The Sanctuary of Ardour is PG 13. Ardour as a group might loosely reference the philosophy of emotions and what they could be interpreted as, especially when it comes to the Hollows species within this group. Please do not apply these philosophies to yourself, or your daily life. This is a work of fiction and does not reflect how the group feels about others within the group or the world at large.

While the group may touch upon complex feelings such as depression, anxiety, mania, etc. We will NOT be discussing triggering topics such as real-life tragedies, self-harm, human loss, human disorders, and so forth.

We may also use verbiage that is traditionally linked to religious viewpoints in its stories and characters. This is all for the purpose of storytelling and crafting a fun fictional game. We will not use any real-life religious figures or faiths within its story. Sanctuary of Ardour will not use its platform to discuss real-life religious figures or faiths, everything used is and will be fictional.

Everything within the Sanctuary of Ardour should be kept as a work of fiction, and while we encourage you to express yourself please be conscious of others. If you're in doubt about any personal storyline, character, or used emotion, please reach out to a mod.




Species Ownership Information

1.1 Hollows are a closed species founded by Traumlaterne /deviantart.com. The ownership was transferred over to TeaLeo in 2019. All Co-species (Seekers, StarQuills, Husks, etc.) were founded by TeaLeo. For the sake of simplicity, Hollows and Co-Species are umbrellas under the term “Ardour” or “Sanctuary of Ardour”.

1.2 As a closed species users do not have the right to create their own official Hollow or Co-species within or outside the group without expressed permission. Unofficial designs, mimicries, etc. will not be accepted within the group or community and can result in a suspension or full ban from the group and its community.

1.3 This Terms of Service applies to the Sanctuary of Ardour and Co-species community found on multiple platforms such as Deviantart, Toyhou.se, and more. These Terms of Services will apply to any and all community sales, games, and events. Please be sure to read the Terms of Service carefully before participating within Ardour and its Co-species on any platform.

1.4 Please note that these Terms of Service will override those of guests and affiliates within the Ardour brand. By participating in the Sanctuary of Ardour’s group, website, sales, and events you are agreeing to adhere to these Terms of Services listed below.

1.5 We reserve the right to refuse all services and community access to any User, Guest, Moderator, or Affiliate who breaks TOS agreements and guidelines. Claiming ignorance of the TOS will still result in disciplinary action in accordance with the offense as outlined below.


Changes to the Terms of Service

1.1 As the community grows updates to the Terms of Service will occur. All revised versions will be posted and/or linked to on all platforms Ardour content is hosted. It is recommended to check back on these Terms of Services from time to time to make sure that you, the user, are participating within the current TOS.

1.2 Deviations outside the TOS can lead to warnings, suspensions, and bans depending on the severity of the offense.


Terms of Service Terminology

  • “TOS” - Shorthand for “Terms of Service”.
  • "Ardour" and “Sanctuary of Ardour” - Refer to any character within the official universe (e.g. Hollows, Seekers, StarQuills, Husks, etc.).
  • "FTO" - Stands for "First Time Owner" who is someone who has never owned a Hollow or Co-species before.
  • “MYO” - Shorthand for "Make Your Own".
  • “DTA” - Shorthand for "Draw to Adopt".
  • “OTA” - Shorthand for “Offer to Adopt”.
  • “TH” - Shorthand for the website Toyhou.se. A website where an art community group for Ardour is hosted.
  • "User” - Refers to any individual participating within the Ardour community.


Community Disclaimers

1.1 Ardour and its Co-species are a closed species. Only official Species designs are allowed within the community. We withhold the right to exclude other mimicry designs and to ban those who disrespect the species rules and TOS.

1.2 As a whole, Sanctuary of Ardour is based on a PG-13 community. We will not accept or tolerate any form of overly mature content posted on any of our platforms. This includes sexual or suggestive material or inappropriate language and behavior. Light gore, violence, etc. can be accepted if it is based in fantasy and has the appropriate tags and spoilers.


Rejection and Refusal of Services

Harassment

1.1 The community of Ardour has zero tolerance for bullying and harassment of its members. If you are being harassed as a user of the species or over a design that you own, please reach out to someone on the moderator team. Warnings and/or consequences will be carried out by staff to any offending parties within the group.

