Rights and Ownership

*I hold all rights to my artwork. Dont claim you own/made it.

*All my artwork comes signed, deleting the signature invalidates their value.

*I can and will share my artwork in my social networks and portfolio, please specify if you dont want it shared.(I can delete it even after posted, please communicate!)

*I can reject artwork or cancel a commission, depending on which, your money will be given back or a refund will be worked on.

*Please dont re-produce, edit or trace my artwork without my permission, you are free to re-post giving me credits.

*When buying a design you are buying both the design and artwork, feel free to use both within each rules.

*I wont revoke a design unless these special circumstances: Charge back, not paying or not completing the trade. If someone else comes to tell you I said different speak with me first. (Always communicate with me for any problem! I never use third persons to fight my battles dont trust them!) 

*I reserve the right to reject a commission if I dont feel comfortable with the subject, the way the commissioner makes me feel or I had problems with the commissioner in the past.

*If you commission a sketch, lineart, flat, you are free to finish it yourself or ask another artist to do it, on the other hand, you are free to ask me to finish your artwork, or art you had commissioned, but please! show me the artist tos or that they agree to it, otherwise I will decline.

*In case of someone else finishing my artwork you still need to credit me ie Gingler did the lineart, x added the colors.

*You are free to resell for any price you want and add extra rules to the design, but the main rules will stay. 

Payments

*I accept payments through Paypal.

*Prices are in USD and paid in mexican pesos (please very important!)

*Half payments are avaible or full in front, I wont deliver the HD/completed artwork until fully paid.

*I dont feel comfortable accepting payment plans, instead talk to me for an agreement.

*Tips are very much appreciated!

*Im very thankful but dont tip to cover my paypal fees, thats not on you <3

Refunds

*Once the artwork is delivered, I wont accept refunds or cancellations, please consider this before paying or asking artwork.

*I do not accept refunds for designs, you are free to resell if you need the money or ask for a custom trade.

*Charge backs if done on a finished artwork/design, will be taken very seriously, I will make a post to make others aware and blacklist you, for unfinished artwork, talk to me first before doing so, we can work on a refund if you have monetary issues and the artwork hasnt been finished or any other problem.

*I have the right to use screenshots in case of a charge back or some shady business I notice to protect myself.

*Depending on my table of prices and the amount of work Ive done, the refund will be accordingly. 

*Before starting the sketch 100% refund

*Sketch done, sketch prices will be asked and the rest refunded (In case of a lineart and above)

*Lineart done, lineart prices will be asked and the rest refunded(In case of a flat and above)

*Flat done, flat prices will be asked and the rest refunded (In case of a shaded piece and above)

*Tips are not refunded, sorry, please be sure you can give that extra ! <3

Credits

*All my artwork need be credited Deviantart-Gingler, Twitter-Gingler, Toyhouse-Gingler, Tumblr-Gingler, Instagram-Gingler_warrior if used in any way, or if you are re-uploading artwork to TH, please credit with my username Gingler instead of a link to my da or any other place.

*Do not remove my signature from any artwork/design.

*All links must be working that link to my pages.

*For easy crediting you can check my front page here in TH and there are all my links to my socials.

Posting,Sharing and Using

*If you ever re-post my artwork, credit me and link one of my socials.

*All my artwork first is stashed in DA sta.sh, later it will be reposted in Da and Twitter, if you dont want me to post your name or even to repost it feel free to ask!

*You are free to use my artwork for personal use.

*Ask to use my artwork commercially, so we can end up with an agreement, also all artwork for print is best used in 300 dpi, and all my delivered digital is in 100 so if you discuss this with me, I can update the dpi, fix small things and update the artwork all ready for printing and more.

*Designs can be used personally and commercially, just credit me in a clear way with one of my socials at least.

*Cropping my artwork is fine for personal use, just leave the signature visible, in case of cropping my signature cant be seen anymore, please credit me in some other way, like in a profile state i drew the art.

*In case of edit or redesign, keep the original file in case you trade later people can recognize the original design.

*If you redesign, I still need to be credited some way.

*I always upload all artwork to my deviantart or twitter in a way to keep all the artwork avaible, but in case of very old artwork, I might or not might have it, still feel free to ask, I might have it somewhere else, if it wasnt uploaded.

Trade,Resell, Gift design.

*In case of trading outside TH, please tell me, just to keep track, or keep the character in a special place in  your th for traded character off th.

*Designs traded outside TH are voided from custom trades, since I dont know if they are the real owners or not, even with proof I would preffer to evade it.

*You are free to co-own, but dont put me in the middle of it, this is between your friend and you.

*Feel free to resell for any price.

*Keep the price you originally bought it or traded so the next person can have an idea.

*Feel free to add extras like commissions and such to the price.

*You are free to add your personal artwork value to it, but dont raise your prices to crazy amounts to say your char is now worth 99999$ and just have tons of sketches lol.

*Feel free to ask for vouchers for the designs.

*Please dont "Split", "Breed", "Twin" my designs and then sell those.

Commissions

*Commissions can take from 1 day to a month depending on the type of artwork, it might take even longer if there are several characters or are several commissions, feel free to ask for a estimated amount, this counts toward the first day I start on your artwork.

*I'm usually working on several things, if you want to be notified when I fully start on your commission you can ask this.

*If you have a special date tell me to give priority to the commission, in case the date is very close you can pay extra to have it delivered earlier and worked around the clock.

*You can ask for updates every week, please dont ask everyday this usually makes me anxious and makes me work on another commission instead.

*Depending on our agreement, I will send an invoice to pay, after you had paid I will start your commission not earlier.

*Artwork wont be delivered until you had paid in full.

*For half payments, I will work to the half of it and ask for the full amount when that part is done to finish the whole art.

*I can send the whole process for reviews, you can ask for this, or if I have more poses in mind I will send for reviews, here you can ask to change things like the pose, expression or any other adjustment. (Chibis dont have reviews)

*I can send linearts for reviews too, here I can make little adjustments nothing too big like change the whole pose, but more like change the face or some detail in the clothes.

*For the flats I can do little changes in the colors, but i usually color pick to get the right colors, if the character doesnt have a ref, here is where this comes in handy.

*I can still make little changes after the artwork has been delivered, but its much advised to try to make the changes in the previous steps otherwise it will super hard and even can cost you an extra!

*You have 2 changes per stage, for a full pic that would be: 2 for the sketch, 2 for the lineart, 2 for the flats and 2 for the finished piece for a total of 8!

*Errors by my own hand will be free and not considered over the possible max changes. in a character with a clear reference.

*What counts as a clear reference? A full body without shading that shows clearly the characters colors and features.

 *In case of a lack of a full clear reference pic, you wont get infinite free changes (I used to have infinite fixes, but some people took advantage of this) instead you will get one free pass and then detail me every fix and then you get the two free fixes, if you missed to explain me a fix its up to you.

*Chibis get a max of 2 free fixes.

*You cant ask for a refund after the art has been finished and delivered, since you cant refund me the time I spent on it.

By making business with me, you are agreeing to my Terms of Service you are bound to them and are aware of this fact.
Breaking or willfully ignoring them can result in blacklist, and depending on severity public blacklisting.
