TERMS OF SERVICE

BY WORKING WITH ME, you agree to the following terms of service. This is non-negotiable.

AS OF 9/20/2023, THIS TOS IS STILL REQUIRED IN REGARDS TO ANY OF MY ADOPTS OR COMMISSIONS MADE BEFORE THE FOLLOWING DATE.

ADOPTABLE / CHARACTER RESALE TERMS

• Do not use any design created by me to perpetuate harmful stereotypes, actions, etc.
  • This means CSA, child sex abuse, pedophilia, borderline, shotacon, lolicon, whatever word you want to use. Stop that shit.
  • This includes racial, gender, and sex stereotypes, and more. Cut it out.
  • This includes historical tragedies, events, etc. No Nazi redesigns why would you do that.
• Do not use any design created by me for commercial use, EG VTuber models, PNGtubers, merchandise, etc. without prior notification, request, and payment.
• DO NOT CONVERT ANY DESIGN OF MINE TO A CLOSED OR OPEN SPECIES. I DO NOT WANT TO BE ASSOCIATED WITH ANY SPECIES OF ANY KIND.
• Do not resell the design for higher than purchased UNLESS INCLUDING NEW ARTWORK.
• Do not resell the design for monetary value if traded.
• Contact me if there are any issues with reselling, ownership, interest in creating merchandise / profit off the design, etc.

PAYMENT

• All invoices must be paid in full upfront. If there are ever any issues regarding the commission,  adoptable, or character along the way, I may give a chargeback or you  may open a dispute through this.
• The currency I use is USD, it's preferred if you cover the exchange rate but isn't required.
• Do not pay in cryptocurrency of any kind. I will decline your commission.
• All commissions are charged through PayPal invoice only, unless we agree on something else.
• DO NOT CONTACT ANY BIDDERS WITH THE OFFER OF DUAL OWNERSHIP. Due to an instance in which the other buyer backed out, I will not longer  be supporting dual ownership unless the two of you are either friends or  partners. Please do not contact random bidders about dual ownership.

COPYRIGHT AND USAGE

I, the artist, hold every right to the produced illustration, not the commissioner.
Therefore, I am permitted to use the specified artwork to

• Promote myself with it on any website
• Display it on any site I so desire
• Use it as examples for future commissioners.

THE BUYER IS ALLOWED TO

• Use the copyrighted artwork for personal usage unless agreed otherwise
• Print the art, and claim the right of the character, but not the artwork itself
• Use the art to promote themselves with proper credit given to the artist
• Repost the art on their social medias while giving proper credit to blyssade

If you break the copyright in any way, every right you have to the drawing will be retracted.

THE FOLLOWING IS CONSIDERED COPYRIGHT INFRINGEMENT

• Reproducing / using the copyrighted artwork commercially / gaining a financial profit off of it's likeness
• Creating merchandise of the artwork
• Reposting the artwork without giving proper credit to blyssade
• Taking credit for the creation of the artwork
• Removing any watermarks or signatures
• Altering the artwork without my consent.

BY FAILING TO FOLLOW THESE REQUESTS, YOU WILL BE BLACKLISTED.

CANCELING / REFUNDING POLICY
I reserve the right to cancel your commission, trade, or adopt and refund the money for your commission at any time.
You reserve no right to cancel or demand a refund from the artist at any point unless we have fully discussed it.
If the money has not been sent, the commissioner has the right to cancel the commission.

If you file a refund for your  invoice, your right to everything I have created thus far will be  retracted and I reserve the right to do as I'd like with the incomplete  transaction. This may be changing the character, selling the base, etc.
You  do not, under any circumstance, reserve the right to use the sketch in  any way, shape, or form.
