Raccoony / pinucoon's Terms of Service

The rules below apply to all my adoptable/custom/design work. If you agree to my T.O.S., you agree to every line that is written under this statement.

General Rules, Payment, & Refund Policy

- $1 = 100 points

- Questions? Contact me on either Toyhouse (you are here), Instagram (pinucoon), or deviantArt (mandytheraccoon, inactive) at any time!

- I only accept USD (US Dollar) via PayPal and deviantArt points as currency. I do not take Venmo, Cashapp, Amino Coins, or any other form of money payment currently.

- I expect payment within 24 hours. I will give you a bump if, by then, you have not sent anything! Repeat ghosting will result in blacklisting.

- I only accept holds if your case is appropriate, and these will most likely be a range of 24-48 hours. I expect you to pay in full by the end of the allotted time.
- If I state I am accepting upfront payment, do not expect me to hold a design!

- I will only transfer ownership of a character to you once your offer is accepted and all payments are completed. No inbetween.

- No refunds will be provided after I accept your offer. You must ensure that you have all the necessary permissions to the means you are using to pay prior to commissioning, especially if someone is spending on your behalf. The only exception to this rule is if I personally specify otherwise.

- Chargebacks will result in an instant public blacklist and further action will be taken. The design will also be rightfully revoked because you did not pay for the agreed-upon price. Similar to my commission work, I have given every possible chance to receive a quality design experience with every rule that I require listed cleanly and explicitly for you, and I will not tolerate forceful 'refunding' because you disagreed with this after accepting my terms of services and deciding to pay.

- Keep my designs on Toyhouse. Private them, authorize-only them, I don't mind - just do not delete their original profile from the site.

Selling & Trading

- Do not resell the design for more than its original price, unless it has additional artwork.
- Even so, you may not heavily and/or unfairly inflate the worth of the character because, say, a singular image has been added. I expect you to have at least a subtle amount of math literacy - if said image was commissioned for $10, the character is not suddenly worth $40 more!
- This applies to personal work as well. I am not the judge of the prices you believe your art to be worth, but I will look heavily down upon, say, an 'experimental piece' upping the character worth by two thousand percent, and I will warn you if this is a repetitive, deliberate offense.
- Sentimental value / writing biographies does not count towards a character's worth.

- You may not exert your own TOS over my designs - this includes actions such as justifying arbitrary higher resale using personal rules or limiting tradership (e.g. 'tradebacks only').

- You may trade/gift the design for payments outside currency, unless otherwise stated.

- You may redesign a character as much as you like! Please ask prior to editing my artwork, however.
- This does not permit you to eradicate my role as the original creator.

Credit & Usage

- I retain the rights to any artwork I create. This enables me to freely use the commissioned piece in posts, advertisements, or my personal portfolio. I will never claim your characters to be my own.

- If you wish to use my designs commercially, please extend further contact - I have commercial design fees that we can discuss. Otherwise, personal use only.
- However, you are allowed to use a character I designed in small-scale personal merchandise for which you are charging payment, such as stickers, posters, and prints, as long as these are small-scale productions with unsustainable income and it is artwork that you have permission to use in this way. No, you are not allowed to use my artwork for this.
If you would like to confirm my judgement as to not inadvertently abuse this rule, please do so! I am most easily reachable here on Toyhouse.
- Printing out a poster or sticker of my illustrations for personal use (e.g. for your room), however, is absolutely allowed - show me, I'd love to see!

- You may not, under any circumstance, use my designs or artwork for NFT uses.

- I may use the artwork I created of your design to advertise my work. I will not claim your character as my own.

- Do not claim my design as your original work. Where credit is due, link any of the following: Raccoony @ toyhou.se / pinucoon @ Instagram / mandytheraccoon @ deviantArt

- Co-ownership is permitted for no more than two individuals per character. However, you are only allowed to credit one toyhouse profile directly to my designs page, whereas any secondary profile must link me offsite!
- You are not allowed to 'sell/trade your half' of a co-owned character, to prevent loss of verifiable information. If the character must be sold or traded, ownership must be transferred in full. Please consult whoever is co-owning with you before you reach any decisions! Blacklisting is a possible consequence for those that do not abide by this rule.
