INKMART TERMS OF SERVICE
My Terms of Service are divided into sections; general, art & commission, and design & adoptables. Please be sure to read the general section, and any relevant sections to the business you have with me. Thank you!
By purchasing or trading for any kind of art or design work from me, you agree to the following terms regarding the work, so please read them carefully, thank you. If you have questions, please read through this first, to see if it's been answered.
General Terms of Service
- Do not save, repost, redistribute, or use my art in any way without receiving permission first. Commissioners or customers who have purchased a design have permission to post the artwork (with credit), and to use it for personal (non-commercial) use.
- Do not edit, trace, or copy my art in any way. Do not claim my art as your own. Do not remove my signature.
- Nobody is permitted, under any circumstances, to use any part of my art or designs for non fungible tokens (NFTs) or AI generated art. Use of my artwork for advertising or profits associated with non fungible tokens or cryptocurrency, or AI art learning or generating, is strictly prohibited.
- If posting or using art made by me, please credit me clearly and correctly. If the art was not made for you, you may not post or use it in any way. For credit, please link to this Toyhouse, or whichever social media you found me through.
- Just be courteous please, that's all. Further terms of service will be below.
Design & Adoptables Terms of Service
- My art & designs are digital only (unless stated otherwise), this means you are paying for a digital file, no item shipping.
- I take payment through PayPal invoices, Venmo, CashApp, or gift cards on a case by case basis. All prices are in USD. Payment must be sent within 48 hours of me asking for it, I will not send you the files / a TH transfer until I have received payment. Must be 18+ for purchases.
- I do not do refunds once a design has been bought, you have seen what you are paying for in advance.
- I reserve the right to refuse selling my designs to anyone for any reason, without explanation. (Though this is typically due to not feeling personally comfortable with content you may have on your profile pages, or history of not paying, etc.)
- You may trade or gift designs by me. You may resell designs by me for what you paid for them, or if you had added more art (whether it's personal art or commissions) you may add the value of the extra art- to a reasonable extent, please do not overprice. It's not required that you inform me of ownership changes, however I would definitely appreciate it.
- Designs are only for personal use, commercial use is prohibited unless stated otherwise. You (or artists you commission for art of the design) may not ever use my designs for merchandise or for profit. I retain partial rights to my designs to be used for examples, for a portfolio, or to post to my social media (but I will never do something like "reclaim" a design).
- You may not edit the original art of a design, erase my signature / crop it out, or claim you made the art or design. Please do not post to your own art gallery (DeviantArt, FurAffinity), however character hosting websites (Toyhouse, ArtFight) are fine.
- You may not use, edit, heavily reference, or post my designs if you do not have explicit permission. You may post designs/art made by me if you own the design or commissioned the art, but it must be properly credited. Don't use my ocs or designs for things like roleplay "face claims" or Dungeon & Dragons / ttrpg character art, unless you purchased the design.
- You can make changes to a design (in your own art) so long as they remain at least vaguely recognizable to the original. You may make alternate forms of a character (feral to humanoid, feral to anthro, a closed species form, etc.) but you must keep the designs together, you are not permitted to split a design into multiple forms and separate then sell/trade/rehome them.
- You may not make an entirely new species based off of any of my designs without permission, but it is ok to make alternate forms / versions of the design for pre-existing closed species you participate in. Please read the above rule.
- Do not use my designs as vehicles for hateful content. Don't whitewash my designs. Don't edit fat designs into skinny. Don't change noted or obvious transgender designs to cisgender. Don't remove disabilities. Don't use my designs for characters that participate in things like incest, rape, hate speech / hate crimes, or other things with real negative impact. Villains are fine, just don't be 'weird' or fetishistic about serious real life crimes, and we're fine.
- Do not knowingly purchase or trade for any of my designs with the intent to give them to someone I have blocked. Evading a block by having a third party (or alt account) obtain a design for them is prohibited (and rude). I don't repossess/refund designs that have been paid for, but please do not allow people to obtain more designs from me after being blocked.
Art & Commissions Terms of Service
- All my art commissions are digital only (unless stated otherwise), this means you are paying for a digital file, no item shipping.
- I only take payment through PayPal invoices (unless stated otherwise), all prices are in USD. Payment must be sent within 48 hours of me asking for it, I will not start work on the commission until after it has been paid in full. Must be 18+ for purchases.
