TOS or Terms Of Service is a list of agreements you agree to upon purchasing my artwork 1. All Art that I draw for you may be posted on any of my personal pages including (but not limited to) my Instagram, Portfolio website, Twitter, and Tumblr as promotional material for my commissions. You may opt out of this by directly mentioning where you would not like it posted, but you cannot get out of the Portfolio website as that is for freelance work as well as commission work. 2. ALL SALES ARE FINAL. I DO NOT TAKE RETURNS UNLESS THE REASONING IS A FAULT OF MY OWN. ONLY PARTIAL REFUNDS WILL BE ISSUED IN THESE CASES* (Emergencies are excused from this rule, but that is case-by-case) 3. All money for these commissions will be received ONLY through PayPal* Goods & Services , Venmo, and Cashapp. 4. Payment plans will be done on a person-to-person basis and should not take more than 2 months to complete unless the order is over 200$. NORMAL payments will be 50% Upon lock-in, and 50% upon finishing. You are also able to opt in to paying the full sum at the beginning. I WILL NOT TAKE FULL PAYMENT AT THE END UNLESS I TRUST YOU. THIS IS FOR MY OWN PROTECTION. 5. If ever posting your commissioned artwork anywhere there should always be a link back to my work whether that be a link to my website or a tag of the appropriate social media. My social media accounts are all listed on my Toyhou.se profile page for easy access 6. If appropriate references do not exist for the commission you are getting I may ask for a list of clarifying details. remember: less reference equals more margin of error. Better to be safe than sorry! References are suggested but not required (especially for simple characters) I can work off description but there may be a small fee for designing labor. 7. I reserve the right to deny any commission if the character is too complicated, makes me uncomfortable, or for whatever reason cannot be translated into my style. 8. If you have any specific preferences like eye color, clothing/fur texture, placement of markings, ETC that differs at ALL from the reference material PLEASE make it heard when I send you WIPs. I will do my best to communicate with the commissioner but if they are not happy due to something they themselves failed to mention I reserve the right not to refund or redo large portions of my work over again if the piece is already finished. 9. All information given to me by the commissioner whether if be email, social media usernames, discord tags, phone numbers, addresses ECT. will never be shared with anyone regardless of prodding. Private info is private regardless of who is asking. 1. Characters created by me are allowed to be used in commercial settings like stories, animated YouTube videos, and even merchandise for series /AS LONG AS/ I am notified beforehand.
2. You MAY NOT edit my artwork of a character unless you ask and are granted permission from me directly. Often times I'm able to do it myself for free, so please just ask.
3. You are allowed to use characters you get from me in NSFW artwork and situations, but just a reminder PLEASE tag appropriately, and I will not make or authorize NSFW edits of artwork /I have created/ myself, sorry.
4. I will never revoke a character from you or get mad at you making the character morally questionable, but I will be putting you on a personal blacklist if you make illegal, extremely horrific, or uncomfortable art of a character I have made that includes hate speech in most forms, especially if it is an expression of your own hateful views, feral NSFW, or other things like that.
5. I reserve the right to decline any edit requests and requests for commercial use when asked. Although rare, I may turn down a request due to its nature if it violates other rules in my TOS like #4. Permission is good for the specific story or piece you asked me about and will not be revoked. I require people to ask for individual pieces of art at a time or as a bunch all at once. I will never authorize blanket editing permission.
6. If a character was gifted to you by me or created for free by me, they are under no circumstances able to be resold, ONLY regifted, until monetary value 10$ or above is added to the character via art.
7. I personally like to be notified when ocs by me go up for sale since often times I can take them back, redesign, and rehome or use them in my own stories. I am always open to taking in old characters of mine by me or ones I used to own. While this isn't requred like the rest of my rules, It is greatly appreciated!
