By purchasing my art or adopts, you automatically agree to the following conditions.
By obtaining my art or adopts through a second party, you are still bound to these conditions.
Please read this journal in it's entirety as it will outline the acceptable uses of my art and adopts.

Payment

• All payment should be made in USD via PayPal invoice (sent upon agreement of final commission price). Payment is due in full and upfront unless a plan is discussed beforehand.
• If a payment plan has been discussed you are required to pay by the specified date. If you need an extension please let me know in advance. I am really understanding to personal financial situations and is usually lenient regarding extensions.
• DO NOT send the payment directly to my paypal. I will provide the Paypal.me link. If your country does not support this feature I will invoice you.
• Payment is for DIGITAL GOODS ONLY so you must select NO SHIPPING REQUIRED during checkout. You are not required to pay any additional shipping fees as nothing will be shipped to you.
• Once I begin working on your commission there will be NO REFUNDS unless I CANNOT complete you order during a 6 month period (aka your Paypal Buyer's Protection period).
• Additional fees are determined on a per work basis and only to cover the increased time taken to complete your work due to a complex character design. I WILL NEVER ASK YOU TO COVER PAYPAL FEES!

Artist Rights

"By commissioning me, you are purchasing my artist labor only. I retain all viable copyrights over my work, which include but are not limited to the right to distribute, reproduce, or use the work for samples/self-promotion unless discussed beforehand."

• If requested, I will not repost your commission publicly to my DeviantART. Just ask me before hand! Do not attack me after it has been posted.
• I cannot claim the Intellectual Property and will not reuse or resell the work.
• I have the right to decline any commission I feel uncomfortable with. Please refer to my commissions journal for more information.
• It is expected I am to always be credited for my work where it is due. If you repost to a character gallery you MUST GIVE CREDIT.

Commissioner Rights

• As the commissioner you have the right to repost the artwork to character galleries such as Charahub, Toyhou.se, Sta.sh, etc. I ask that you refrain from posting it to your DeviantART gallery as this is a conflict for my copyright.
• You may use the artwork for PERSONAL USE ONLY! You may not redistribute or resell my artwork in any way.
• Please refrain from editing my work including removing my watermark or signature. These are to protect my copyright over the work made.
• You may not claim any work I do as your own.
• You may use the work to increase the value of a character. My artwork of the character is allowed to exchange hands from one owner to the next.

Adoptables

"The terms listed below govern pre-existing, premade and custom adoptables. These do not apply to any closed species that I am the guest artist for. These will come with their own terms and conditions outlined elsewhere. If you sell or trade an adoptable made by me you are required to show them my terms and conditions"

• I retain the right to the original artwork. I ask that you do not edit the original character art in any way.
• You have permission to make minor edits to the design if you'd like.
• You may gift, trade or sell the character (unless received in trade. You may not resell an adoptable you received in trade).
• You may not resell an adoptable from me for more than what you paid unless it comes with additional artwork to enhance the value (it will be up to you to make sure the artwork attached to this character by other artists is transferable with the character. My TOS does not govern the work of others).
• My designs are not to be used for commercial purposes. You may use them for nonprofit, personal projects such as comics, novels, etc.

I WILL NOT REVOKE AN ADOPTABLE UNLESS ANY OF THE FOLLOWING CONDITIONS ARE MET:

• If the design is being misused in a for-profit, scamming or scalping scenario.
  I do not condone scamming in the community and refuse to allow others to use my designs this way.
• My account is chargebacked on a design.

Revoke (definition): To take back or withdraw the right to use the original artwork or design.

IF YOU DO NOT AGREE TO THE TERMS LISTED ABOVE PLEASE DO NOT PURCHASE FROM ME OR RECEIVE ANY WORK FROM OTHERS BY ME.

Receiving a design or piece of art from me through another party does not make you exempt from my terms and conditions. With anything you buy always educate yourself on any terms and conditions like you would a safety label on a house hold cleaning product.
