By ordering a commission from me, user takodogs ("the Artist"), you ("the Client") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/ cancelled commission with or without a refund, and/ or a blacklist/ public service announcement. Please note that these Terms of Service may be subject to change without prior notice.

These Terms of Service are in effect as of JULY 01, 2022.

Section 1.1 - Will Draw

The Artist is willing to draw any of the following:

  1. Human(oid) | Kemonomimi | Anthro*
    (*Anthros that lean heavily towards the feral side instead of human(oid) will be rejected)
  2. Original Characters and/ or Fan Characters
  3. Sonas
  4. Real life people* (*only if express written permission of the subject in question is provided)
  5. Fanart
  6. Light Gore
    (Ex. Excessive blood, detached limbs, etc.)
  7. Characters in appearance of the following age ranges:
    1. Teenagers
    2. Young adults (18 - 35 years old)
    3. Middle-aged adults (36 - 55 years old)

Section 1.2 - Will Not Draw

The Artist will not draw any of the following:

  1. Feral
  2. Hateful imagery
  3. Explicit Sexual Content
  4. Heavy gore
    (Ex. Detailed internal body parts)
  5. Mecha
  6. Elderly-appearing characters (65+ years old)
  7. Sexualized underage characters (in actual age and appearance)
  8. Pedophilic relations
  9. Incestuous relations
  10. kink/fetish

Section 2 - General

  1. The Artist has a right to refuse the commission for whatever reason, with or without explanation.
  2. The Artist has a right to cancel the commission for whatever reason, with or without explanation.
    (Please see Section 6 - Refunds for more information on cancellations.)
  3. The Client has a right to cancel the commission for whatever reason, with or without explanation.
    (Please see Section 6 - Refunds for more information on cancellations.)
  4. The Artist has a right to upload the commission on any/ all social media (Tumblr, Twitter, DeviantArt, Toyhou.se, Instagram, etc.) unless specified by the Client beforehand to keep the commission private.
  5. Payment is to be made after the Client has approved the sketch. The sketch will be resized and watermarked. The commission will be on an "on hold" status until payment has been received.
  6. The Artist will not work with deadlines or rush orders.
  7. The Artist does not work on a "first come first serve" basis. Smaller commissions/ commissions that do not take much time may be worked on in between larger commissions/ commissions requiring more time.
  8. The Client may contact the Artist at any time to ask for a progress check on the commission, but no more than once every two weeks. The Client is encouraged to contact the Artist via social media (Tumblr, Twitter, DeviantArt, Toyhou.se, Instagram) if the Client is unable to reach the Artist via e-mail.

Section 3.1 - Designs

General Adopt TOS:

  1. All designs have a 14 day/2 week trade/resell cooldown. The Client may gift designs freely.
  2. Do not resell designs at a higher price than what you bought them at unless they come with commissioned artwork.
    • Designs received through trades may not be resold unless you have added to the character's value. Commissioned art and full personal pieces add to their worth; Gifts, trades, and low effort artwork do not count towards their worth.
  3. The Client must notify the Artist if trading a design.
  4. The Client is forbidden from using the Artist's designs to promote or romanticize disgusting content. (homophobia, transphobia, racism, pedophilia, incest, noncon, etc)
  5. If redesigning a character, do not lighten the skin-colour, do not permanently straighten textured hair, and don't remove prosthetic parts or other disability aid. Otherwise, the Client make any changes they wish.
  6. While the Client is allowed to give their character any pronouns, gender, and story-- they are forbidden from labeling them with harmful terminology or symbols. This includes but is not limited to bi/pan lesbian, super straight, toothpaste flag, the battelaxe bisexual flag, the labrys flag, any fetishistic or derogatory language that the Client unable to reclaim, and obviously other hate group symbols.
  7. The Client is forbidden from writing the Artist's designs as racist stereotypes, even if "positive".
  8. The Client is forbidden from deleting the Artist's designs. They may hide them, however. Please notify the Artist if this is the case, otherwise the Artist will assume the Client is breaking TOS and they will be given a warning.
  9. The Client may not use the Artist's designs for commerical use at the moment.
  10. The Artist reserves the right to revoke his designs from the Client without refund if found breaking TOS. This will only be done in especially concerning situations.