1.2 Moderators can only intervene in Ardour and Co-species related issues and conflicts. If the issue you have with another user doesn’t relate to the group or to the species, we cannot intervene as moderators of the group. Serious issues should always be redirected to site staff or other site report systems.

1.3 Depending on the severity, harassers will be given a warning on the first offense. Second offenses will result in a ban from all Ardour platforms, sales, and events. Further offenses will result in a permanent ban.

1.4 Do not confront, harass, or bully others outside or within the group for suspicion of copying Ardour and Co-species designs or concepts. If there is ever concern over potential knock-offs or copying please let moderators know in private and refrain from speaking on Ardour or the team’s behalf.

Banning

1.1 Bans outside of temporary auction bans or temporary conduct bans are permanent. Permanent bans are from the group found on all official platforms as well as official adopts. You will be notified if you are banned and you will be given reasons along with any provided proof available if allowed by other parties. If you would like to file for an appeal, respond with your rebuttal and we will re-evaluate the case IF the option is given. If there is no option for repeal, it will be stated in the note.

1.2 Ban notices are only sent out by group admins. If someone sends a fake ban notice, notify a moderator so it may be dealt with promptly.

1.3 The following list includes, but is not limited to, reasons for banning:

  • Continuous harassment and/or bullying of users and mods.
  • Purposefully inciting drama.
  • Disobedience towards warnings for TOS breaks.
  • Scamming.
  • Continuous scalping attempts or successful scalping.
  • Dishonesty such as faking receipts or faking identities.
  • Ban evasion.

1.4 If you are banned, you may not use your Ardour designs within the group or any group activities. You are still able to trade, resell, or void them from the masterlist, but breaking trade/resale rules in the TOS will result in blacklisting.



User Ownership and Documentation

1.1 All Ardour species will be available through various means such as, but not limited to, official sales, raffles, MYOs, etc. These designs are not officially owned by the user until full payment is received.

1.2 When purchased, the owner has full rights to the character’s artwork and autonomy over the character’s development.

1.3 All currently owned Hollows, MYOs, and Co-species are logged and kept through a visual masterlist found here.

  • This masterlist is the only acceptable proof of ownership within the group. All Ardour and Co-species trades, transfers, etc. should be completed via the rules listed on the masterlist to officially update the proof of ownership (see how-to steps in the site’s FAQ). If any complications persist, reach out to a group moderator.
  • No one within the group has the right nor has the power to revoke a design legitimately purchased from them. This rule extends to all guest artists.

1.4 The Ardour group does not recognize co or multi-ownership of one or more characters. Only one owner will be recognized by the masterlist and overall groups.

  • Co-ownership may happen in private without punishment from the group. However, any ownership disputes will not be dealt with by the Ardour team.
  • The owner listed on the masterlist is the one that will be recognized until officially changed.

1.5 Any suspicious accounts or users may be refused service on sales and events.

1.6 The user has partial rights to the group and community activities. If the user fails to abide by TOS regulations after fair warning, their character may be:

  • Removed from the group’s protections.
  • Revoked access to future group events.
  • Marked as “delegitimize,” or “retired” in the registered entry in the master list.

1.7 Users that receive an Ardour species through legitimate means may not:

  • Claim the Hollow or Co-species as their own creation or claim the design as their own creation if it was not designed by them.
  • Trace or recreate Hollow or Co-species designs for any sort of public use or commercial purposes.

1.8 Violations of any of the above will result in moderator action and consequences.


Trading & Transferring

1.1 Ardour owners are free to trade and gift their characters to other users. When a character is gifted or traded a post must be made on the masterlist for it to be officially recognized within the group.

1.2 Advertising Trades - You may advertise that you are looking to trade or transfer your currently owned Hollow or Co-species in many different ways. A few of the most popular ways are:

  • Submitting a trade thread within the Ardour TH group. Be sure to follow the submitting rules found within the group.
  • When advertising, always include a link to the masterlist entry of your character.

1.3 Reselling Traded Characters - Any Hollow and Co-species received without the exchange of USD or equivalent currency cannot be resold. This includes trading for any merchandise that is for sale as this is still viewed as a monetary exchange. You may still trade a character for physical goods so long as it is not something a user would need to purchase in advance or at the time of trading.


