With the purchase, trade, or gifting of any OC credited to AbelArtwork/TaineNightingale ("A"), with art credited to A, or with a redesign credited to A, you the reader ("B") agree to these Terms of Service automatically whether or not you read them. Failure to abide by the Terms of Service may result in a rejected/ cancelled character transfer with or without a refund, and/ or a blacklist/ public service announcement.

These Terms of Service are in effect and up to date as of 05 SEPTEMBER 2023.

These Terms of Use apply to all users who own a design that has been created/designed/co-designed by AbelArtwork/TaineNightingale, or comes with a custom redesign by AbelArtwork/TaineNightingale. These rules apply to characters even if they have been traded 100 times. Please be aware some characters and adopts come with specific rules that are not listed here but are listed explicitly on the posts. You are still subject to any consequences if you break those rules.

1. A will NOT trade characters to users without a toyhou.se. This rule is the only one that does not apply to future exchanges.
2. B may make edits to the design/ redesigns as long as it remains recognizable.
3. B may not make major changes where the design is unrecognizable from the original.
4. B may not use aspects of the original design to create a new/separate character or species (without prior discussion with A).
5. B may not sell, trade, gift or separate an original design from a redesign for any reason unless permitted by both the original designer and the redesigner. This is considered a scam and theft and is highly disrespectful to the original designer as well as any previous owners who added redesigns.
6. B may regift the design.
7. B may retrade the design only if the design was obtained via trade and/ or sale.
   1. If B obtained the design as a gift/ for free, the design cannot be retraded unless additional value (i.e. trades, commissions, personal art) has been added to the character's gallery. This includes "freebie swaps."
      1. Free/ Gifted art (i.e. art received in which B did not give anything in exchange) does not count as additional value.
8. B may resell the design for the same price as bought.
   1. B may not resell the design for a higher price than bought unless additional value (i.e. trades, commissions, personal art) has been added to the character's gallery.
      1. Free/ Gifted art (i.e. art received in which B did not give anything in exchange) does not count as additional value.
9. B may use the design for personal/ non-commerical use.
10. B may use the design for commercial use only if discussed with A beforehand.
11. B may not claim the original design as their own.
12. B may not claim the original artwork as their own.
13. If uploading the original artwork off-site, credit to the Artist must be provided.
14. A only claims credit of the original design (if designed by A). A does not claim credit to any redesigns of the design.
15. A acknowledges that once a design is owned by B, the design/ character no longer belongs to A.
16. B will NOT delete any characters from Toyhou.se. If they feel the need to delete a character designed by A then they must contact A first.
17. If B is found using AI generated artwork for either payments or character trades, B will be blocked and blacklisted immediately. This is the only warning and any users who are blocked in this manner will not have the chance to remedy and become unblocked.

Through the TOS stated above, B is subject to a character traded to them being removed without a refund if they are found breaking terms (in severe cases). There is a scammer who purchases characters and then sells them to multiple people. If you are found associating with this person or these actions, any and all designs traded from me (AbelArtwork/TaineNight) to you can and will be taken back with no notice and a public statement will be made about your transgressions and scams.
