General

• ‘Artwork’ within this document includes YCHs, customs, and adoptables.
• The buyer agrees to the Terms and Services when I agree to take the service on (For example: When I agree to sell you a design, or when I agree to complete a YCH). If the buyer revokes their agreement, the service will be cancelled and a refund may not be given.
• Updates can be requested at any point through the process. If I am unable to provide an update in that moment (For example- I’m at work or otherwise away from my computer), I will let the buyer know as soon as possible. Please note that my job forbids me from taking my phone out of the staff room, and so it may take hours to receive a response during the day.
• I can refuse a transaction for any reason, and I do not have to provide the reason.
• Expect artwork to be completed within 2 weeks. This deadline can be extended if both parties agree; otherwise, a refund may be issued at my discretion. Further clarification is given under ‘Refunds’.
• Artwork cannot be used as a base or otherwise traced.
• I will not knowingly draw characters or relationships that fall into my ‘Will Not Draw’ boundaries, as located on the shop front.
• Questions and clarifications can be asked at any time.

Payments

• All payments must be through PayPal or Kofi
• Unless stated otherwise, payments are taken as Pound Sterling (£)

Artwork uses and editing

• Artwork may not be used for commercial purposes unless I have agreed to its usage
• I reserve the right to use artwork as examples of work.
• The buyer has the right to upload and use (non-commercially) fully paid for artwork if full credit is given to me. It is requested that credit is linked to my Toyhouse, or the same website the artwork is posted on (For example: “Art by @ 8bitgalaxy” on Bluesky, “Art by @ 8bitgalaxyart” on Instagram, “Art by 8BitGalaxy on ToyHouse” on Discord). Please ask for social media handles if they’re not found on my profile.
• Do not remove my signature from artworks. If the signature is cropped out in a way you cannot reasonably control (such as in a profile picture or banner), then credit must be given in a bio or otherwise made explicitly clear.
• Initial sketches cannot be given to anyone else to complete if they are part of a commission, YCH, or Custom. Sharing among friends in closed groups is allowed if it is made clear that it is part of an unpaid for YCH or custom.
• Character information can be freely edited. (For example: Height, gender, age, sexuality, personality, history, family, universe, moral alignment, etc).
• Characters may be redesigned and given alternative forms/ species.
• I cannot revoke or otherwise ‘take back’ designs once the purchase is finalised, which includes reselling, trading, or archiving designs.
• Artwork and characters may not be used to promote or justify bigotry in any form.

Breaking Terms of Services and Blacklisting

• Breaking the Terms and Services the first time will result in a warning. Breaking the Terms and Services a second time will result in a blacklisting or second warning should I see fit.
• The Terms and Services can be altered at any time. If the Terms and Services are altered during a transaction, the buyer will be notified and asked to agree. If the buyer does not agree with the new Terms and Services, the service may be cancelled without blacklisting.
• Breaking the Terms and Services for the first time will result in a warning. Breaking the Terms and Services a second time will result in a blacklisting or second warning should I see fit.
• Blacklists will be made public.

Refunds

• Information on deposits can be found below in the ‘“Your Character Here”s and Customs’ section.
• Deposits may only be refunded if I am unable to complete the artwork within two weeks or the agreed-upon deadline. A refund will not be given if I have good reason to believe you are stalling the artwork’s completion to take advantage of the deadline. (For example: If you request a headband in the character’s hair, then 3 days later, ask for it to be changed into a ribbon. Then days later, changing the dress to be blue, then to green. The,n continuing to request changes until/ after two weeks have passed and the artwork is technically ‘incomplete’. Your deposit will not be refunded after the deadline, whether it has been extended or not.)
• If a service is cancelled for any reason after the deposit has been paid, the deposit will not be refunded. However, you are free to keep the initial sketch to use however you see fit.
• Final payments will not be refunded, whether on adoptables, customs, or YCHs, for any reason.

“Your Character Here”s and Customs

• An 50% deposit is required to proceed with a piece AFTER the initial sketch has been approved. This deposit is non-refundable.
• The rest of the payment must be sent after a heavily watermarked artwork has been approved of.
• Progress pictures will be medium-quality JPGs and heavily watermarked
• I am the sole owner and user of all unapproved and unpaid-for pieces. Nobody is allowed to use initial sketches, unapproved designs, or other artworks pending payment unless explicitly stated otherwise.
• I retain credit as the artist of YCHs, and the artist behind and original designer of customs.
• Customs may be redesigned, but credit for the original design must be given to me and made clear within the custom’s profile or information box

Adoptables

• I hold the rights to retain and use the unsold adoptables in any way.
• An adoptable can be put on hold for a future buyer. They can be on hold for a maximum of two weeks from the day they are placed, unless both parties agree upon an extension. If they remain unsold after two weeks, they will be relisted for sale. They cannot be placed on hold again by the same person.
• Adoptables must be paid in full before HD, unwatermarked artwork is sent or the character is transferred (If applicable on ToyHouse)
• I retain credit as the original designer. If the adoptable is redesigned, then credit for the original design must still be given to me and made clear within the character’s profile or information box
• Adoptables may be given away, gifted, or traded for a value equal to the sold-for price plus any paid-for artwork attached. (For example: Kenji the Shiba was bought for £15. The new owner also purchased a £10 headshot of Kenji. Kenji the Shiba is now worth £25. The new owner receives a free half-body from a raffle, art trade, request, or Art Fight attack, but Kenji is still worth £25. The owner can sell him for a maximum of £25 or trade him for something worth a maximum of £25.
