Design TOS

YOU CAN:

- Redesign the character as much as you’d like.

- Turn the design into a closed species character (you don’t have to ask. This is your permission, you can send this as permission proof).

- Void my closed species designs from closed species’ (you don’t have to ask for this either. This is your permission).

- Sell the design for its worth (if it has no added art by you/others). If you paid $50 for an adopt by me, and are reselling it with no added art, the worth is $50, etc. I don’t care if you add your own personal art to value on designs made by me, that’s your choice to do that.

- Use the design commercially (merch, comics, etc). I don’t care about this either, once it’s out of my hands then I don’t own it, you do.

- Resell, retrade, regift. You can trade characters you get from me for free, I don’t keep track of all that, but I know some people do so heres your go ahead in case you’re looking for my rules on this.

- Co-own my designs, on the condition that I am NOT involved in any drama that may come of it. If the co-ownership falls apart that is your problem and I will not interfere, so please be smart about who you decide to co-own with.

- Edit my artwork, on the condition you keep the originals for posterity’s sake. I mass delete old artwork about once every year and thus am not responsible for you losing files or editing them and deleting originals.

YOU CANNOT:

- Impose your own trade rules/TOS on my designs. No “notify me if you trade”, no “must give back to me”, no “must wait (x amount) days to trade”, etc etc. The new owner can agree to do the “notify me” thing if they so choose to (like a pinglist), but you do not have the right to impose your TOS onto my designs.

- Make my designs into a public species. Example: you receive a design by me, you take the idea for the design and make a whole public species out of it. Private, personal use, lore species for oc development is okay. Public open/closed species that people other than you will be participating in is not.

- Resell my designs for more than they’re worth with no added art. If you pay $50 for a design, and then turn around and resell it for $100 as is, what the fuck man. What the fuck.

- ^ This includes that you cannot add worth of characters traded for my designs to the value. If you didn’t pay money for it, it’s not added worth. If you trade a character worth $20 for a design by me worth $0, THE DESIGN IS STILL WORTH $0. No money spent = NO added value.

- ^ Vouchering my designs for something above their worth is also not allowed. The voucher must be equal to the worth of the character, meaning characters worth $0 cannot be vouchered.

- Make twins of my designs and then sell/trade them separately. If you make my design a twin, they go together, or the twin gets deleted.

- Delete my designs from toyhouse. Do not sell them to users offsite, any future owners must have a toyhouse for worth logging purposes, and to avoid potential scams.

REGARDING ART IVE MADE FOR CHARACTERS

if I have made artwork for your character/a character you currently own for FREE (personal art I made at the time I owned them is included in this), you are NOT allowed to add the “worth” of that piece to the characters value. The worth of my artwork that you DIDNT pay for is ZERO (0). Under no circumstances am I okay with people using my free art/art trades/old personal artwork as added value. 

EMERGENCY EXCEPTION

In the event of an emergency, you may contact me to ask permission to upsell your design made by me. When approved, you may sell or voucher the character for more than it’s worth (ideally with proof of the exception approval), and the selling price will then be considered the characters value. Just contact me with the design and the price you wish to sell it for, and we’ll go from there. My CS designs are excluded from this, as they must follow the species TOS.

I don’t believe in “taking back” designs so if you break my TOS I will just block you.
