COMMISSION AND DESIGN/ART TOS

If you have questions, comments, or concerns about my TOS feel free to reach out to me. If you see someone breaking my TOS please inform me as well. By commissioning me or owning a design by me you are agreeing to adhere to these terms. Violating them will result it being privately blacklisted, repeat or extreme offenses will result in being publically blacklisted. I will not and do not revoke designs.

If you use any of my art that is not explicitly F2U or commissioned by yourself or use it in a way not allowed I will get said art/design taken down. This includes:

• USING MY ART OR DESIGNS COMMERCIAL USE OR FOR PROFIT. This means you cannot use any of my designs or artwork for merchandise or any manner that will result in you profiting from the work. I do not sell commercial rights to characters OR art.
• Using my art as an example of your own commissions.
• Using my art or designs for NFTs, crypto, or any other project, system, ect. ect. like it.
• Selling my art as an adoptable, or reselling a design as an original adopt. This includes breeding/offspring charts without explicit permission.
• Tracing my art or designs.
• Tracing my art or designs to make a profit.
• Using my art to add onto an ocs cost but adding more than you paid for the art (a $5 comm but putting it down as $6+).
• Using my art/designs as a face claim for rping or your own oc WHEN it was not a commissioned piece of art.
• Editing my art unless F2U and explicitly stated to be allowed.

You are allowed to:

• Use commissioned or F2U art on your profile with explicit and stated credit.
• Use payed for art and designs or F2U art offsite with explicit and stated credit.
• Repost COMMISSIONED art on sites such as toyhou.se with explicit and stated credit.
• Add commissioned art price onto the price of a character.
• Trade or sell characters that have been bought (but not for more than they are worth unless extra art has been added, commissioned or otherwise).
• Commission or create personal, nonprofit/noncommercial work of designs/ocs bought from me.
• Redesign/change the species of adopts bought from me so long as they are recognizable to the original and credit is still given. (This dont not include splitting designs. split designs MUST be sold together)

WHEN RECEIVING A COMMISSION...

• Know that I have every right to decline a commission for any reason.
• Only use a clear reference image. If I cannot make out the design I will ask for a clearer ref.
• Be aware I may used a commissioned piece of art as an example of a commission type. It will link back to the post though, and no credit for the character will be claimed. I typically ask for permission before hand as well.
• You will get a version of your commission before you have payed. However it will be watermarked heavily, and they will not be taken off until payment is sent. Payment is take after the art is finished.
• If you ask me to draw something that i've stated I won't I will either ignore you or tell you no. If you wish to persist I will not take a commission from you even if its something else.
• Make SURE that you state any special additions or requests when you send the commission in. I will NOT go back in to change the pose or completely redo it if you forgot to mention it until the end. MINOR EDITS or details i forgot will not result in an additonal charge.

• During the commission process, you will be giving wips and progress photos typically. The amount of these will depend on how complex or in depth the art is, but you will receive a wip of the sketch/lineart to make sure the pose and layout is to your liking. Cheaper, quick commissions are the expection to this. Ask if you'd like to see a wip for those.

CHARACTER MUST BE YOURS UNLESS ONE OF THE FOLLOWING:

• You're ordering art for a oc contest, in which win or lose the art WILL go to the winner of the comp.
• You're ordering gift art for a friend! In which case note me their user and tell me when to post it to avoid ruining the surprise.
• You're ordering fanart for a show, game, or other media property. Other commission rules still apply though.

POSTING THE COMMISSION SOMEWHERE WITHOUT CREDITING ME WILL RESULT IN BEING BLACKLISTED !

If it was an accident and you fix it when confronted then that's fine but if you don't and act like it's yours then we'll have a problem. FANART CAN NOT BE POSTED ANYWHERE EVEN IF IT IS COMMISSIONED. The only exception is if you explicitly ask and I tell you its okay. Do NOT post it without asking and more importantly without credit. This doesn't include using it as an icon, that is allowed without explicit permission.

SEND PAYMENT AFTER I TELL YOU THAT YOUR COMMISSIONS DONE! NOT BEFORE.

