Rules that apply to my art, whether that be art you receive from be through a trade, gift, commission, or art of mine that was included with a character that you receive.

Commissioning me or trading means you automatically agree to these rules, even if the rules change.

1. Do NOT repost my art without links attached that go directly to my page without my explicit permission. (This excludes character storage like sta.sh or Toyhouse). You may use the art with credit on any site but do not claim it as your own. If shared, it must have a link redirecting to one of my social medias (preferably my twitter). My TH is dana-the-cat, please credit me there. Do not use my artwork without permission.

2. Do not remove my signature, all of my works with signatures on it are part of my portfolio. Removal of my signature will result in rights of using my art being revoked from you (regardless of if you paid for it) and you will be publicly blacklisted. If you attempt to use my artwork without its signature I will file a DMCA takedown wherever you upload it. If you aren't deterred by that alone, I will contact a lawyer. This encompasses both cropping and erasing. If you plan to use my art as an icon I’m fine with you doing so but only IN the icon (I would greatly appreciate if you asked me first as well since it does sting a little seeing my signature removed.. I have it there for a reason QvQ)

3. You MAY edit my artwork (within reason), but only if you own the character or have paid for the art. Otherwise, do not ask. Do not abuse this to add derogatory or insensitive things. Do not edit my artwork of animals to be sexualized, I will ask you to take it down.

4. All art that was bought may be resold for the same price, but please confirm with me the price beforehand if you're unsure (this does not apply to any art before 1/31/19, but you still may not overcharge for my artwork)

5. Absolutely no chargebacks, anyone that tries will be reported immediately and the chargeback will be disputed. If you ever need a refund, depending on the situation, I WILL refund you (you will not receive whatever you paid for if you do)

6. Once you have received an update on artwork (VIA Discord/notes/DMs) or if I have already started on a piece, you may not get a full refund. Depending on where I am on it, you will get a partial refund and the WIP will be sent to you.

7. I check the pages of all people I do business with and I have the right to refuse business with you without needing explanation. I have a personal blacklist that will never be made public of people I refuse to do business with— I do not block these people unless I feel threatened

8. I am willing to edit art you paid for from me for free so long as you are cordial about it (i.e, don’t yell at me for little mistakes, I’m human and I’m glad to help you feel satisfied for quality content). Big edits may cost extra.

9.*****I will not do business with anyone whose account is under a month old unless they are using points, zero exception unless you can prove that you have an older account****

10. Repeat harassment can result in revoking of rights to my art and further harassment will result in revoking of my designs (this is something that requires for you to REALLY get on my bad side, I will always try to talk things out before it reaches this level)

11. If a trade is initiated and I send first, I expect the other character within 24 hours or I will otherwise reclaim them for myself. This also goes for CS trades (regardless of what the species group says)

12. If buying an adopt, you are subject to the following... -payment is due within 24 hours unless a payment plan has been discussed. -any artwork is due within a month of offering. if not finished, the adopt will go back up. If offering both art and money, payment is due in 24 hours and the art within a month (I will be more forgiving with this method) -Absolutely no holds, pay when you have the money or request a payment plan. -payment plans must not be more than 2-3 weeks.

13. Do not trace my artwork. I do not make F2U bases, everything I make must be paid for. If you don’t like that then feel free to just Google “f2u base” and get one elsewhere.

14. Absolutely DO NOT draw NSFW of any of my animal designs, feral or anthro. I don't care if they're yours, I'm not allowing my animal designs to be drawn in suggestive ways. I will warn you the first time but any time after that I will blacklist you from any of my other designs.

15. As of 11/27/19, obtaining a design after being blacklisted will result in the revoking of the design. This only applies if you've obtained a design of mine after this point. I will refer to my ToS when revoking, no exceptions allowed. (IP blocks will not prevent design revokes) I no longer revoke characters, but if you are caught knowingly trading to someone who is on my blacklist you will be blocked and reported for block evasion. Obtaining a character made by me means you understand this, and I will link this statement in the report. If TH doesn’t do anything, I’ll instead file a DMCA.

16. Clarification, 1/2/2020: if you have me blocked, I have the right to revoke your use of my artwork; ONLY if the artwork was free (group currency =/= money. this does not apply to commissioned artwork). I will only do this at my leisure, and I likely will not do this unless you already know you cannot have my art.

17. If I have suspicions of you trying to scalp a character I made I will ask for them back. Do not use my designs to scalp extra money if nothing of value has been added to them (i.e you buy a character for $5 and sell it for $20 when there's no added artwork (art you got for free that you didn't make is included)). Failure to do so or explain yourself will result in a DMCA takedown (this is the only time I will revoke a character). This does not apply to people who have a genuine emergency, like things that you NEED and not stuff that you WANT (I.e health, housing, rent, etc)

18. You may kin my designs! Do not roleplay as them nor make a kinsona out of them unless you have explicit permission from the person who owns them! In case of a time where someone trades a design with a kinsona, the kinsona MUST be traded alongside the character who it is based on. No exceptions.

19. I do not take holds unless you are someone I am familiar with. This is to prevent people from putting characters on hold and never paying. I will accept payment plans but if it isn’t paid back after the specified time I may refund you and you will no longer be able to try for that character again (on a case by case basis, emergencies exempt. Payment plans may not be used as a loophole to receive a hold and requires a down payment ESPECIALLY if it is over $50). 

20. Characters that have been gifted to you that were created by me are subject to their own ToS; most of these characters are under a strict rule of you are not allowed to trade, sell, or gift them unless you have asked me first. People seen doing this will be blacklisted and I will start reclaiming characters that go against this.

21. As of 4/17/21 I will NOT be gifting my characters to people I’m not extremely close to. Don't ask, don't beg, nada. I'm not doing it anymore because people abuse my trust just to take free shit from me.

22. When trading/selling my designs, my ToS overrules yours. Your ToS do not apply to the designs I create, and if there is a discrepancy please follow my ToS.

23. Related to the above, no one is obligated to do pings for any of my designs even if the previous owner says they are. You’re weird for that, only trade/sell what you’re 100% willing to trade or don’t do it at all.

24. Anyone caught harassing someone in relation to any of my designs will be blocked, blacklisted, and reported. (I.e begging for a design, attempting to force someone to give you a design, etc etc)

25. DO NOT USE MY ART FOR AI. DO NOT USE MY ART FOR NFTs. I WILL PERSONALLY SUE YOU IN COURT FOR THIS IF IT IS DONE DESPITE MY WISHES.