Reselling

1.1 Ardour species can only be resold if the current owner previously purchased the character. The easiest way to see how much a design is worth is by viewing the masterlist. A few rules should be followed before reselling a character.

1.2 Higher Price Resells - A character cannot be resold at a higher price than what they were originally purchased for. This is to prevent “scalping” or buying and hoarding designs with the intent to sell them at a higher price.

1.3 Appraisals - A user cannot receive the full resale price and more unless they have commissioned art of the design. Users can choose to resell up to the price they paid for the design and commissioned art. Proofs of purchase for commissioned art must be provided. Users cannot resell their design for more than they paid by adding on commissioned art if they themselves did not purchase the commissioned art (they can only resell the design at the value it was purchased at).

1.4 Reselling Traded Characters - Any Ardour and Co-species received without the exchange of USD or equivalent currency cannot be resold. This includes trading for any merchandise that is for sale as this is still viewed as a monetary exchange. You may still trade a character for physical goods so long as it is not something a user would need to purchase in advance or at the time of trading.

1.5 Reselling MYO Slots - MYO Slots can be resold as long as they were purchased via USD or equivalent currency and were not a result of trading, contest winnings, free events, prizes, etc.

1.6 Reselling a Resale - After a user-to-user resale transaction, the user who purchases the resold Hollow, Co-species, and/or MYO Slot cannot resell it for any more than what it was just purchased for. (For example, an MYO was originally purchased for $50. It is then resold to another user for $30. At this point the MYO cannot be resold for anything more than $30.)


Redesigns

1.1 Redesigning is only allowed on current Hollow and Co-species a user currently owns. Redesigns should not be treated as MYOs or Customs, instead, they should be viewed as a way to make minor changes to a current character. Please review the redesign guidelines in the forums before submitting a redesigning.



Adoption and Reception Guidelines

1.1 Note: Users do not need to own a Hollow or any of its Co-species in order to participate within the community and most of its events. See more during event postings.

1.2 There are multiple ways to receive a Hollow and its Co-species within the community- below is a list of all possible and legitimate ways to receive one. Any purchases, trades, gifts, etc. made outside the rules listed below could result in a suspension or ban from all Ardour group platforms.

1.3 Auctions - Auctions can be held to sell Ardour species to potential buyers. Official group auctions are held within the Toyhou.se Group. However, there are a few rules and courtesies users should be aware of before participating in one of our group auctions.

  • Starting Bid - or SB for short is the starting price of the offered adoptable. Offers below this number cannot be placed.
  • Minimum Increase - or MI for short is the minimal increase that you can offer against another user’s bet.
  • Auto Buy - or AB for short is the maximum a design will go for during that particular auction round. For example, if the current AB is $150 a user cannot offer $151+
  • Participating - Do not participate in an auction if you do not have enough funds to pay for your own bid. Even if you are not the current highest bidder unforeseen dropouts may occur leading to your most recent bid being chosen. Please retain any funds that you bid, you are individually held responsible for what you offer.
  • Dropping out - If a user is currently the highest bidder dropouts are not allowed. If a dropout is made the user will be temporarily suspended from any future Ardour adoptions (not just auctions).
  • Editing Comments - Do not edit or hide your bidding comment. Editing your bid to be higher or lower than your original bidding amount will not be tolerated and will be grounds for suspension.
  • Courtesy - When an auction is held on Toyhou.se or an equivalent messaging chain website, it is preferred that when bidding you directly reply to the current highest bid. Keep all questions and comments about the auction, art, pricing, etc. outside of the created bidding chain.

1.4 Flat Sales - Unlike Auctions, Flat Sales have a fixed, unfluctuating, price for each design. Prices for Flat Sales are set by the artist and can fluctuate, however, there are no Starting Bids or Auto Buys allowed. Flat Sales are always first come first serve to everyone within the community unless specified for FTOs. Here are a few rules and courtesies users should be aware of before participating in a Flat Sale.

  • Bargaining - Do not bargain or offer different amounts of items or currencies on a Flat Sale adoption that is not listed within its official post.
  • Editing Comments - Do not edit or hide your offering and/or claiming comment. Edited comments will be ignored on all Flat Sales as they come off as deceptive.
  • Claim Buffer - When claimed, a design will be held for that user for a predetermined amount of time specified within the description of the sale, often 24 to 48 hours. This buffer time is meant to give the user adequate time to send the payment, if full payment is not received before the end of the buffer then the seller has the right to give the buying opportunity to the next claim in line.

