Hello! These are the terms of service for all of Elk_Montauk's / Elkpine's art pieces and desings.

 These are prone to change over time, but do not fear!! If you break any of the following rules below, you will be warned beforehand to prevent any confusion!.

If you have any questions regarding these rules, feel free to DM me for more info!.

Any Rule with the following symbol (" ^ ") can lead you directly to my blacklisted users!, so read the following with caution.

You are free to disagree with any of the following rules below, but please, do not harrass me, i have my private reasons for every single one of them.

° Payment & refunds 💲💰

- I receive all of my payments currently through paypal, Brazilian clients can pay through PIX or deposits! 

- I can take payment plans both on commissions & adopts

- Due to my paypal, i cannot refund clients OUT of Brazilian territory, wich means i cannot make any refunds for international clients atm.

- Due to the problem above, my refunds cant be made through monetary value, but i can instead substitute the original order for another piece of art of your choice.

° Art & Commissions 🖼️🖌️

• Basic info:

- All payment needs to be done before the lineart process starts, if it isnt, the art progress will be paused until its properly finished.

- I can only draw Animal based characters such as Anthros, ferals, mechas, Monsters and others, but i cannot work with humanoid based characters such as nekos, humans, elfs and others!.

- Oc swaps can only be done before the first refined sketch is done, i can tolerate same species ocs swaps with small editions & etc, but completely different characters wont be considered.

- I dont have any problems with correcting any small details through the art process, but! If its already in the rendering phase (after the lineart & flatcolors stages) and its a BIG change (such as changing the species or changing the expression) your request will be ignored.

- For any NSFW and suggestive comissions, i will request a ID beforehand to confirm your age beforehand.

- You are allowed to use my art for personal stuff, such as profile pictures, con-badges, keychains & others with proper credits!.

° Adopts & Custom-made desings 🎨🎭

• Basic Info:

- If the desing was bought through a non-monetary offer (pieces of art, trading or gift) you aren't allowed to sell it for a higher price than the base/original one. Unless the desing in question has any commissioned or payed art pieces that could add to the current desing value. (Self made pieces may include in the value increase, but simple pieces such as a sketches wont be considered.) (If you dont know the desing's base price, feel free to contact me for this info !!)

-Redesings, gender swaps, species swaps and smaller updates are welcome, As long as the newer desing resembles the original desing.

-Adopts directly bought from me need to wait for a one week cooldown (7 Days min/Max) before being sold or traded again.

-Please do not delete my desings and their original TH profile, If you wanna fully "get rid" of any of them, feel free to contact me, and i would take them back with no problem!. 

- You are allowed to use my desings for monetary profit such as comics, books, & others with proper credits!.

• General Rules ✒️🧾

- Don't use my art for any type of AI training, ChAI or any AI type in general ^.

- Don't use my art pieces for any form of personal monetary profit. (this doesnt apply if the piece was commisioned for that specific reason/ desings also not applicable if credit is included)

- I wont work with minors for NSFW or suggestive pieces ^.

- I wont work with offensive themes such as: racism, xenophobia, homophobia, misoginy, pedophilia & others , please don't request any of these themes ^.

- Do not claim my desings as your creations! Keep the proper credits assigned to me.

- Don't erase my signature.  

- Don't trace my art.

Don't sell, trade or gift any of my desings with a blacklisted user ^.

° Blacklisting & Strikes 🚫

•Basic info:

- If the rules above get broken, you will normally get a verbal warning from me, wich i like to call a "strike", everyone has a limit of 2 strikes per person, and once they reach its limits you will be blacklisted.

- Before every strike reaches its limit, i will give the infractor a verbal warning about it before it reaches  the "no comeback" zone.

- If the rules marked with "^" get broken, the infractor will be directly blacklisted.

- My blacklisting procress includes blocking and restricting access to my social medias.

- My blacklist is public, but any message i get regarding to it, will be ignored.
