- Terms of service and understanding what the species is:
- In purchasing an original design created by me, you are automatically accepting the following terms and conditions. If you are interested in purchasing a design from me, please read the following TOS. The TOS are readily and easily accessible on every design auction or group page, so there is no excuse to not have read them. Send me a note or comment if you have any questions or concerns. - Current Closed Species: Kopiimochi
- What does it mean to have a closed species?
- The concept of a Closed Species is one that has been designed by a creator who has decided to restrict access to their creation for the public. Individuals without explicit permission from the creator(s) may not create their own version of the species. Designs for the Species can only be created by the official creator(s).Depending on the species, it may only be available for purchase or trade as an adoptable. Designs created by a bootlegger or not created by the original creator(s) are not considered official. The creator(s) of an Original Species can copyright any design they make and can trade mark the name of the species in order to deter copying, so please be aware of this when creating or naming characters that closely resemble those already existing. Creators are able to take legal action against these types of offenses.
TOS:
- These rules apply to every Closed Species that I AtelierKopii have create.
-Unless I give you explicit permission, you may not create your own Species design. Permission can take several forms: I have given you the title of "Guest Artist",
where you can design a character for auctions, DTAs, OTAs, et cetera. You have won or purchased an official MYO (Make Your Own) or Custom slot. I am also able to create a customized design for you.
-Any name you want, a personality, a backstory, a gender, etc., may be chosen for any Species design obtained. As much as you like, you can also change the clothing or accessories that a character wears. If you wish to alter any of the original markings, colors, or body designs, you must first seek my permission (AtelierKopii). The original art created by AtelierKopii or Guest Artist may not be altered.
- A design may be traded or resold for no more than the price you had originally paid for it. Even so, if you have created more artwork on the design, the price may be increased according to how much art you have created and what it is worth. If the item has been traded or sold, please also notify me so that I can update the owner list.
- Any Closed Species design that is obtained from me or guest artist must be credited to me, the species and the artist the first time it is used. Each time the original art of the design is used, it must be credited to me. As long as the original work is credited and referenced back to one of my galleries, you can post it on your website. The work may also be used for any personal use that you desire, including, but not limited to, icons, signatures, layouts, wallpapers, themes, and personal site displays. However, you may not reproduce or reuse any design by me for profit, which means that you may not create merchandise from my designs for sale.
- By purchasing a design from me, you are only purchasing my labor and a partial right to the design. I retain all rights to my work, including but not limited to rights to distribute, reproduce and use it as a sales or self-promotion sample. Unless I somehow get the design back, I will not re-sell a design that has been purchased from me.
- You must wait a period of time before purchasing another design from me.You may purchase up to 3 batches but must wait 48 hours to make another purchase.
-no co owning, no bidding help. All purchases must be made by one person. By purchasing a kopiimochi or joining the group. You are agreeing to the terms and conditions. All users cannot get a refund once the item is purchased. All users must consent to the final price before purchasing once it is complete it is complete.
-charge backs will get you banned and blacklisted.
Payment:
- Currently, I only accept cash (USD) payments through PayPal. Points are worthless to me since I never purchase anything on DA.
- Invoices are sent to clients who purchase designs from me. If you send me any payments before hand, they will be refunded.
- If funds are not sent within 24 hours of your request being accepted, your request for ownership of that particular design will be forfeited, and the design will be put back on the market. A full, unwatermarked design will only be sent after payment has been received.
- For design bids/prices over $200, payment plans are available. For the design to be held for you, you must pay at least half of the total amount up front, though. If you are unable to make the rest of the payment by the deadline we agreed upon, you will forfeit the design and I will put it back on the market. Your payment will also be refunded.
- You may resell a design for the same price you purchased it if you are truly unhappy with it. Do not purchase the design if you do not actually have the funds to do so. Pre-made designs are not refundable, and I do not want to put you in the negative financially. Be aware of your budget before purchasing. Prioritize the necessities over the luxury items (food/water/shelter). Art is a luxury item.
- I reserve the right to blacklist and ban anyone from owning any of my adoptables.
