Guide to my profile!

Breaking my TOS will result in 1 strike. I’m less likely to give designs to you if you have a strike. 2 strikes = a blacklist! Scamming me or making NSFW of my designs will result in an immediate blacklist.

Terms of Service is contractually binding. By agreeing to this TOS and transferring the title of the design to you, an implied contract is created. An implied contract is a contract that did not have to be spoken nor written to still exist — and still be legally binding. By agreeing to this TOS, you also agree to the potential repercussions of breaking said TOS—which in some cases includes non-refundable title repossession.

In case of breach of contract in which the offer is not upheld, the contract of the sale is immediately void as you will have failed to fulfill your obligations under the contract—and your right to receive the character is revoked.

In case you think I am making this up to sound intimidating, I am a business law student. You can research these laws yourself. This is a legally binding agreement.

Those who have owned my characters before this updated TOS will be exempt from following any rules present here that they did not agree to when the TOS was originally read and agree to.

TOS:

- You must abide by my blacklist. I expect you to read it as well, it is found here. You are not permitted to sell my designs to anyone on my blacklist. If you do, you will be blacklisted as well.

- I won’t accept art from you unless you’re willing to add the original piece to my characters profile yourself. Otherwise, the art‘s original quality is damaged from me saving it. Please just do it yourself! It only takes a few minutes of your time

- You cannot sell my designs for more than they are given to you unless art is added to the design! You may resell for a fair price if you traded for the character!

- Never offer below the SB on my adopts!

- You are free to redesign a character however much to your liking EXCEPT for lightening skin, removing xeno/neo labels and pronouns, detransitioning trans characters, and anything else offensive of the likes!

- Money offers must be through PayPal only!

- **** Please do not lewd my designs. I am asexual and have s*xual trauma. I do not want any NSFW/s*xual art or stories made of my designs. Gore is okay. Fetishization is not. I do not care if you make the design of age, I, as the designer, am asking you to not lewd my designs under any circumstance. If I find out you’re doing this to my designs, you will be blacklisted and blocked unless you were unaware of the rule. There are PLENTY of other designs circling around the world for you to get and make NSFW for instead! I don’t see how this is too unreasonable of a rule, just use someone elses design for NSFW, not mine. ESPECIALLY do not make nsfw of my feral designs, MLP included.

- On that note, please do not involve my designs with backstories that include p*dophilia or s*xual assault. Just like with the NSFW rule, there are so many other designs in the world to channel your story into, please just don’t do it with mine. As an abuse victim I cannot bear to see my designs used for this stuff.

- If you are reselling/retrading/regifting my designs after agreeing to this TOS, you agree that you have a responsibility to inform the new owner of my design about my TOS so that they agree to it as well. 

- I don’t care if you like DSMP, but please I am asking you please, due to personal discomforts, please do not make my designs dream-based or make art of them supporting dream. Please respect this. I don’t care if you support dream, but understand I don’t 

- Please refrain from making controversial art with my designs! This includes using my designs to make ableist, homophobic, xenophobic, etc. art. In general I am not comfortable with the shaming of another sexuality with my OC, unless it’s something like shaming p*dos

- Please do not delete a character that I give you. If you do, such as you’re moving from Toyhouse, please inform me first!! I get very panicky if I notice a design I’ve given you is deleted

- Please do not buy a design from me only to redesign and immediately resell it. I expect at least a week and a half wait period before attempting to resell an adopt of mine, but this is open to private negotiation with me. There will only be a real issue if you are doing this before the elapsed time period with a higher price tag than you bought the character for. Unless there is added art, I do not give you the right to sell my designs for more, especially immediately after purchasing. Don’t adopt from me if you have these intentions. As this is a form of scamming, if I find that you are immediately attempting to resell the character for more after adopting from me, it is fully within my legal rights to remove the character from your possession and transfer title of the character back to me. In this case only, a refund will be offered.

- On that note, if you redesign a character from me, my TOS STILL applies to that character, as that character was still my original concept. You are NOT allowed to remove me as a creator of a design if you redesign them. Just put yourself as a designer underneath, but do not remove me from the credits.

- YOU ARE NOT ALLOWED TO MAKE NFTS OF MY DESIGNS. Do not buy if this is your intent. If you agree to this TOS, and you make NFTs of my design, I have the legal right to remove the character from your possession without refund.

- If I find out you scammed me such as trading me a stolen design or charging back on PayPal, I will take my design back from you without exception. No legitimate trade would have been made, and our contract would immediately be void, putting the title of the character back in my possession. It’s like stealing something from a store, even if you upgraded it you never got fair possession of the item in the first place, therefore it’s not truly yours and the title never transferred to you. 

- For art, you have 3 months max to complete the art. If you do not send me progress over those months, give me poor communication, and then end up backing out, you will get a strike. If you have an art-related strike, I’m less likely to accept your offer AND you’ll only be given 1 month to complete the art (if there’s several pieces I am willing to change this) Please keep this in mind before offering art!!

- You’re completely allowed to use my designs for commercial use, in fact I probably encourage it, just please inform me first! I’d love to see what you do with my designs :)

- To review, these are the circumstances I would revoke a character from you. These include: scamming, immediate upselling, feral nsfw of my designs, or if you are outed as a predator, groomer, zoophile, proshipper, racist, homophobe, etc. Refunds will only be offered to those who have attempted to upsell my design. The refund rule is subject to change. By agreeing to this TOS, you are making a legally and contractually binding agreement, and cannot back out of it if you happen to fit the criteria mentioned.

That’s about it! I mean this in the politest way possible, but if you break my TOS because you didn’t read my TOS, it is not my fault. From now on I will be reminding people to read my TOS and be sure they agree to it’s terms before adopting from me
