Mermay Eko Adopts (OPEN)'s Ownership

The following terms govern use of dracogryph.aquapyronarpgs.com ("Site" or "the Site") and should be considered the rules surrounding usage of licensed characters ("Characters") and licenses to create characters with set restrictions ("MYO Slots").  These rules also apply to which kinds of artwork or written materials (collectively "Art") are permitted on and in connection with the Site.

User Accounts

Users may sign up for an account or elect to not sign up for an account.  These terms are binding and apply to Characters even if no account is created.  Users must have a DeviantArt or Twitter account in order to use the Site or its Characters.

If users break these terms, they may face the following (collectively "Administrative Actions"):

• License termination
• Temporary blacklisting from the Site
• Permanent blacklisting from the Site
• Removal of Art or other user-created content from the Site

Blacklisting means that no Characters or MYO Slots may be transferred to the user.

The following materials are not allowed in connection with user profiles or any other user-editable areas of the site (such as Character profiles or submissions):

• NSFW Art, images, or content
• Excessively violent or gory images or content (small amounts of blood are allowed)

Additionally, users are forbidden from knowingly engaging in the following:

• Scams, or trading items, Characters, or MYO Slots the user does not own
• Abuse of site bugs or glitches to obtain items, Characters, MYO Slots, or currency
• Sale of Site invite codes

Licensing

Users are granted a non-exclusive revokable transferrable worldwide license to any Characters they obtain, through any means, including but not limited to:

• Raffle
• Sale
• Auction
• Freebies

The following terms apply to licensing fees which may be part of obtaining a character license:

• Any licensing fees for a character must be paid in full before the character is licensed.
• Acceptable payment types and amounts will be visible on the character's sales post. If paying in real life currency, United States Dollars (USD) are required.
• If paying through PayPal, Stripe, or Square, a valid email to send an invoice to is required.
• If a licensing fee is over $100, financing may be available.

No materials or characters which are part of Dracogyph are considered standalone products. Licenses require a non-banned Dracogryph account or a DeviantArt account. Any characters are individually licensed to a single user  for the duration of the licensing period. This is indefinite, but can be terminated for reasons including but not limited to:

• TOS violation in any Aquapyron project.
• TOS violation in connection with any Aquapyron project.
• Violations of conditions on continued use after Administrative Action.
• Violations of intellectual property rights related to any  Aquapyron project.

We reserve the right to terminate license(s) at any time for any reason, though we will try to provide a reason should we be forced to terminate.

Character Usage

Uses allowed by these terms:

• Trading, gifting, and/or reselling Characters as allowed on their profile
• Posting Characters to Toyhouse with proper credits (credit aquapyrofan as an onsite creator)

Uses disallowed by these terms:

• Trading, gifting, and/or reselling Characters as disallowed on their profile
• Posting Characters on Toyhouse with improper credits
• Use of Art or Characters which do not belong to the user
• Illegal uses of Characters
• Creating or otherwise obtaining NSFW Art involving Characters
• Trading Characters for "vouchers" if their profile indicates that they can't be sold
• Creating or using Characters without the appropriate MYO Slots or otherwise approved designs

Changes

Users may change the design of Characters through the use of onsite items, and must get them approved through the onsite Design Update form.

MYOs

In the case of MYO Characters, or similar, where a user is permitted full control over the designing of a new Character with given restrictions (such as traits or use of a specific file):

• Intellectual property rights of all characters created through "MYOs" are held exclusively by aquapyrofan.
• Users are permitted to use the Characters they create through these "MYOs" in the Dracogryph ARPG.
• Characters must not violate intellectual property rights of any individual or company and must not be based on existing characters.
• All other terms apply.

Customs/Semi-Customs

In the case of customs and semi-customs, where a design is created with some input from a user:

• Anything heavily based on or using the name of a trademarked or copyrighted property will be stripped or, if possible, genericized.
• Anything breaking the Content Guidelines will be stripped.
• Anything impossible for or contradicting guidelines of the species will be stripped.
• Dracogryph administration reserves the right to take minor creative liberties with requested details in a semi-custom, or custom.

Infringing Characters

Any licensed Character that was created with input from the licensee (through a MYO, semi-custom, etc.) that is found to be based in part or whole on a trademarked or copyrighted property will have their license immediately terminated, and the licensee may face termination of other licenses. This does not apply if the basis is minor or generic enough.

Termination of Licenses

Should a licence be terminated, there will be no compensation for any licensing fees from Dracogryph or its administrators.

Alteration of the design associated with a terminated license to convert them to another species without making significant changes to design, marking, and color scheme is forbidden, and can result in the termination of any or all licenses held by the licensee in question.
