🪶- TERMS OF SERVICE -🪶

Hello! Please take the time to read my terms of service (T.O.S.). As it is meant to help protect me as an artist, and you as the customer/client.

 By purchasing from me, you understand and agree to my T.O.S. 

Infringing upon these terms will result in being blacklisted; you will not be able to participate in purchasing any of my future designs.

Please remember to credit me as the character’s original designer with a link back to any of my socials!

I. 🪶 | Personal/Commercial Use:

If you have purchased my design(s), you may use it for personal use.

• I retain the rights to all of my art and reserve the right to use it as I fit. (example: using it for commissions simple) For this reason, my adopts are for non-commercial use only. 

Again, My adoptables are not meant for commercial use. 

II.🪶 | Payment and after Payment:

At the moment, I only accept Gift cards via Amazon. I currently don’t have a bank account and I’m working on getting that resolved so I can save up money for my personal and health care! With Visa gift cards, I can use them for food or other needs like clothes.  eGift cards via Amazon is also fine.

• After the full payment has been confirmed, and I have received said payment; I will send the file(s) pertaining to the adoptable.

After the adoptable is paid you will receive the unwatermarked version of the character via email, or It will be transferred to your toyhou.se account if I'm selling it through toyhou.se.

No refunds! Make sure what you’re buying is actually what you want. 

III. 🪶 | Gifting, Trading, and Reselling:

• You may resell the original design but only at the price originally purchased for, unless you have commissioned additional pieces from myself or others.
• The designs can be traded for other designs.
•  Designs may be gifted to other users.
• Any new owner of the design is subject to these T.O.S. 

If you trade, sell or gift the adopt, please let me know of the new owner so I can update my list :3

IV. 🪶 | Limits and boundaries:

• I will NOT sell my adopts to people who use AI or NFTs. 
• I have the right to not sell an adopt to anyone for any reason.
• Claim the original art as your own. Same goes for the design(s) or the character as a whole are yours.
• Do not whitewash my designs. 
• Adopts may NOT be aged up or aged down. If you plan to make NSFW of the adopt make sure they’re 18+. 

V. 🪶 | Ownership:

Once again, I retain all legal rights to my designs. 

As the creator of an adopt design I retain the use rights and intellectual property rights to my original artwork and designs. This means:

• I may make bases, species, or other characters based on my own existing designs.
• I may post the design on my comm carrd, socials, or other art-sharing platforms for promotional purposes. 

However, As the owner (you) of said adopt design you may:

•  Write, draw, role-play, and create world building on any designs you have purchased from me.
•  You retain ownership and responsibility of all text, images, and other original content you make based on any designs you have purchased from me.

Once you buy an adopt from me, it’s yours to use as you please for non-commercial purposes. 

VI. 🪶 | Editing:

You can:

• Name the character, change clothes or gender of the character if I made them androgynous/genderless (or keep them genderless!). 
• You can also change the character’s body markings or hairstyles.
• You can use your character for rp, as a mascot or avatar, or original stories if the adoptable is not fandom based.

You can’t:

• Do not remove the character’s features like breasts from Female/Femm presenting designs. Changes like making them smaller or bigger is fine.
• Remove Trans surgical scars (ex: Top scars, Phallo scars or any other kind of  bottom surgery scars // Changes to the scars from large to small, small to large or change the looks of top scars (Keyhole to Double Incision, Double Incision to Periareolar etc. as long as them being post-op of any is still indicated there. Same can be implied to Trans Woman / Trans Femm if the scars are visible.) I'm also fine with tattoos covering the scars.) or make Trans characters (or anyone under the trans umbrella), Cisgender. 
• Removing physical disability on disabled characters and so on after purchase. 

That will result in a blacklist. Seek adoptables that fit your likings. Buying an adopt and then removing something that’s a part of them is disrespectful.

VII. 🪶 | Freebie Adopts: 

 When you receive a design from me for free, you're agreeing to these terms:

• Freebie(s) cool downs are one week! Please do not trade them before then.
• The design may be gifted, traded but not sold. 
• If you don't want the design anymore, you may gift it to someone else (if so, update me the new Owner!) or send the character back to me. Do not Remove their TH Pages.

Since they are freebies, I don’t have much to add other than respect my terms and do not give them to anyone in my blacklist or those who are blocked by me.