1.5 OTA - Offer to adopt or Name Your Price, are sales that may be hosted by the artist. OTA’s will not follow the conventional Flatsale or Auction rules, instead, the artist will give a list of items, currencies, artwork, etc. they may be interested in trading for posted Ardour design. Here are a few rules and courtesies users should be aware of before participating in an OTA.

  • Bargaining - Do not bargain or offer different items, currencies, etc that are not listed in the official OTA post. (ie. do not offer artwork for a design that is requesting in-group materials.)
  • Participating - Do not participate in an OTA if you do not have an offer you can keep. Please retain any funds, items, etc. that you offer, you are individually held responsible for what you offer.
  • Editing Comments - Do not edit or hide your offering and/or claiming comment. Edited comments will be ignored on all OTAs as they come off as deceptive.
  • Claim Buffer - When claimed, a design will be held for that user for a predetermined amount of time specified within the description of the sale, often 24 to 48 hours. This buffer time is meant to give the user adequate time to send the payment, if full payment is not received before the end of the buffer then the seller has the right to give the buying opportunity to the next claim in line.

1.6 FTO Events & Sales - All FTO events, sales, etc. are occasionally available for users who have never owned a Hollow, Co-species, or any related MYO within the group.

  • All rules for auctions, sales, events, etc. still apply to FTO events and sales.
  • If a user attempts to purchase an FTO Ardour species when they are not an actual FTO user:
  • You will be revoked from owning the design and will be refunded in full (minus tax) if the currency has already been exchanged.
  • The design will be put back up for another FTO to claim.
  • You will be banned temporarily from all future sales and events.

1.7 Customs - Customs are unique Ardour designs created only for the purchasing user. Often the user is able to request the look, color, type, and more of the species being created. Customs are not always open but can often be acquired through auctions or flat sales- be on the lookout for journals or posts announcing custom openings. Here are a few rules and courtesies users should be aware of before ordering a custom.

  • Availability - Customs are only available through Admins. Admins will post when their customs are open, along with their personal terms and conditions. Be wary of any other posts offering custom designs as they could be fraudulent.
  • Pre-Existing Designs - Customs cannot be based on any pre-existing OC designs unowned by yourself (no mimicking, copycat, and/or mirroring of designs). Purposely creating a copy of a pre-existing design is grounds for a warning or ban based on previous offenses.
  • Copyrighted Characters - Though your new Ardour can certainly take inspiration from copyrighted material and characters, please refrain from “morphing” a specific character directly into an Ardour.

1.8 MYO - Much like customs, users have creative freedoms after acquiring an MYO. When a user has an MYO slot they gain full creative freedom over their Hollow and/or Co-species as long as they keep within the guidelines of Rarity System found on said Ardour’s page. Here are a few rules and courtesies users should be aware of before using their MYO slot:

  • MYO Slot - Users may not make their own Hollow or Co-species without first acquiring an MYO Slot for the respective species. If a character is created without an MYO Slot it will not be recognized by the community.
  • Rarity Tier System - MYO slots are sold in tiers allowing the designer to use any number of traits that are within their respective tier and lower. Tiers and traits can be viewed on each respective Ardour’s character entry found under “Known Creatures” in the Mythic Tome.
  • Expiration - MYO Slots do not expire unless otherwise stated (ie. 24-hour Free MYO Events).
  • Designing - You may commission someone to design the MYO for you, however, all rules still apply. If applicable, staff members and guest artists may be available for the commission.
  • Pre-Existing Designs -Customs cannot be based on any pre-existing OC designs unowned by yourself (ie. no mimicking, copy cat and/or mirroring of designs). Purposely creating a copy of a pre-existing design is grounds for a warning or ban based on previous offenses.
  • Copyrighted Characters - Though your new Ardour can certainly take inspiration from copyrighted material and characters please refrain from “morphing” a specific character into an Ardour.
  • Availability - Like customs, MYOs are not always open or available to purchase, so be sure to stay up to date with journals and posts announcing upcoming MYO sales and events.

