TERMS OF SERVICES

T.O.S

  1. Diwamata does not permit the usage of Non-Fungible Tokens (NFT) or any existing cryptocurrencies in any form to existing designs/images.
  2. Diwamata does not permit the usage of Artificial Intelligence (AI) training in any form to existing designs/images.
  3. Diwamata does not own or copyright the concept of historical angels, cultural implications of diwatas, or manananggals, only the lore.
  4. You are not permitted to create Diwamata MYO designs with the intention to make an “off-brand” version of any other closed species.
  5. You must always properly credit any artist/designer of any and every Diwamata related work.
  6. Do not overprice/inflate the value of a Diwamata character just so you can profit out of them, this includes raising the prices of your own or commissioned art just to profit out of the Diwamata.
  7. Any misuse of MYO slots or Diwamata designs will be addressed with a strike that can lead to being blacklisted.

PAYMENT & MYO

  1. Official Diwamata designs/adoptables & MYO slots are non-refundable.
  2. Official Diwamata designs/adoptables & MYo slots payment must be made within the first 48 hours after the invoice has been sent.
  3. You are obligated to follow the general code of conduct within the Diwamata Toyhouse and Discord sites.
  4. Official Diwamata designs/adoptables & MYO slots can not be charge-backed, you will be blacklisted if done so. Designs/adoptables will be relisted for sale.
  5. Vouchering & Co-Owning Diwamata characters are allowed.
  6. Payment should be made in USD through PayPal or Ko-Fi.
  7. Bid participation will only be possible if your account is a month old. (Showing proof of previous accounts that existed longer than a month can bypass this rule.)
  8. If an official Diwamata slot was received from a trade without any monetary value involved, that Diwamata slot’s value will be completely voided and cannot be included in the appraisal's value.
    • Commissioned redesigns, extra artworks and such can be added to the Diwamata’s value.
  9. Bid participation is heavily supervised, be a responsible bidder and only bid when you can afford it. (Avoid deleting bid comments.)
    • Strictly no happy-bidders, backing out of a bid for more than 3 times will result in a blacklist from bid participation.
  10. Diwamata slots/designs can be re-sold, re-traded, or gifted (only under the guise that it has been sold, traded, or gifted before). Gifted slots/designs can only be gifted again.
  11. If a MYO slot has been used to design a Diwamata, it cannot be reverted back into a MYO slot.
    • You may commission another artist/designer to design your Diwamata MYO slot.
  12. Diwamata characters made with a MYO slot must always be approved first before being recognized as an official community Diwamata character.
  13. Each time Diwamata designs/adoptables & MYO slots get traded/gifted/resold and transferred to a new owner it will have a 30 days cooldown, upon getting design/adoptables & MYO slots you must wait until the cooldown before transferring to another owner. You are not permitted to transfer until the cooldown ends.

DESIGN

  1. Diwamata characters may not be depicted or referred to as ‘loli’ or ‘shota’. Any characters designed or portrayed in such ways will be deleted and promptly blacklisted.
  2. You may claim the ownership of a Diwamata character but not the design yourself. (i.e adoptables, customs, etc.)
  3. You are allowed to use your owned Diwamata character for your own personal use. (i.e. profile pictures, decorated purposes, etc.)
  4. You may only use your Diwamata character for commercial uses if you have paid & completed the qualifications needed to use your Diwamata character for any monetary purposes. (i.e. streaming, vtuber content, merchandise, other paid content, and etc.)
  5. You may draw inspiration from preexisting designs, but you may not copy or heavily reference designs from already existing characters that you do not own (TV shows, cartoons/animes, video games, pre-existing Diwamata characters, other peoples' characters, and etc..)
  6. To approve a Diwamata design, we will require a full body reference and the listed Diwamata traits in order for the staff to distinguish and approve the MYO design to make it into an official Diwamata character.
  7. You are not allowed to use controversial and racist iconography on Diwamata designs.
  8. If the Diwamata design is a commissioned custom, the original price of the custom must be added to the Diwamata’s value.
  9. You must ask the original designer/artist before redesigning their design.
  10. When redesigning a Diwamata character, you must keep at least 50% of the latest design intact. Official Diwamata characters must keep at least 70% of the design intact with the original designer’s permission to redesign.
  11. Once a redesign is approved, the previous design must be archived and cannot be actively used.
    • The previous design Diwamata may only be unarchived if the new owner wishes it to be once the transfer has been made. (redesigns can only be reverted back to the original once.)
  12. Regarding twin Diwamatas, you will require two (2) Diwamata MYO slots as they count as two separate individual designs.
    • Twins must be resold/traded/gifted together, you are not allowed to give them away separately.
  13. For raffled MYO slots, you cannot resell/trade it, you are only allowed to regift it.
    • If the raffled MYO slot has been made into a Diwamata character, it will only be allowed retraded/gifted.
  14. Staff members and guest artists’ official Diwamatas cannot be voided without their permission.
  15. You are allowed to void a MYO Diwamata character that was designed by you.
  16. Voiding a Diwamata character is irreversible and you must remove all traits Diwamata-related.
  17. Voided Diwamata designs will be kept on the masterlist for record-entry reasons but will be listed as voided.

LORE CONFORMITY

Though the Diwamata lore is heavily implied to be in-compliance to its traits . . .
  1. You are not required to follow the official lore of Diwamatas, feel free to use your Diwamata Character in your own universe, stories, headcanons, etc.
  2. You will need permission from any of the listed Admins (134340zzz, pawfaiit, chuupew) to create an AU version of your Diwamata character (for masterlist purposes.)
  3. You are allowed to make an AU (alternate universe) version/spin-off of your Diwamata character if you are the owner/designer for other closed species AUs. If you are not the original designer/creator for the Diwamata character, you must need the granted permission of the original artist/designer first.
