By ordering a commission from me, TheMeowingFox ("the Artist"), you ("the Client", "(s)he/ they") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/ cancelled commission without a refund, and/ or a blacklist. Please note that these Terms of Service may be subject to change without prior notice.

These Terms of Service are in effect as of AUGUST 21, 2023.

Section 1.1 - Will Draw

The Artist is willing to draw any of the following:

1. Human(oid)s*
2. Monsters*
3. Animals*
   This includes but is not limited to:
   1. Kemonomimi*
   2. Anthro/ Furry Characters*
   3. Feral*
4. Original Characters and/ or Fan Characters*
5. Sonas*
   (*Designs that are hyper detailed or require hyper detail will be rejected)
6. Adult Nudity, with or without genitalia
7. Creepy Cute
8. Blood and Gore; both Light and Heavy
   (Ex. Excessive blood, dismemberment, detailed internal body parts, etc.)
9. Implied Sexual Content
   This can include:*
   (*Fetishes that are heavily exaggerated will be rejected)
   1. Chubby | BBW | SSBBW
   2. Giant(ess), Gentle or Tyrant | Size-play | Macro | Micro
   3. Soft Vore | Hard Vore
10. Characters in appearance of the following age ranges:

    1. LGBTQ+ rights (The inclusion of the flags alone counts!)
    2. Animal rights (Not PETA)
    3. Racial Justice/ Civil Rights Movement

Section 1.2 - Will Not Draw

The Artist will not draw any of the following:

1. Real life people
2. Race-swaps | Gender-swaps
3. Explicit Sexual Content
   (Ex. Pornography, hentai, etc.)
4. Realistic horror
5. Machines | Mecha
6. Implicit and/ or overt hate speech (ex. Anything opposing movements such as LGBTQ+ rights, Civil Rights, etc.)*
7. Pedophilia | Lolicon/ Shotacon | Sexualized underage characters (in actual age and appearance)*
8. Incestuous relations*
   (*In addition, it may lead to an instant blacklist)
9. Kinks/ fetishes not specified in Section 1.1 - Will Draw.

Section 2 - General

1. The Artist has a right to refuse the commission for whatever reason, with or without explanation.
2. The Artist has a right to cancel the commission for whatever reason, with or without explanation.
   (Please see Section 6 - Cancellations for more information on cancellations.)
3. The Client has a right to cancel the commission for whatever reason, with or without explanation.
   (Please see Section 6 - Cancellations for more information on cancellations.)
4. The Artist has a right to upload the commission on any/ all social media (Tumblr, Toyhou.se, Ko-Fi) unless specified by the Client beforehand to keep the commission private.
5. Payment is to be made after the Client's order is approved.
6. The Artist will not work with deadlines or rush orders.
7. The Artist does not work on a "first come first serve" basis. Smaller commissions/ commissions that do not take much time may be worked on in between larger commissions/ commissions requiring more time.
8. NSFW commissions may only be ordered by a Client 18 years of age or older. If the Artist has any reason to suspect the Client is underage while asking for an NSFW commission, the commission will be automatically rejected/ cancelled. Repeat offenders will be blacklisted.
9. The Client may contact the Artist at any time to ask for a progress check on the commission. The Client is encouraged to contact the Artist via social media (Tumblr, Toyhou.se, Ko-Fi) if the Client is unable to reach the Artist via Discord.

Section 3 - Image Rights

1. The Client may make minor edits to the completed commission (ex. Cropping, Adding text/ borders, Changing Brightness/ Contrast/ Hue/ Saturation...).
2. The Client may not make major edits to the complete commission (ex. Coloring/ Shading line-art, adding solid lines to a sketch, etc.).
3. The Client may use/ reupload the commission for personal/ non-commercial use, but only if proper credit to the Artist (TheMeowingFox) and a linkback to any of the Artist's social media (Tumblr, Toyhou.se, Ko-Fi) is provided.
   1. If the commission includes characters that do not belong the Client, additional credit to the owner(s)/ creator(s) of said characters must be provided when using/ reuploading for personal/ non-commercial use.
4. The Client may use/ reupload the commission for commercial use, but only if proper credit to the Artist (TheMeowingFox) and a linkback to any of the Artist's social media (Tumblr, Toyhou.se, Ko-Fi) is provided.
   1. If the commission includes characters that do not belong the Client, additional credit to the owner(s)/ creator(s) of said characters must be provided when using/ reuploading for commercial use. Confirming that the owner(s)/ creator(s) of said characters allow commercial use is recommended.
   2. The Client may not redistribute the commission as an NFT.
5. The Client may not use/ remix the commission in AI Art of any kind.
6. The Client may not claim the commission as his/ her/ their own work, whether (s)he/ they did or did not make any edits to the commission.
7. The Artist does not claim ownership to any of the characters/ subjects portrayed in the commission. Characters belong to their respective creator(s).

