TERMS OF SERVICE

 If you do not like my terms and/or are unable to agree to them, please find another artist. I will not negotiate my terms for any reason to please you. By buying a commission from me you are automatically agreeing to my T.O.S.

Expectactions 

• You are purchasing a digital file only, do not expect a printed piece of art. Please back up any commissions you get from me.
• You will receive the full-size illustration with a watermark, you will also receive a transparent version of the same illustration unless stated otherwise with my watermark. Please do not remove my watermark.
• If you wish to re-upload the picture somewhere else, please make sure I am properly credited for the piece you commissioned.
• Be sure to save the picture somewhere so you don’t lose it.
• I reserve the right to cancel your commission if I don't feel like drawing it or because you are causing more issues to me, my mental health and/or if you cause issues for other artists.
• Do not ask me to draw in a different style that refers to another artist style, an anime, or any other style unless said style is my own. If you commission me, expect me to do it in my style and nothing more. You commissioned me for my work because you like my style. Do not try to change it. Unless I offer commission in another art style.
• With the provided reference of your character that has a color palette section, I will be strictly sticking to that specific color palette and I will not change anything unless it is purely a stylistic choice. However, if you want me to slightly change the color palette please let me know.
• As an artist, my art is constantly changing as I continue to improve my work, so there might be slight changes between the artwork in my gallery and the illustration you will receive  (ex. lineart style, coloring method, composition...). They are very slight changes, but please keep this in mind.
• I will do my best to complete the piece you order, but you are the one who has to make sure that whatever you order is suitable for my style so you can avoid any dissatisfaction in the future.
• You get 3 revisions before it starts to cost extra. Revision fees are $5 per each revision.
• If I made a mistake on your commission that you noticed feel free to ask me to change it. This is free of charge.

Turnaround Rate and Progression 

• I work a regular job Mon-Fri and I’m off the weekends which is when I have time to work on commissions.
• Depending on the commission it can take 3 days minimum or a maximum of a month at most. If it takes longer than a month I will reach out to let you know why it’s taking so long.
• If you want a commission done by a certain time that will be a rush fee which is 25% fee of the entire order. Unless it’s a discounted commission which is free of charge.
• I will usually provide sketches and WIPs of any commission. You don't have to reach out to me asking about your commissions. This will only cause me more stress and make me refund your commission.
• I will always ask for your thoughts and opinions on your commission to make sure you are satisfied with the final product. 

Payments and Refunds 

• There are 2 payment plan options we may discuss beforehand.
•   You pay all of the agreed upon price up front before I start the commission.
•   You pay half of the price (number will vary depending on the total price) before the commission, and the other half when the commission is complete. You will send the other half of the payment before you receive the completed commission.
• Commercial use is 100% the total price, always. No exceptions. 
• Refunds are only available if I cannot complete your piece in a timely manner or if I feel I am struggling with the piece. Please be sure you want to commission me as refunds will not be given if the piece is completed.
• I draw things at my own pace.  This means that there is no set order on when I complete your order.  If you have any concerns that your commission is being neglected, please inquire politely. I will give you an update on the progress.
• Commissioners MUST be over the age of 18 to be able to commission me, you are breaking PayPal's rules if you are not and will be reported. 
• Payment is due at the time that you commission me. I will not start any artwork until payment is fully or partially sent.
• I accept payments in USD via Paypal, Ko-fi, and DA points. Different forms of payment will become available in the future.
• I do not accept any form of crypto currency, or e-checks.

Copyright 

• You are allowed to re-post the image as long as credit and a link back to me is given.
• You are allowed to print out the piece as much as you like and hang it on your wall! 
• You CANNOT sell my art/trace/make any type of profit off of it. AT ALL.
• You are allowed to use your commission, for example, on your Youtube / Twitch page as long as there is a link to my profile, but you cannot make a profit off the drawing alone (such as prints, graphics, merch, etc.)
• YOU DO NOT HAVE PERMISSION TO SELL MY ARTWORK AS NFT OR ANYTHING RELATED TO THE SORT.
• YOU DO NOT HAVE PERMISSION TO USE MY ARTWORK FOR AI IN ANY WAY, SHAPE OR FORM.

ADOPTABLE TERMS OF SERVICE

Overall Rules 

• I do not do refunds for any of my adoptables. All sales are final once you receive the adoptable file.
• You must pay for an adopt within 48 hours. If not the design goes back up for sale and you will be blacklisted.
• I will hold designs for a maximum of two weeks. Please make sure you are able to pay for the adopt when you request to have them put on hold. If you are unable to pay you will be blacklisted.
• Please only comment if you have the funds to purchase an adopt from me. Please do not delete your comment or back out of a purchase. This will result in being blacklisted.
• Adopt purchasing  are on a first come first serve basis unless stated otherwise on an adopt post.
• Filing a back charge will result in being blacklisted.
• When owning an adoptable by me, I will acknowledge co-owners. Designs can be shared, but the person who bought the adoptable will be credited as the sole owner unless the payment was split.

Reselling, Trading, and Gifting 

• My adoptables may be re-sold, traded, and gifted.
• Resales must match the original purchase value of the adopt, with additives only for commissions purchased or art personally made.
• Designs received in a trade may not be sold and can only be traded. Designs received as gifts may not be resold and can only be gifted to another person.
• For all adopt made in 2022 please inform me of change in new ownership so I can update accordingly. Anything made before 2022 I don't need to be informed of.
• Reposting adopts on DeviantArt I most be creditd. It doesn't matter if it's unwatermarked as long as I'm credited. 

Commercial Rights 

• Sale of designs are personal unless you explicitly pay the commercial fee. Commercial fees are a flat fee of $10.
• Without rights purchased, you are not allowed to use my art of the design for profit in any way. 
• When you pay the commercial fee you may use the design for commercial use but not the art I made for the adopt commercially.
• Whenever you purchase a design you can ask to pay the commercial fee along side buying the adopt.
• Commercial rights may be purchased later to all designs where the purchase of commercial rights is made available in the original sales post.

Credits and Reposting 

• After you purchase the design you can do whatever you want with it as long as I'm credited for it at least once. Though I would love to see the art you make with the adopt.
• Please do not claim the design as your own. You will be blacklisted.
• Do not use my designs if you are not the owner of the design. You will be blacklisted.
• Do not trace over my designs. You will be blacklisted.
• Only the purchaser of my work may re-post the art they've received, and public re-posts are fine as long as I am credited as the artist.
• If it's being uploaded to Toyhouse make sure to credit me (Puffy-Princess) as the designer or link back to my DeviantArt account (Puffy-Princess).

Prohibited Content 

• Publicized art of my designs that include subjects such as:
• Sexual artwork with children, hate speech & racism in any real world context.
• Certain types of fetish content (feel free to ask which ones I mean) and any type of philias.
• Will NOT be tolerated, and you will be blacklisted.
• Failure to follow these rules will result in a warning, which will become a block/blacklist if rules are repeatedly broken.

AI and NFTs

• YOU DO NOT HAVE PERMISSION TO SELL MY ARTWORK AS NFT OR ANYTHING RELATED TO THE SORT. Even with a commercial license you will be blacklisted immediately.
• YOU DO NOT HAVE PERMISSION TO USE MY ARTWORK FOR AI IN ANY WAY, SHAPE OR FORM. Even with a commercial license you will be blacklisted.
• I do not condone AI or NFTs, I will block AI users and people who do NFTs

Breaking my T.O.S will result in you being blacklisted from purchasing anymore of my adopts and being blocked in the future if a repeated offender.
