It is heavily encouraged for you to read through the whole ToS. Failure to comply with any of the rules listed will result in the cancellation of your commission or blacklist in extreme cases. Do take note that 50% of the payment will be deducted from the total of your upfront payment during refund unless specified otherwise.

COMMISSION TERMS OF SERVICE:

1. General Terms

   1. Prices are subject to change. If using my commissions for worth logs, use the original price you got it for. 
   2. I have the right to refuse or cancel any commission for any reason; I am not required to tell you (this will hopefully be a rare occasion!)

2. Payment

   1. All payment currency is in USD.
   2. Do not send payments unless I agree to accept your commission and ask for the payment.
   3. Commissioned artworks should be paid 50% upfront before the artist takes on the request. The other 50% should be paid after the sketch is approved. 
   4. All payments should be made through PayPal or Ko-fi. 

3. Commission Wills and Wonts

WILL:

• Draw humans and humanoids
• Draw fandom ocs
• Draw mild gore

DO NOT TYPICALLY (ask):

• Draw monsters that do not resemble humans or have complex anatomy.
• Draw antro characters (I can draw them, it's just not something I have a lot of practice in). 
• Suggestive art, you must be 18+ (proof is required). 

WON’T: 

• Draw nsfw or fetish artwork
• Draw mechs (ex. transformers, Voltron)
• Draw anything related to incest, pedophilia, l*li/sh*ta, racism, homophobia, zoophilia, etc…
       - If I have the suspicion that a commission is about any of these or a character is involved in any of these, I have the right to ask for clarification and/or refuse your commission.

4. Process and Delivery
   
   1. Pre-commission;

• I will notify the commissioner when I start the commissioned artwork, and the 'Expected Turnaround Time' will be activated. 
• My 'Expected Turnaround Time' will be no longer than two months, the shortest being two days. It depends on how much work I have on my plate. 
• If you need an exact deadline for any reason, let me know! I may charge extra depending on how soon (the maximum fee will be 50% more).

   

2. During Commission;

• You can see which commissions I am working on via my Trello Board, please refer to it if you want to check progress before messaging me. Thank you! 

3. Post-commission/ Delivery;

• Once done, the completed artwork will be sent via email or Discord DM as a high-resolution PNG file attachment.

NOTE: 

A jpeg file or other file type can also be sent upon request.

5. Revisions

   1. The commissioner is entitled to two (2) major revisions during the whole commission process. Small changes are completely fine at any stage and will not add a fee. 

• I will start with the sketching process, this is when I highly encourage all your revisions to take place as it is the easiest to adjust during this time. It is not encouraged to ask for major revisions during the final stages of the commission. 

2. Changing the subject of the commission will not be permitted after completing the payment.
3. There will be no revisions allowed once the commission is considered complete. 
4. Extra major revision(s) will incur fees proportional to the additional workload.

6. Copyright and Usage Policy

1. Under no circumstances may the artist's signature be removed from any work.
2. Art may not be modified or edited by anyone but the original artist.

For every commissioned artwork, the artist is allowed to:

1. Retains the right to own the copyright of the completed artwork (not character) unless the commissioner requests a commercial use of artwork (an additional fee will be applied).
2. Can promote services and products with the finished artwork anywhere (portfolios, examples, etc...).
   
   

For every commissioned artwork, the commissioner is allowed to:

1. Use the commissioned artwork for personal use unless agreed otherwise. (ex: upload it on all your social media profiles, forums, etc.). If you are to do this I ask you to give credit to me for the art. 
2. Print the artwork and claim the character(s) as their own, but not the artwork itself.

7. Refund and Cancellation Policy

   1. Refund 

      1. No refund will be issued at any given circumstances unless:

• (I) If I, the artist, failed to deliver the product according to the pre-agreed Turn Around Time (TAT) during the contract agreement. (Refer to the commission contract to check the agreed-upon TAT.) If I do fail to complete your commission 100% of the payment will be refunded. 

2. Cancellation

   1. The artist has the right to cancel any art commission and refund the appropriate amount.
   2. The artist is entitled to cancel or deny the art commission if the artwork contains any depictions of racism/sexism/hate or is meant to mock/ridicule an individual for no apparent reason.

DESIGN TERMS OF SERVICE:

8. General Terms

   1. Designs I make must always be credited to me (ex. on Instagram, Toyhou.se, DA, etc…)
   2. Do not remove my credits if a character is redesigned, even drastically.
   3. If you intend to use my designs for commercial purposes (merch, stickers, pins, etc…); I will expect/ask for public credit under my username on any items with said character. I will also charge a fee to allow commercial use. 
   4. Reselling a design is not permitted unless the character has commissioned artwork added to the worth, was bought off me, or obtained via resale.
   5. I do not revoke designs and only do so under extreme circumstances (ex. blacklist evading).
   6. Drawing not safe for work material of designs made by me is allowed (except in the case of ferals, minors, or other immoral circumstances).

PUBLIC BLACKLIST

• Blacklisted users are not allowed to own designs by me. Designs by me they owned before their blacklist will not be revoked.
• trading, selling, or gifting designs by me to blacklisted users will result in a warning, and the trade or sale must be reversed/refunded. If not, it will result in a blacklist.
• You may not commission me to draw a character for a user that is blacklisted. If I find out, it will result in an immediate blacklist.
• Do not evade any blocks to ask me why you've been blacklisted.
• Users will only be publicly blacklisted if I feel it fit and serious enough to add (scammers, design theft, up-selling, etc…)

BLACKLIST:

• none yet. I hope to keep it this way.

By commissioning me/obtaning a character that I designed, this signifies that you, as the commissioner, agree to all the terms listed above, and this agreement will take effect once the artist starts working on the commission.
