By commissioning or buying a design you are instantly agreeing to each and every one of these guidelines, and you also understand that breaking any of these rules will result in a ban from commissioning or purchasing a design from me

These rules may change over time so please check in every once in a while just in case!

General TOS

- I hold the right to reject any commission for any reason

- I will not finish the commission until full payment is received, I will send you a WIP beforehand if you'd like, however

- You may use the piece however as long as you are not gaining profit from MY WORK and GIVING CREDIT, it is YOUR character, after all!

- Do not make edits to my artwork, if you want something edited, contact me, however, cropping and such is ok since you are not making drawn edits! (if you're unsure just ask!)

- I am depressed all the time even if I don't seem like it, so getting art out is usually something I take a while on! There's also school and such

- I will not do refunds unless I have not started the commission! So think long and hard before commissioning me! Also please give me about 3+ months, and I normally wouldn't have the money ready anyways, so please keep that in mind too!

- I will take paypal (USD) about 90% of the time

- Please send through 'Goods And Services' when buying something from me via paypal!

Refunds

- I will not take refunds if you are unsatisfied with the finished product, if you are unhappy, we can work out edits, but I will not redraw the entire piece!

- I have the right to refund you if I feel I can't finish or do the commission

Reserving Slots

- I will no longer put you on a waiting list for commissions! Sorry!

- HOWEVER, I will let you hold a commission (WHEN OPEN) for 24 hours!

- I will not hold if I am in need of money

Design TOS

- If you trade/sell any of my characters you must send them this TOS!

- Please let me know who the new owner is

- You can resell the design for only what it's worth, this includes art, but it must be paid for! (I will allow you to count your own art as well, but be reasonable!)

- If you got the character via trade/gift you may resell them FOR WHAT THEY ARE WORTH

- You can add/change whatever, but still make it recognizable as my design (if unsure contact me!)

- No breeding or similar designs

- If the new owner does not have a DevART, please let me know what other site they use most

- Let me know if you moved accounts as I do not want to get confused or think you've quit, as then I will consider the design returned to me

- Co-owning is ok, but do not make profits off it it

- You're free to change name, gender, age, etc. (unless stated otherwise but this is rare)

- DO NOT DRAW OVER MY ART and CREDIT ME if you are using my art of the design for a ref sheet!

- Crediting yourself for owning the character is fine, but claiming ownership of the design is not acceptable

- Feel free to draw, write about, and role-play with the character. You may use the character commercially. Like making them a character in a comic, shirts, calendars, etc. But credit to me must be ON the product and I MUST be notified and ASKED first. I AM ALLOWED TO SAY NO AND IF I DO AND YOU USE THE CHARACTER LIKE THAT ANYWAY THE DESIGN WILL BE TAKEN AWAY.

Artist Rights

- By owning a character design by me, you’re purchasing my labor, art, and only a partial right to a design. I retain all copyrights over my work, which include but are not limited to the right to distribute, reproduce or use the image as a sample for sales and self-promotion. But, this does not mean I can resell characters or that I OWN the character. it just means that I can post/show the art of those designs as example work and so on. The character is still yours in all of its entirety, but deigns are of my own original creation, so I can use the design to show people my artistic capability, or to promote design commissions, etc.

- I claim all rights to the Intellectual Property, but I will not reuse/resell the design again for personal and commercial projects.

- I reserve the right to reject your custom proposal without question.

- I reserve the right to modify and keep or resell any rejected/refunded designs to be sold at a later date.

- The complete payment transaction must be completed before you own a character.

- All money must be paid or all art must be completed before you have ownership of a character.

- If you order a custom from me DO NOT ask for a refund, you are only allowed to ask if you're in financial trouble/ emergency etc. And I have every right to refund you anytime.

- If I make many attempts to contact you for the remainder of a transaction and you never get back to me, the transaction will be canceled, you will be refunded, and I will take my character back.

BLACKLIST This is the public blacklist, These people are not allowed to buy my designs, receive them in any way. They are not allowed to own a design by me in any way or possess any art by me.