Section 3.2 - Cultural Sensitivity

Read this section very carefully if you are in possession of or plan to purchase a culturally-specific design from the Artist. Since the Artist will (likely) only ever be making Japanese-based designs, this section will only be covering that. The Client should be very mindful of how they write any designs they receive; The Artist not tolerate fetishization or insensitivity of any sort. It should be mentioned that these rules also apply to non culturally-specific designs as well. If you, the reader, ever finds these rules to be excessive, you should not be writing characters from other minority groups in the first place.

With regards to designs that draw inspiration from or are based in Japanese culture:

  1. The Client is allowed to write them as any ethnicity they please, however, the character should still be mixed Japanese.
  2. The Client is forbidden from naming the Artist's designs a blend of romanized nouns. (e.g. Hikariha, Okamitsuki, Mizukaze, etc)
    Please look into how naming conventions actually work if you plan on giving the character a Japanese name.
  3. The Client is forbidden from naming the Artist's designs faux Japanese names with the intent of sounding "kinda asian". (e.g. Aikoru, Moichi, Tinomu, etc.)
    While these names can technically exist with the correct kanji combinations, they are straight up FOUL!!!!!!!!!! I'm not even sure what sane Japanese parent would name their kid that.
  4. The Client is forbidden from naming humanoid characters random Asian foods.... please........ it can be a nickname i dont care but please..................
  5. While not mandatory, the Client is to avoid using those mom baby name sites you find on the first page of google upon searching "Japanese girl names that mean [x]". Please im begging. The majority of the time, the meanings listed are either entirely inaccurate, only take the most popular spelling into account, or are romanized oddly. https://japanese-names.info/ is a wonderful, easy to use site for finding good names !! Hot girls don't gatekeep. While all spellings in this site are accurate, note that some of the names themselves are fictional! (smth to note for all of my writers out there 🤞)
  6. Final note on names: it is ok to make fictional names so as long as they sound realistic. For example, Yoisaki Kanade from Proseka has a fictional surname, meant to contrast the spelling of Asahina Mafuyu.
  7. If the Artist finds the Client to be writing their character in a concerning manner that was not mentioned above, they will contact be contacted about it. Refusing to fix cultural insensitivity is strictly against TOS.

Section 3.3 - Blacklist

Do not trade the Artist's designs to any of these users, and do not add them to any of the listed species. Anyone personally afilliated with these people or groups are prohibited from interacting as well; This includes members of listed species! Few exceptions to this clause will be made. :

Species

  1. Luminents | a horrible attempt at incorporating Japanese themes in a closed species. From the pseudo-Japanese words sprinkled throughout the lore, the unprompted insertion of Shinto imagery in the species logo, and the sole fact that Eevie_Inky is oddly obsessed with the culture as a whole-- Luminents has left a sour taste in my mouth. If you support this species, do not interact with me.
  2. Aermerean Haven species | PSA. Personal bad experience with their staff. Also their species are just lame what can i say lol.
  3. Skeleslimes, Demedics, Perfumies, Drink Devils | The founder of these species has a history of being manipulative and horrible to his staff.
  4. Takomimi, Hoshi-Kami, Wishwings, Kitsunewings | I'm just gonna lump every other minor weeaboo-made species here omegalaugh
  5. kshanggalin, kessholumi, | just don't want anything to do with these

Section 4 - Image Rights

  1. The Client may make minor edits to the completed commission (ex. Cropping, Adding text/ borders, Changing Brightness/ Contrast/ Hue/ Saturation...).
  2. The Client may use/ reupload the commission for personal/ non-commercial use, but only if proper credit to the Artist (@User) and a linkback to any of the Artist's social media (Tumblr, Twitter, DeviantArt, Toyhou.se, Instagram) is provided.
    1. If the commission includes characters that do not belong the Client, additional credit to the owner(s)/ creator(s) of said characters must be provided when using/ reuploading for personal/ non-commercial use.
  3. The Client may not use the commission for any commercial use unless discussed with the Artist beforehand.
    1. Commissions for commercial use will be charged more than personal/ non-commercial commissions. Prices are negoatiable.
    2. If the commission includes characters that do not belong the Client, the Client can not use the commission for commercial use unless explicitly written permission from the owner(s)/ creator(s) of said characters is provided.
  4. The Client may not claim the commission as their own work, whether they did or did not make any edits to the commission.
  5. The Artist does not claim ownership to any of the characters/ subjects portrayed in the commission. Characters belong to their respective creator(s).
  6. The Client is expressly forbidden from using the Artist's work for AI generation, NFTs/blockchaining, and other such practices.

