Terms of Service - Interaction & Blacklist - Design Preferences

INTERACTION

Please do not interact with me or my content if you fall under any of the following:

1. You are not Asian and go by Asian names/ Aestheticize-Fetishize Asian cultures (especially East Asian)
   1. Going by Asian names includes systems. If you are not Asian, find an alternative name.
   2. I don't like people using terms like "hikikomori" or "yandere" unironically as well, especially if they're not Asian.
2. You support loli/ sho/ cub, beast/ zoo, etc. content or glorify/ fetishize unhealthy behaviors/ relationships.
   1. This includes content of characters who are meant to look childlike despite being adults.
   2. This includes just NSFW art of ferals.
3. You support MAPs/ PEARs/ pro-shippers/ "anti-antis," or if you are into things such as age-play.
4. You use terms like f*mboy, tr*p, and f*ta and-or if you sexualize/ fetishize transfems.
5. You make cult jokes.
6. You treat designs only as trade fodder, and hold designers and artists to unrealistic expectations.
   1. Example: "I only want HQ trades" / "No LQ offers"
   2. Example: "Popufur trades only"
   3. Example: Buying adopts/ characters from an artist specifically for trading. Includes buying a character and immediately putting up for trade/ sale.

BLACKLIST

1. iKitsunyan - No race listed and is very clearly fetishizing Japanese cultures (i.e., going by Japanese names, calling their system the "Oyasumi System"). 

By ordering a commission from Leviathan "seapriest," I, the client, affirm to have read and agree to be legally bound by the following Terms of Service listed below.
Failure to abide by the Terms of Service may result in a rejected/ cancelled commission with or without a refund, and/ or a blacklist/ public service announcement.
Terms are effective as of JUNE 12, 2023.

GENERAL ACKNOWLEDGEMENT

1. My work takes time - I am a mutli-disabled person with a part time job and a full time college student, and I put a lot of time and effort into my artwork. As a result of this, my art may take longer than other commissioners.
   1. I experience memory loss and am forgetful even otherwise. Reminders are not rude to me, as I am very susceptible to forgetting tasks.
2. You may not claim any of my work - whether it be art or design - as your own. You may reupload it with direct credit to my Toyhou.se account.
3. All payments are expected to be given within a week, unless there are specified circumstances. High payments may include a payment plan, which will be discussed in DMs.
   1. If what is offered is something other than real currency, we may discuss timelines.
   2. Do not offer or bid if you know that you cannot pay.
   3. I do take emergencies into consideration. I promise that I will work with you, especially if you work with me.
4. Backing out on bids or offers will put you on a hold from bidding or offering on anything of mine for 1 week.
5. Charging back will result in permanent blacklisting.
6. Not responding for more than 1 week (ghosting) will result in permanent blacklisting, unless there are outstanding circumstances.
7. Payment will be taken through USD and PayPal.
   1. Payment will be done through sending an invoice to the client, and will not include any extra fees. I will require an email from the client to send the invoice to. 
8. I may cancel or deny service to anyone for any reason.
   1. In the instance of a cancellation, notice will be given with the reason why. I will also fully refund what has been paid.

ART TERMS

1. I will receive half payment up-front and half of the payment after the sketch is completed. 
2. You may cancel and receive a refund up before the sketch is completed. Once I receive full payment, I will not offer any refunds.
   1. Outstanding circumstances may be discussed.
3. You may not trace or replicate my artwork.
4. "Do"s and "Don't"s will be discussed upfront.
   1. I am consistently trying to improve my artwork, which means I may be more lenient on things. This is because for some "Don't"s, I may take experimental commissions.
   2. You may generally follow that a hard "NO" is anything that is considered harmful. You may ask for specifications. 

DESIGN TERMS

1. You may never delete my designs from Toyhou.se - Unlisting and privating is okay.
2. If the design is not paid for by our specified date, I reserve the right to put it back up for offers. 
   1. I will notify you one day prior to doing this.
3. All of my designs must be owned a minimum of 1 week before transferring to someone else. 
   1. All transfers must go through me to ensure my terms are followed.
   2. My designs may never be transferred to anyone on my blacklist.
4. All of my designs must be owned a minimum of 1 week before requesting design alterations.
   1. All design alterations must go through me.
5. Closed Species and-or Open Species AUs are permitted, as long as said species is not on my blacklist.
6. Designs may not be resold for any more than what it was bought for, unless it has extra art.
   1. Designs may not be resold if they were given to you for anything that does not have monetary value. They may be gifted or traded.
7. When pricing designs by me, please follow the listed rules to ensure designs are not overpriced when reselling:
   1. Personal art may only add value if it is completed. It is only worth 25% of the owner's commission prices. 
   2. All commissioned art adds value. It is worth 100% of the artist's commission prices.
8. Certain designs may not be allowed to receive NSFW art if the following applies:
   1. The design is currently owned by a minor.
   2. The design was a collaboration with a minor.
   3. The design is meant to look like a child, or is intentionally childlike.
