Aso's terms of service revamped

Hello! So, my ToS needs a major overhaul. So, here we go.

I will be dividing it by sections.

Note: I only use paypal


adopts and designs

- These rules only apply to my designs. Anything someone else made falls under their terms of service.

- Unless otherwise discussed, USD/currency adopts must be paid for within 24 hours. art payments should be delivered in a reasonable time

- Designs bought under $100 USD do not include commercial use. If you want to use them for commercial use, we can discuss that in private messages. (This is because it's unethical to make a butt-ton of money off something you didn't pay a lot for)

- Designs bought for over $100 USD are assumed to have commercial use.

- The exception to the previous two is if it's from an open, closed, or semi-open species. Species ToS goes above mine.

- You may not alter my art in any way, even if it's made on a base, without my express permission. It's rude. At least ask me if I can do the alterations or draw a new reference yourself.

- Regarding my freebies: Unless you add extra art, you may not trade them, sell them, or put them up for free or best offer. Gifting them is fine. Adopt shelters are a hard no.

- I'd prefer that anything paid for via art or game currencies not be sold for IRL currencies without extra art.

- My adopts are not to be used to create original species without discussing it with me first. (I'm rarely going to say no, but I just wanna know first, ya know)

- I must be set as the creator of my designs. If someone redesigns them, they may be added as a designer. (Sorry, but I've had people set themselves as creator simply for redrawing the design)

- Do not use my designs for zoophillic/pedophillic or bigoted content.


Species design rules

- If you buy one of my species concepts/receive it, you get the right to sell adopt on it.

- Premade species designs have a minimum cost of 150 USD if your intent is to turn them into a closed species.

- custom/random species designs otherwise have a minimum cost of 50 USD if you're turning them into a closed species.

- Price minimums do not apply for anything but closed species.

- Once your species concept is paid for, you can add whatever lore and stuff you want, make adopt, and change the design(Just don't edit the art itself).


Art and commissions

- I retain the right to decline any art I'm not comfortable doing for any reason

- Payment must be received before I start lining. I will not line until I am paid. I will end a watermarked sketch and after a week send another reminder to pay. If, after another week, I am not paid, your commission will be cancelled.

- I do not do sexual/pornographic art including fetish art. Don't ask. (Just so it's clear, you're not in the wrong for having a fetish. I just don't wanna draw sexual content for other people)

- I may add an extra fee if you wish to use my art for commercial purposes. Otherwise my art is not for commercial purposes.

- My art is not for use in NFTs, AI-training, or anything related to either of the two.

- Turn-around times vary, but I will ensure regular communication(weekly at minimum once I start your art)

- Do not, under any circumstances, edit my art unless it's a base or was otherwise made to be edited.


My species

- All my publicly released species are open, meaning there's no need to pay me to make one.

- A species is publicly released if it's got a reference and is in either Starship Yena or Miri Village

- They should at least have a link to the world their species in and a link to me somewhere in their profile or ownership tab. Tagging them or submitting them to their respective worlds as well is ideal.

- None of my species include commercial use. This only applies to versions of the designs that are of my species.

- Lore is optional outside of ARPG activities.


What I'm not allowed to do

As in, I cannot do the following

- Ask you to authorise me so I can keep track of my designs

- make you change your character's info(This also means that I cannot enforce certain aspects of a design. However, I reserve the right to block anyone for using my designs for bigoted purposes)

- revoke a design for any reason with the exception of a chargeback(I do not send designs until I'm paid. However, a chargeback means that I am well within the right to take the design back, because that's essentially a refund-and-return.)

- contact you about whether/how you are using a design(it's not my business)


Blacklist

My blacklist is my blocklist. It is not publicly available. Those on my blacklist may not gain art or designs from me firsthand, whether it be directly or through a friend or sock puppet. My art should still be credited to me regardless.

If, for some reason, there's still an old blacklist floating around, I will delete it a soon as possible because it's both out of date and doesn't need to be publicly available.

How you get on my blacklist is simple:

1. I blocked you for whatever personal reason

2. You broke my ToS, thus earning yourself a block

Please note that I will not make any action but blocking you if you break my ToS. I don't have the time or energy to fully enforce what is ultimately a social contract rather than a legal one.
