Just pinging all the people whose offers I'm considering to let y'all know I am still thinking about it! And I'm leaving the ad cycle through it's five days in the ad chat, so I'm going to accept an offer at the earliest whenever that happens! Sorry for the delay in replies and such to all of you, I very much appreciate your patience!
GENERAL TOS/WILL AND WILL-NOTS:
-By commissioning me you automatically agree to these terms!
-It is your responsibility to read these before commissioning me. A link to my TOS is always available in the design ownership page on Toyhouse.
-I reserve the right to refuse to sell to anyone, without having to disclose what the reason may be.
-I can decline a commission if I don’t feel comfortable drawing it for whatever reason. Trying to push me to change my answer will lead me to stop messaging you and possibly decline any future commissions.
-I will not be taking any form of cryptocurrency as payment.
-Due to schedule fluctuations, commissioned work may take anywhere from 7 - 30 days, I will notify customers of any further delays. I try not rush commissions and do my best to make it look as satisfactory as I can, for me and for you. Deadlines can be negotiated, but they may incur additional charge.
-If you want to set a specific deadline, please give me at least 2 weeks warning. I will keep you updated if i need a time extension or if it’s taking me a little longer to finish your commission. In the event of a serious personal issue, I may choose to refund a commission (see 6. Refunds).
-Any kinds of characters are fine! Feral, Anthro, Closed Species, Human, Humanoid, Robot/Mecha, Monster etc. I can draw any species, any gender, any body type. Commission prices will still vary based on the complexity of the character’s design.
-I will not draw real people that are not you yourself, and I will not draw nsfw.
-If you are unsure about whether or not I will draw something, just ask!
-Please be clear and precise about what you want (i.e. 1-6 sentences explaining what you want is good. Try to keep it concise and to the point). Unless it is a ref sheet/character design commission, please have a clear, 2D visual reference of your character available.
-I do not remove my signature from finished pieces under any circumstances. Removal of my signature will result in a block/blacklist from me.
-My artwork may not be used for anything related to blockchain technology (that includes NFTs, cryptocurrency, or anything similar), under any circumstances. Any artwork of mine found on a blockchain is either stolen, or violating my ToS.
-Once an adopt is yours, you are free to do whatever you please with it. Give it a personality/name/gender, change it, redesign it, get any kind of art you want of them, etc. (Closed Species adopts I make must abide by the respective species/group’s rules however)
1. INTELLECTUAL PROPERTY
a. My artwork may not be edited, copied, traced or heavily referenced by anyone. This applies to all work, regardless to whether it is personal, commission work, or a design. Individuals who are found to be copying, tracing or heavily referencing my work will likely be denied service in the future.
b. My artwork is my own property and I retain the rights to it. The commissioner retains the rights to their own characters. I will never sell commission pieces on any sort of merchandise, or any other commercial uses.
c. I have the right to use any of my artwork, commissioned or otherwise, in my online publications, portfolios, examples etc. Please consult before commissioning if it is a gift or should not be posted publicly.
2. PAYMENTS
a. All payments will be made in USD (US Dollars) via PayPal. You must be 18 or older to commission me, per PayPal TOS. Every commission type, unless stated otherwise, has a BASE price, meaning that the price STARTS AT the listed number and may go up depending on complexity of the character/picture.
b. Payments may be sent immediately, or after an initial sketch is recieved for lined or colored artworks.
c. Work on commissions and customs will begin once the full payment has been received. For designs, rights and original designs files will be transferred only once the design has been paid for in full.
d. Payment Plans are available only when payments exceed 100USD. Payment plans require a non-refundable down-payment of 50USD minimum, followed by a minimum payment of 25USD per week due.
(Exceptions can be made, but must be negotiated prior to purchase or claim of a design or commission.) Down payments must be made within one week of the sale.
e. Payment amounts will be discussed via messages, and can be edited with me if necessary!
f. In the case of auctions, you may request to use a payment plan in your bid comment, your down payment must be listed as well!
3. DESIGN AND ADOPTABLE POLICY
When you bid on, purchase, or come into possessions of my designs, you automatically agree to the following conditions:
a. Design rights and original transparent design files will be transferred ONLY once the full payment has been received.
b. Any additional edits, design tweaks or design variants will be started only once design has been paid in full.
c. Owners of my design have the right to use the design freely, as a personal character or brand mascot, commissioners do not have the rights to sell my art in any way, shape, or form, including on merchandise or minting as nfts. In plain terms, the design may not be used for financial gain.
d. I retain the rights to my original artwork, which can not be edited or altered by anyone other than myself. My artwork may not be copied or traced by anyone, including design holders. Please consult for edits of original artwork, variant color schemes or design alterations may be commissioned. The design itself can be edited whenever wanted, no need to ask, just retain some of the design's features please.
e. Holder of the design may repost my original artwork on sites such as refsheet.net or toyhou.se, but not sites like deviantart, twitter, or instagram.
f. All reposts of my art must include my credits, which you can find on my deviantart.
g. My designs may be freely resold, traded or gifted.
4. COMMISSIONED ARTWORK
When you commission me, you automatically agree to the following:
a. I have the right to deny any commission for any reason
b. Commission work will begin only once full payment has been received.
c. I have the right to cancel your commission at any time and will provide a full refund if I do so.
d. I will provide progress shots whenever requsted, and additionally at each stage of the artwork! (sketch, lineart, color, shading, etc) And if I'm able to, you can request for me to stream while I draw your artwork. If you would like to opt out of receiving WIPs, or would like WIPs sent at specific stages, please let me know.
e. When progress images are provided, you can request changes to the stage I'm working on, or minor changes to the details of the art. Please be aware that when one stage has been approved, major changes will no longer be made to it. For example, if lineart is approved, you may not request to edit it further down the line. Once the work has been completed and the final file transferred to you, changes will not be made to it. Major changes may incur an additional fee.
f. I expect some flexibility to use my artistic judgment, and may make minor color and tonal changes to the overall image, but will do my best to stick with the design or request I get. This may lead to some markings and hues deviating from the original design.
5. CUSTOM DESIGNS
When you commission me, you automatically agree to the following:
a. I have the right to deny any commission for any reason
b. Work on custom designs will begin only once full payment has been received.
c. I have the right to cancel your commission at any time and will provide a full refund
d. I expect to be given some artistic freedom with my design process, though I am happy to work from description or moodboard, or even highly specific prompts. (I will need some amount of visual prompt!)
e. I will provide progress shots in the sketch, lineart and color phases. Once one stage has been approved, I will not heavily modify that stage again. For example, requests to majorly change lineart after approval will come with an additional fee.
6. REFUNDS
a. Refunds will need to be discussed directly, You are allowed to cancel your commission and ask for a full refund if I have not started on it yet. If I have already sent you the finished sketch and you have approved it, you are only allowed a partial refund.
b. If I have to cancel the commission for any reason you will receive a full refund no matter how much is completed.
c. If you recieve a refund on a partially started work, you will NOT recieve what's been completed so far. If it is not a custom design, the work in progress will be deleted per request, or turned into a YCH or base at my discretion.
d. No refunds on adopts are allowed. You are, however, free to resell the adopt for the price you bought it for.