Recognized Currencies and Payments

1.1 Below is a list of currency that is available for official transactions within the group. Anything used outside of this list or any characters sold outside the group should be met with caution.

1.2 Glimmers - Glimmers are the group's "in-game" currency. This currency cannot be exchanged for any real-world value and does not exist outside of this group.

  • Glimmers are available to every user and can be earned by participating within the Ardour community. They are often given out as rewards for completing prompts, events, and more. Users may also use Glimmers as a valid type of currency within the group when opening commissions.

1.3 USD (PayPal) - USD (United States Dollar) is the most common currency used within the group. Only through PayPal can physical currency be exchanged - direct deposits, checks, wire transfers, etc. will not be made as an official transaction.

  • If you live outside the United States and use another currency PayPal will automatically translate your currency into USD as payment - please be aware that PayPal may charge a small transfer fee when transferring different currencies.

1.4 Other - Guest Artists, Resellers, etc. may also accept onsite currencies, gift cards, game currency, or anything else that has a specific USD value placed upon it. We ask you to use your best judgment when it comes to these offers as some may not offer fraud protection the way PayPal and other onsite currencies do.


Payments and Payment Plans

1.1 Ardour species can be sold officially by Artists and Guest Artists for any of the currencies outlined above. It is important that you, the user, pay close attention to the description and rules of each new auction, FTO adaptable, flat sale, etc. that you are interested in. Each new post could have specific rules and payment types that you will have to follow in order to participate in the sale.

1.2 Payments Through Paypal - PayPal transactions will only be conducted via invoice. The seller will reach out to you privately on your platform of choice to ask for your email. An invoice will be sent to your email and will be used for proper archiving of purchase history with a copy of the TOS for digital goods included for the buyer.

  • Please note: If you live outside the United States and use another currency PayPal will automatically translate your currency into USD as payment. Please be aware that PayPal may charge a small fee when transferring different currencies.
  • Please refrain from using a shared PayPal account for purchasing. It is the purchaser's responsibility to compensate the artist in full if a third party is stalled.

1.3 Payment Plans - Payment plans may be available on certain sales if a set amount is given. If it is offered, payment plan rules set by the artist and/or seller will be listed within the description. Be sure to read thoroughly before participating in a plan.

  • If payment is not given in full by the time limit set by the artist/seller the user will be refunded all payments given during the plan along with any down payments made beforehand. The user will then receive a warning and the design will be resold.
  • If the user is unable to pay for a short amount of time within the payment plan period, it is encouraged to reach out to the seller to see if any grace periods can be arranged.
  • Failed payments will result in a temporary auction ban.
  • Any attempted or successful chargebacks will result in a ban from the species as a whole.


Leaving The Group

1.1 At any time users are free to leave the group on any and all platforms any time they wish. Upon leaving users may keep all characters, items, and currencies they have collected and gained.

1.2 Users do not need to notify the moderation team of their leave.

1.3 Users who leave the group and still own a Hollow or Co-species - it is required for this user to still stay within the guidelines of trading, gift, and reselling when planning to do so with said characters.


Voiding and Retiring Owned Characters

1.1 It is possible for users to retire (or void) their currently owned Ardour character from the masterlist. Doing so offers the availability to transfer this character into a One-Off Design status. This status effectively removes the desired character from the official masterlist and group to be used elsewhere. There are a few key things to know before a user retires their character.

  • The user does not need to leave the group to retire any of their Ardour characters. Retirement can happen at any time.
  • The retired character cannot be used within the group’s events, games, etc.
  • The character will be hidden from the public masterlist. Moderators will still be able to view the character.
  • It is advised for the owner to keep note of the now retired Ardour character’s old master list number and to hand off this number whenever this character is transferred to another owner.
  • To remove the retirement status of a character an appeal must be made. Instructions for said appeal will be listed in the group.
  • A retired Ardour character cannot be sold or advertised as a Hollow or Co-species.

1.2 In order to transfer your Ardour into retirement status, the current owner must contact the moderator team requesting such.

1.3 Likewise, in order for a Hollow and/or Co-species to be added back into the Ardour group, the current owner must show proof of purchase/trade (if the owner has changed), have the Masterlist number handy, and request to be put back onto the masterlist by the moderation team.