- I do not do refunds once the work has been started, this is due to the fact I typically finish everything in one sitting. Art will typically be completed and delivered within a week or two, though if there are any delays the commissioner will be informed.
- I reserve the right to refuse any commission for any reason, without explanation.
- I only work from clean digital references of the character you'd like drawn, I will not draw from; written descriptions, pictures of traditional art with insufficient lighting or uncolored references (for colored commissions), photos of real people, or video game screenshots by themselves. Exceptions may be made, but please ask in advance.
- If posting my art anywhere, I must always be correctly & clearly credited. With social media, I prefer you retweet/reblog from my post, but for Toyhouse and ArtFight you have full permission to post to your character's profile page.
- Commissioned artwork is for personal use only, you may not use it commercially, for any kind of merchandise or profit, unless stated otherwise. You may not redistribute my work. I retain rights to my art to be used for examples or for a portfolio. If you prefer I do not post your commission to social media, please inform me.
- If you want to see a sketch/WIP phases, make that known when commissioning, as I will not automatically do this. (Be aware that sending a WIP and waiting for approval to go ahead may slightly slow down the turnaround time if you don't reply quickly.)
- After the art has been completed I am willing to do ONE go around at fixing anything small you want changed (that isn't something I missed on the references / a mistake on my end, I will fix those as often as needed), however I will not make large edits like recoloring the whole thing, redoing large chunks of lineart, redrawing the whole thing, etc. If you want big edits I'll ask you to pay a fee to compensate for the extra work.
Here is my trade preferences for what I'd consider trading my ocs for! It's separated by category (character trades, art, vouchers, etc). PLEASE at least read the specific "not interested, don't offer" section in the category relevant to your offer.
Character Trade Preferences:
Seeking:
- Human(oid) designs, prefer if they have an outfit already designed. Will look at any, but I enjoy; d&d/fantasy, urban fantasy, modern, masc & beefy dudes, androgynous ocs, tieflings or demons, monster people like vampires or werewolves, maybe futuristic/sci-fi, aliens, etc.
- Interesting and unique one-off feral/quad creatures, NOT regular animals (small bipedal creatures also acceptable)
- Liked designers: photinus, buffbears, bugwizard, archstar, heavendeluxe, scpkid, sorochiey/sorochii, topicalsteppe, bibiken, etc. (Will absolutely look at characters from designers not listed, this is just for a general idea of designs I like)
- Characters from my favs (except the "pretty" folder), but it depends what oc of mine you're offering on and what design you're offering to me- do not harrass owners of the designs in my favs if they're not ocs you own / up for offers already
Neutral on:
- Open/Closed Species are fine, I'm looking for designs I love regardless if it's a CS
- Furries/anthros & bipedal monsters (picky)
- Outfit designs (picky, may not trade some ocs for outfits alone)
Not Interested In, DON'T Offer:
- MYO slots from any species (unless I specifically say I'm seeking one)
- NO customs or mystery adopts
- NO designs on f2u/p2u bases (except if designed by my 'liked designers'), or any doll maker / dress up game / picrew / gaiaonline adopts
- Normal cats, dogs, regular common animals (especially with natural/dull colors), absolutely no "emo dogs" or dog-like creatures with human hairstyles
- Overly young or cutesy/anime looking humans
- Any blatant fandom-based adopts (mlp, wings of fire, lion king, bnha, naruto, homestuck, steven universe, sonic, etc.)
- No fetish based characters (designs that come with nsfw art are fine, just don't want the entire character to be based on it)
Art Offer Preferences:
Seeking:
- Digital drawn art (I prefer colored art but would consider lines/b&w/sketches if I really like the style)
Neutral On:
- Traditional drawn art (so long as you have good lighting / clean scans)
- Physical crafts such as needlefelts, sculptures, plushies, etc. (must be able to be shipped to me)
* For physical crafts I'd most likely prefer them of my creature ocs, unless you prefer working with humanoids
Not Interested In, DON'T Offer:
- Custom designs (unless I follow/watch you, but I may still decline)
- Writing/fanfic, music/song covers, aesthetic boards
Voucher Offer Preferences:
(only able to voucher characters if it doesn't go against a designer's TOS, some ocs may not be voucherable)
- Playstation Plus Online membership
- Gift cards for things like doordash, amazon, clothing sites, playstation store, nintendo eshop
- Characters from here that are similar in value or quality to the character being offered on