Section 4 - Delivery/ Turnaround

1. All commissions will be done digitally.
   1. There will be no hard copies.
   2. The Client is paying for a service/ digital good and will not require any shipping of any kind.
2. All commissions will be done in the Artist’s trademark artstyle, which is reminiscent of the anime/ manga style.
3. All commissions will be .PNG with dimensions ranging from 1000px - 3000px+ unless specified otherwise, with a resolution of 720DPI. Exceptions may be made, depending on the commission.
   1. The Client may ask for a specific canvas size for the commission.*
   2. The Client may ask to resize the commission.*
      (*Note: Smaller canvas sizes may result in losses to detail/ and or quality)
   3. The Client may personally print the commission.
4. All commissions will have a watermark, unless specified otherwise.
   1. The Client may ask for an unwatermarked version.
5. All commissions will be sent via Discord with the completed commission .PNG file attached, or on ToyHou.se via PM with a public Google Drive link to the completed commission.
6. Unless specified not to upload the commission to the public, all commissions will be posted on the Artist's social media with a watermark.
   1. Commissions will be posted on the Artist's social media after the Client has received and approved the original commission file.
   2. The Client may choose to remain anonymous when the Artist publicly uploads the commission.

Section 5 - Payment

1. Payment is to be made after the Artist approves the order. The Client must send payment upfront, and in full.
   1. The Client may be eligible for a future upgrade depending on the stage of the commission that (s)he/ they paid for. If, for example, the Client has paid for a sketch, (s)he/ they will owe the difference to upgrade that same commission to a flat color.
2. Payment is to be made via PayPal or Ko-Fi only.
3. PayPal payment is to be done in USD (US Dollars).
4. PayPal payment is be done using invoices. The Artist will require the Client's PayPal e-mail.
5. The Client does not need to pay extra for any of the PayPal fees.
6. Ko-Fi payment is to be made using the Commissions feature on the Artist's Ko-Fi page. The Artist will set up a specific slot for the Client to pay through.
7. Payment must be sent within 3-5 business days after confirmation.

Section 6 - Cancellations

1. If the Artist cancels the commission for whatever reason, the Client will not recieve a refund, but will recieve the .PNG file of whatever progress of the commission has been completed.
2. If the Client cancels the commission for whatever reason, the Client will not recieve a refund, but will recieve the .PNG file of whatever progress of the commission has been completed.
3. The Client will not be refunded if (s)he/ they are unsatisfied with the commission.
   1. If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits (ex. adjusting colours). Any desired major revisions (ex. reposing, colour scheme change, etc.) will be rejected.
   2. The only major revisions permitted are details that the Artist may have missed and was specified by the Client in the order form/ correspondence while the commission was still in the sketching/ lineart stage (ex. missing tattoo that's essential to the character's design).

Section 7 - Commission Process

The following is a sample of the Artist's commission process:

1. The Client orders a form using the template provided in the commission thread, or on Ko-Fi. Discord or Toyhouse is preferred for the Artist to get in contact with the Client. The Client's contact information will remain private and will not be shared.
2. The Artist contacts the Client via PM or Discord within 72 hours after the Client has sent the order form, confirming the acceptance or rejection of the commission. Upon acceptance, the final price and details of the commission is confirmed.
3. Payment is to be made (via PayPal Invoice, or Ko-Fi Commissions feature).
4. Upon confirmation that the payment has been received, the Artist will begin work on the commission.
5. The Client will receive an unmarked rough sketch of the commission within 1 month. Any and all major revisions must be done at this stage.
6. The Client approves the sketch. Only minor changes (ex. brightness, colour adjustments, etc.) can be made at this point. Any and all major revisions (ex. reposing, additions of details not previously mentioned, etc.) will be rejected.
7. If there are no revisions to be made, or the commission is otherwise approved by the Client, the commission is finalized for publication and completed.
8. Upon completion of the commission, the Client will receive the commission file via Discord, or a Google Drive link to the file via PMs.
9. If permitted, the Artist posts the commission on social media with a watermark.

By owning a design created by me, TheMeowingFox ("the Designer"), you ("the Owner") affirm to have read and agree to be legally bound by the following Terms of Use listed below.

These Terms of Use are in effect and up to date as of AUGUST 20, 2023.

These Terms of Use only apply upon the Owner's new ownership of a design.
Any changes made to the Terms of Use after an Owner has claimed ownership to a design will not apply to said design.

1. The Owner may make both major and minor edits to the design/ redesigns.
2. The Owner may make minor edits to the original artwork.
3. The Owner may regift the design.
4. The Owner may retrade the design.
5. The Owner may resell the design for the same price as bought.
   1. The Owner may not resell the design as an NFT.
   2. The Owner may not resell the design for a higher price than bought unless additional value (i.e. trades, commissions, personal art) has been added to the character's gallery.
      1. Free/ Gifted art (i.e. art received in which the Owner did not give anything in exchange) does not count as additional value.
6. The Owner may use the design for personal/ non-commerical use.
7. The Owner may use the design for commercial use.
8. The Owner may not use the original artwork for AI art of any kind.
9. The Owner may not claim the original artwork as their own.
10. The Owner may not make major edits to the original artwork.
11. If uploading the original artwork off-site, credit to the Designer (TheMeowingFox) must be provided.
12. The Designer only claims ownership of the original artwork.
13. The Designer does not claim ownership of the original design concept/ execution, nor to any redesigns and/ or the character/ associated character of the design.
14. The Designer acknowledges that once a design is owned by the Owner, the design/ character no longer belongs to the Designer.
    1. The Designer may not "claim back" a design.
    2. The Designer may offer to trade and/ or buy the design back, to which the Owner maintains the right to refuse, with or without explanation.
