TERMS OF SERVICE

GENERAL

• Tomoyokis are a Semi-Open species, meaning that you are able to make Common, Uncommon, and Rare, Tomoyokis free.
  • Super Rare Tomoyokis cannot be made freely and still closed within the species.
  • Mutation traits cannot be used freely and are still closed within the species.
• Tracing, copying, or stealing, of anyone's designs, art, or otherwise, can result in penalties.
  • This action also applies for utilizing outside or non-Tomoyoki art within Tomoyoki art or designs.
  • If utilizing bases for any Tomoyoki art, credit MUST be given.
• Chargebacks for any adopts, or official mod-made Tomoyokis can result in a ban and reselling of the adopt.
• By participating in the species, you are agreeing to have read and understand all rules.
  • If you have any concerns or questions regarding any rules of the group/species, as well as the terms of service, please contact the group.

COMMERCIAL USAGE.

• Tomoyoki adopts, customs, etc. made by the Tomoyoki team may be used for portfolios, advertising, etc. for the species.
  • Tomoyokis used in this regard will not be used for financial gain or otherwise.
  • We will always ask permission before using any Tomoyoki for any type of advertisement purposes.
• Owners can use their Tomoyoki for personal and commercial use, including merchandise, projects, and so on.
  • Most commercial usages of Tomoyokis are a case-by-case basis, and depend entirely on the intended usage.
    • Users that intend to use a Tomoyoki commercially must receive approval from the designer (if applicable) and follow all rules designated by that designer.
  • Tomoyokis that are intended to be utilized commercially should notify the team of usage.
    • Note: Tomoyokis are a PG-13 community and species, NSFW content involved with commercial usage should be properly marked and restricted to prevent access to minors.
  • Tomoyokis that are utilized commercially should give credit to the species, designers, and art credit.
    • Under no circumstances do we allow for minors to mass produce content or otherwise.

DISCRIMINATION/HARASSMENT

• Tomoyoki Tavern will not accept any submission of Tomoyokis with the following words: trap, femboy, shota/loli, etc.
  • Submissions using these words will be denied, and we will ask you to remove or change the words.
  • In cases of the usage of shota/loli, we are within are rights to issue proper punishments depending of the content of the character.
    • These words often center around the connotation of pedophilic attraction, with shota and loli indicating young boys and girls, respectively.
• We do not tolerate the harassment of Tomoyoki members over their designs.
  • Continuous or incessant asking, or giving unsolicited offers, for Tomoyokis both up (and not), for offers, sale, trade, or otherwise. This will result in a first time warning, continued or repeated offenses will result in proper punishments.
  • Guilt tripping, begging, or coercion, is not tolerated. We ask for those who are experiencing this to please submit evidence so that the mod team can officially and properly handle these situations and give out proper warnings, strikes, or possible bans.

Disclaimer: While we can handle situations within our official Tomoyoki groups and servers, we are not directly responsible for private interactions between users. As well, individuals involved in outside drama or events is not within our control or domain.

NSFW WORK + TOPICS

• We at Tomoyoki Tavern absolutely do not allow for NSFW, or sexual content, to be made of minor or underage characters. We also do not allow for minors to create, or distribute, NSFW content of their characters, regardless of that character's age. This is regardless of if they're a Tomoyoki or not.
  • NSFW content made by minors, or distributed by a minor, will result in proper punishment depending on the severity of the content. Repeated behaviors will result in a Ban.
  • NSFW content, regardless of age (adult/minor), knowingly made for a minor will result in banning from the species.
  • Knowingly receiving NSFW content BY a minor can also result in being banned from the species.
• Content that does NOT include any of the above, and the creator is a legal adult, we have no say in what can be done.
  • This allows for 18+ Tomoyoki members to create NSFW art, or concepts, for their characters with no say from the mod team.
    • Tomoyokis that contain NSFW content should be properly marked and restricted.
  • Tomoyokis that contain NSFW content cannot be traded to minor individuals. Attempts to do so will result in proper punishments.

