Design Terms of Service (WIP)

Please note that Terms of Use may be subject to change without prior notice.
These Terms of Use are in effect and up to date as of MONTH 00, 2022.

These Terms of Use only apply upon the Owner's new ownership of a design.
Any changes made to the Terms of Use after an Owner has claimed ownership to a design will not apply to said design.

1. The Owner may make both major and minor edits to the design/ redesigns.
2. The Owner may regift the design.
3. The Owner may retrade the design only if the design was obtained via trade and/ or sale.
   1. If the Owner obtained the design as a gift/ for free, the design cannot be retraded unless additional value (i.e. trades, commissions, personal art) has been added to the character's gallery. This includes "freebie swaps."
      1. Free/ Gifted art (i.e. art received in which the Owner did not give anything in exchange) does not count as additional value.
4. The Owner may resell the design for the same price as bought.
   1. The Owner may not resell the design for a higher price than bought unless additional value (i.e. trades, commissions, personal art) has been added to the character's gallery.
      1. Free/ Gifted art (i.e. art received in which the Owner did not give anything in exchange) does not count as additional value.
5. The Owner may use the design for personal/ non-commerical use.
6. The Owner may use the design for commercial use only if discussed with the Designer beforehand.
7. The Owner may not claim the original design as their own.
8. The Owner may not claim the original artwork as their own.
9. The Owner may make both major and minor edits to the original artwork.
10. If uploading the original artwork off-site, credit to the Designer (ano_) must be provided.
11. The Designer only claims ownership of the original design concept/ execution. The Designer does not claim ownership to any redesigns and/ or the character/ associated character of the design.
12. The Designer acknowledges that once a design is owned by the Owner, the design/ character no longer belongs to the Designer.
    1. The Designer may not "claim back" a design.
    2. The Designer may offer to trade and/ or buy the design back, to which the Owner maintains the right to refuse, with or without explanation.

Section 1 - Will Draw

The Artist is willing to draw any of the following:

1. Human(oid) & Kemonomimi
2. Ferals/ Canines (animals) depending on complexity
3. Original Characters and/ or Fan Characters
4. Fanart
5. Light Gore

Section 2 - Will Not Draw

The Artist will not draw any of the following:

1. NSFW/ Nudity of any kind (keep things family friendly pls~)
2. Heavy gore
3. Realism
4. Mecha (Machines / Weapons)
5. Any type of hate / negative art
6. Elderly characters

Section 3 - General

1. The Artist has a right to refuse the commission for whatever reason, with or without explanation.
2. The Artist has a right to cancel the commission for whatever reason, with or without explanation (refund will be issued).
3. The Client has a right to cancel the commission for whatever reason, with or without explanation (if the Artist hasn't started working on the commission yet).
4. The Artist has a right to upload the commission on any/ all social media (Tumblr, Twitter, DeviantArt, Toyhou.se, Instagram, etc.) including as one of their art examples unless specified by the Client beforehand to keep the commission private.
5. Payment format will depend on the rules of the thread (such as the Client must pay first before the sketch is made (upfront), or payment is made 50/50).
6. The Artist will not work with deadlines or rush orders.
7. The Artist does not work on a "first come first serve" basis. Smaller commissions/ commissions that do not take much time may be worked on in between larger commissions/ commissions requiring more time.
8. The Client may contact the Artist at any time to ask for a progress check on the commission. The Client is encouraged to contact the Artist via social media (Discord, Toyhou.se, Instagram) if the Client is unable to reach the Artist via e-mail.
9. Clients are not permitted, under any circumstances, to use any part of their commissioned artwork for non fungible tokens. Use of the artwork for any advertising or profits associated with non fungible tokens or cryptocurrency is strictly prohibited.
10. The artist reserves the rights of the artwork, so the client may not use the commissioned work for any commercial use without express permission, nor redistribute the artwork as your own.

SECTION 4 - Delivery/ Turnaround

1. All commissions will be done digitally and sent in a digital format (unless traditional art is specified)
2. All commissions will be done in an anime/ chibi style or as sampled in the style ordered.
3. The character's color palettes/ designs (?) may be altered to fit the artist's style (such as bright neon colors will be toned down for a better final product)
4. All commissions will be in .PNG or .GIF (transparent version can be requested) -- Animation gifs can be turned to .MP4 if requested.
5. Unless specified not to upload the commission to the public, all commissions will be posted on the Artist's social media.
   1. Commission will be posted on the Artist's social media after the Client has received and approved the original and unmarked commission file.
6. Depending on the desired style and queue, the estimated turnaround is about one (1) week to two (two) months at the latest.
   1. If the Artist has to take longer than two (2) months to complete the commission for whatever reason, the Client will be contacted and informed of the status of his/ her/ their commission.

Section 5 - Commission Process

The following is a sample of the Artist's commission process: (process may vary depending on thread rules)

1. The Client orders a commission using a Google Form, by contacting the artist in one of their listed socials, or on a commission thread.
2. The Client will receive a rough sketch (resized and watermarked) of the commission. Any and all major revisions must be done at this stage.
3. Upon confirmation that the payment has been received, the Artist will work on and finalize the commission.
4. Upon completion of the commission, the Client will receive the commission file. Only minor changes (ex. brightness, colour adjustments, etc.) can be made at this point (charges may apply). Any and all major revisions (ex. reposing, colour scheme change, etc.) will be rejected.
5. If permitted, the Artist will post the commission on social media.
