Terms of Service

Baabies is a closed species Art Roleplaying Group (ARPG). The group  is casual and owners are not obligated to join in on the group  activities.

Below you'll find more information on Baabi ownership,  character usage as well as character transfers. If you have any  questions, please comment below or DM our group directly.

By obtaining a baabi or associated pet species, you are hereby agreeing to the following terms.

Overview

• Baabies is a closed species created by Pinkaboo-Hime and MiniMahou and owned by Zero8426. Baabies can not be reproduced without the owner’s permission.
• Baabies  reserves the right to deny services to any considered by the team to be  a threat. If an individual falls within this list, they are prohibited  from owning a Baabi.
• You may not create a Baabi without a MYO slot.

Credits

• Creator rights must be given to Baabi-Book for all Baabies, regardless of designer.
• All adoptable designer rights must be assigned to the correct individual.

Conduct within the Group

By joining Baabi, you agree and understand that you have to abide by rules set by the creator and team.

• You must be over 16 to join and participate in Baabies.
• You do not need to own a Baabi to be active within the group.
• We aim to be a fun group and do not permit discussion of triggering subjects (ex. murder).
• Do not harass/target others. A warning will be issued if you do so.
• While  we do not encourage offbranding/fanCS, the team discourages and  disapproves of harassing users who create such characters. A warning  will be issued if this is reported to us with proof.
• Do not make  unsolicited offers on characters, slots, or traits belonging to other  members unless they are actively seeking to rehome or trade designs or  items.

Ownership

Character Use

• Baabies are for personal use only.
• Mass produced art of your Baabi is not acceptable. Commercial use is prohibited unless otherwise discussed with Zero8426
• Co-ownership is not allowed.
• You  are welcome to make AU/Alternative forms for your Baabi, but these will  not be considered official or accepted in group activities.

MYO Slots

• You may not make a Baabi without an associated MYO slot.
• Open MYO slots will be announced and purchased slots will be assigned a MYO  ticket number, which may not correspond with the masterlist number.

Character Sale/Trade/Gifting

Baabi designs are  allowed to be sold/traded/gifted depending on how the design was  obtained. The masterlist will note whether a design may be traded/resold in the "Trading and Reselling" section.

In order to resell your Baabi for more than the original price paid,  whether that be slot price or adopt price, you must get an appraisal in the Discord server.

Please refer to the various designer's ToS on the trello masterlist for their rules.

All transfers must be notified on the Baabies Discord.

The use of Baabies as trading fodder is discouraged.

• Paid Characters: May be resold, gifted, or traded. 
  • Resale value is increased if:
  • Commissioned art is included
    • Commissions are for your Baabi-specific design (if the Baabiis an AU of an existing character).
    • Commissioned masterlist art is included.
  • There is additional artwork made by the current owner, it will be counted as Stardust but converted to USD to add to the value.
  • Free/Traded art must not be added into the tally.
• Free Characters: Inclusive  of prizes, gifts, trades, or free MYOs, may not be resold for monetary  value but can be gifted or traded. 
  • You may only sell such characters if:
    • Commissions are for your Baabi design (if the Baabi is an AU of an existing character).
    • There is additional commissioned art.
    • Commission amounts will only be counted for:
      • Real life currency
      • Premium in-game-currency with set USD = Premium Currency equivalents (such as FlightRising Treasure/Gems)
    • There is additional artwork made by the current owner, it will be counted as Stardust but converted to USD to add to the value.

Chargebacks  and scams are not tolerated within our community. Users who file  chargebacks for Baabies sold by official artists, guest artists, or  resale users will be immediately banned and dealt with on a case-by-case  basis

Design/Character Removal

Owners may choose to remove their characters by informing the Creator and team.

• To remove a Guest Design, contact the guest designer for their permission to remove the design from the CS.
• Removed characters cannot be brought back into the species.
• Repurposed characters must remove certain Baabi traits.
• Art from avatar/character makers are never permitted. Art must be your own.
• The use of free bases or bases you have purchased the rights to use are also permissible.

Edits

• On  older Guest Adopt designs edits are allowed; follow the rules on edits.  If you want to reach out to the original artist and ask them about the  edits you are welcome to, but not required.
• Starting October  2021 if the Guest Adopt design has a ToS on edits follow that otherwise  edits are allowed; follow the rules on edits.
• Free designs we request that you get permission to edit the design.

Payment

• Only accepted through PayPal (USD) / Points, unless stated otherwise.
• Baabi will not take monetary payment via PayPal if you are a minor. You must be 18+ if you're using PayPal as a payment method.
• Payments to be made within 24 hours unless otherwise discussed.
• Sales are final and there will be no refunds. Buybacks may be discussed but are unlikely.
• Charge-backs will result in an automatic blacklist and revocation of ownership of design.
• Blacklisted  individuals will not be allowed to return to the group unless  discussed. Their MYO designs will be retired and not be considered  eligible as part of the species even if purchased by a non-blacklisted  party.