LIABILITY

• The Tomoyoki team are not responsible for handling personal situations that may involve a Tomoyoki member. We are here to help in any rule breaking, scamming, or foul play.
  • The mods at Tomoyoki Tavern cannot control, moderate, or otherwise influence, situations that do not directly involve or relate to Tomoyokis. We can only moderate, or control, Tomoyoki Tavern and member conduct related to or within the group. We do not condone, nor appreciate, digging up information or drama on any members to stir up trouble/drama.
  • Members are able to block anyone that makes them uncomfortable, in anyway.
  • Mods are not responsible for fights between friends, general drama, trades gone sour, private drama, or other similar situations.
• Issues with members can be directly reported to the mods, we are happy to help the best we can. We are also able to determine if we, as a species, are able to do anything about specific behaviors.
  • Information about these events do not need to be disclosed directly. If you are in need of updates or information, you are free to ask, but this is, of course, dependent on the situation and is not required to be given.

BLACKLISTING
For public safety, you can view our blacklist here.

• Tomoyoki-Tavern utilizes a four step system, steps can be skipped based on proper consequence for the situation.
  • One Formal Warning
  • One Strike
  • Event Ban
  • Permanent Bans
• Reasons for banning differ from case-to-case basis. Typical ban-related content includes: creating, interacting, or posting, egregious content (re: NSFW WORKS + TOPICS); endangering, harassing, or causing immense discomfort to the community within reason (re: DISCRIMINATION/HARASSMENT), and similar contexts.
  • We allow for individuals who receive a temporary bans to appeal to the team at a later date, indicating improvement, change, or otherwise.
• Individuals on the blacklist can sell, trade, or gift Tomoyokis if permitted.
  • This will remove blacklists as needed.
• Individuals banned due to egregious content or discriminatory actions may have their Tomoyokis auto-voided from the species.

TRADE, SALE, GIFTING RULES

• Tomoyokis made after the opening of the species (11/2/22) can be sold for a base price of 35$.
  • Tomoyokis may be sold within reason, but cannot be made specifically as adoptables.
• Tomoyokis can be traded, sold, or gifted, for anything included real world items, digital goods, services, etc.
  • Vouchers, items, or other similar content, should be priced fairly within the general cost and price of your Tomoyoki.
  • Vouchers, items, or similar content, cannot be priced over the original worth of a Tomoyoki.
  • Any attempts to take back a Tomoyoki once a trade has been completed, unless canceled by all parties involved, will result in proper punishment.
• Additional worth can be added to Tomoyokis by commissions and personal art.
  • Personal art can only be counted if it is a "polished" piece, meaning rough sketches or "memes" cannot be added to the value of the Tomoyoki.
  • Gauging the worth of a Tomoyoki is the responsibility of the buyer and seller.
    • Please report any problems of overpricing to the group or owner.
• Tomoyokis do not need to be appraised; however, here is a list to help determine a Tomoyoki's worth, whether bought, traded, or gifted.
  • If the Tomoyoki was bought as an adopt, that worth must be listed.
  • Commissioned art must have its worth listed.
  • Personal art must have its worth listed.
    • Personal art must be based off of current commission prices.
    • Sketches and "meme" doodles do not count towards this worth.
  • While we discourage adding art received in a trade to the price of a Tomoyoki, if permission is given by all member's involved in the trade, value can be added.
    • This is based upon the involved individual's current prices or proposed price.
  • Art obtained as a gift, raffle, request, or otherwise free, do not count towards a Tomoyoki's worth.
• Members may raffle off Tomoyokis for free to the community at any point.
  • There is no gain to be made when raffling off a Tomoyoki, such as subscribing, favoriting, draw to enter, etc...

CO-OWNING

• Tomoyokis are allowed to be co-owned by multiple people.
• Tomoyoki Tavern is not responsible for any disputes between owners regarding co-ownership.
  • This rule is waived if the disputes may involve scamming-like behavior.
    • Such as monetary, trade, or otherwise, gains that is not conducted by the primary owner.