Section 5 - Delivery/ Turnaround

  1. All commissions will be done digitally.
    1. There will be no hard copies.
    2. The Client is paying for a service/ digital good and will not require any shipping of any kind.
  2. All commissions will be done in an anime/ manga style or as sampled in the style ordered.
  3. All commissions will be .PNG with dimensions ranging from 1000px - 3000px+ at 72DPI, unless specified otherwise. Exceptions may be made, depending on the commission.
  4. The Client may ask for a specific canvas size for the commission.
    1. Commissions with a canvas size larger than 3000px will have an additional charge.
    2. Commissions with a canvas size smaller than 1000px may have prices negoatiable. (Note: Smaller canvas sizes may result in losses to detail/ and or quality).
  5. The Client may ask for the commission to be 300DPI if the Client plans to personally print the commission; however, there will be an additional charge.
  6. All commissions will be sent via e-mail with the completed commission .PNG file attached.
  7. Unless specified not to upload the commission to the public, all commissions will be posted on the Artist's social media, resized and watermarked.
    1. Commissions will be posted on the Artist's social media after the Client has received and approved the original and unmarked commission file.
    2. The Client may choose to remain anonymous when the Artist publicly uploads the commission.
  8. Depending on the desired style and queue, the estimated turnaround is about one (1) week to two (two) months at the latest.
    1. If the Artist has to take longer than two (2) months to complete the commission for whatever reason, the Client will be contacted and informed of the status of their commission.

Section 6 - Payment

  1. Payment is to be made after the Client has approved the sketch. The Client is not to send payment upfront.
  2. Payment is to be made via PayPal or DeviantArt Points only.
  3. PayPal payment is to be done in CAD (Canadian Dollars).
  4. PayPal payment is be done using invoices. The Artist will require the Client's PayPal e-mail.
  5. The Client does not need to pay extra for any of the PayPal fees.
  6. Payment must be sent within 72 hours after confirmation.

Section 7 - Refunds

  1. If the Client cancels their commission for whatever reason, the Client will receive a partial refund, depending on how much of the commission has been finished:
    1. 65% refunded if in the lineart stage
    2. 50% refunded if in the base colours stage
    3. 30% - 20% refunded if in the shading stage/ final touches
    4. The Client will not receive any files of the commission.
  2. If the Artist cancels the commission for whatever reason, the Client will receive a full refund, in addition to a .PNG file of whatever progress of the commission has been completed.
  3. Refunds will be given within 72 hours after correspondence.
  4. The Client will not be refunded if they are unsatisfied with the commission.
    1. If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits (ex. adjusting colours), up to a maximum of two (2) times after correspondence. Any desired major revisions (ex. reposing, colour scheme change, etc.) will be rejected.
    2. The only major revisions permitted are details that the Artist may have missed and was specified by the Client in the order form/ correspondence while the commission was still in the sketching/ lineart stage (ex. missing tattoo that's essential to the character's design).

Section 8 - Commission Process

The following is a sample of the Artist's commission process:

  1. The Client orders a form using a Google Form, linked by the Artist. An e-mail is required for the Artist to get in contact with the Client. The Client's e-mail will remain private and will not be shared.
  2. The Artist contacts the Client via e-mail within 72 hours after the Client has sent the order form, confirming the acceptance or rejection of the commission. Upon acceptance, the final price and details of the commission is confirmed.
  3. The Client will receive a rough sketch (resized and watermarked) of the commission. Any and all major revisions must be done at this stage.
  4. The Client approves the sketch. Payment is to be made (via PayPal Invoice or DeviantArt Commissions Widget).
  5. Upon confirmation that the payment has been received, the Artist will work on and finalize the commission.
  6. Upon completion of the commission, the Client will receive the commission file via e-mail. Only minor changes (ex. brightness, colour adjustments, etc.) can be made at this point. Any and all major revisions (ex. reposing, colour scheme change, etc.) will be rejected.
  7. If permitted, the Artist posts a resized and watermarked version of the commission on social media.
