socials.
  • Modify, Edit, and Repurpose client-cancelled commission sketches.
  • Claim the commissioned piece as their own work.
  • Refuse a commission for any reason as deemed necessary by the artist.

The Client and other parties may NOT:

  • Include the commissioned work in portfolios or commission sheets.
  • Reproduce the artwork in merchandise such as T-Shirts, Stickers, Prints, Mugs, Stationary, etc without an agreement or contract. (Personal Use is fine.)
  • Mint/Reproduce and or sell commissioned art into NFT. If you see my art being sold as an NFT it was done against my TOS.
  • Modify, Edit, and Repurpose the commissioned piece without permission
  • Claim the commissioned piece as their own work.
  • Post ANY artwork by the artist to socials without proper credit to the artist. (Proper credit constitutes as a link to the artists' site/profile, or officially tagging an account the artist is directly in control of on the corresponding site.