• Before receiving the final commission, you will get a watermarked version to make sure everything is fine and to your satisfaction. This will also be when you are asked to pay. Upon your review and payment being sent, you will be given the unwatermarked commission.
• Failure to send payment after multiple notices and responses will result in the canceling of the commission. EX. I message you 3 times, you respond okay each time and still never send the payment. If you will be delayed in sending them PLEASE just inform me.
• I won't blacklist you if you don't send payment (because you wont get your art until you do anyway), But i will not take another commission from you until youve payed off the last one.

OTHER INFO TO BE AWARE OF:

• READ MY TOS. If you claim to have had no idea what my rules were that isnt a valid excuse and depending on the severity of what you did I will either blacklist you or hesitate to work with you again. My tos is easily accessible from my profiles and my adopts, by buying anything from me you are automatically agreeing to my TOS
• Its 2 strikes and then your out when doing lesser rule breaks (genuine accidents and mistakes will not be contented towards this).
• If you have a question or concern regarding a commission or design, MESSAGE ME. I am in EST but active fairly often on my Toyhou.se from 8am-10pm. I will try to get back to you ASAP.
• If I find out you've broke my TOS the following can happen:
• If you broke a design TOS, the character you will be sent a notice to either not do it in the future or stop the sale.
• IF you do it again you will be blocked and blacklisted.
• The design WILL NOT BE REVOKED. I do not have the power to revoke design, but you may be publicly blacklisted from owning my designs in the future depending on the severity of the events.

If art TOS were broken the following can happen:

• You will be notified. Failure to comply will result in a warning
• Repeated offenses will result in a block and blacklist.
• IF YOU USE MY ART/DESIGN FOR PROFIT, YOU WILL BE PUBLICLY BLACKLISTED AND BLOCKED.

IF YOU BLOCK ME AFTER COMMISSIONING/ADOPTING FROM ME...

• I will not revoke the art or designs you have received from me.
• You will, however, be blacklisted and barred from interacting or receiving my work in the future. This includes getting art directly from me through friends or other users, getting designs of my via trades or vouchers, or any other means.
• If you unblock me, and are going to get my art and designs again, or attempt to, message me. Otherwise you will not be removed from the blacklist and continue to be blocked from getting any of my work.
• If I've blocked you back however, it's likely because I will not remove you from the blacklist and do not want you to interact with me or my work again period. DO NOT BLOCK EVADE ME.

WHAT I WILL DRAW

• Furries/Anthros.
• Humans/Humanoids.
• Feral ocs (any animal).
• Simple to moderately complex designs.
• Simple to moderately complex armor/mech.
• Oc x Canon/selfship content (ask).
• Fanart for shows. (Depends, ask)
• Fandom ocs. (Depends, ask)
• Simple to somewhat complex backgrounds. (ASK)
• Candy gore (ASK.)
• Light regular gore (ASK)

WILL DRAW, MAY TAKE LONGER
These are things that I am not well versed in drawing, but willing too should you desire it. Understand these may take longer/require more communication with you to make sure everything is as it need to be.

• Complex ocs (detailed armor, dragons, ask).
• Very muscular people.
• Very curvy people.
• Story/lore very art (this includes comics)
• Complex/detailed backgrounds.

WHAT I WONT DRAW

• Hate art.
• Violent art.
• Heavy gore.
• Shota/loli/ whatever.
• Drug related content.
• 'Proship' content (incest, adultxchild, ect.ect)
• NSFW/Extremely sexual characters (includes fetish ocs).
• Ocs named Lilith or Sabbath, especially if they are occult/demon themed. Other demon/occult ocs are fine.
• Military/war themed ocs and drawing. Doesn't matter if it's fictional or not, do not ask.
• Any character with utters or multiple breasts. Don't even ask it will be a no.

BY COMMISSIONING ME, BUYING DESIGNS FROM ME, BUYING ART FROM ME, OR OTHER SIMILAR WORK YOU ARE AUTOMATICALLY AGREEING TO FOLLOWING MY TOS.
