PSA - SCAMMER - IKASHIMA ( Possible resolution pag

Posted 7 years, 1 month ago (Edited 6 years, 10 months ago) by Muley

:EDIT: Ikashima has issued an appology post on page 8, for anyone interested in seeing.

This is a post to alert you guys that there's been someone who's been "commissioning" artists, only to have charged back the payments after receiving the majority of their art.
There's no way to get back the money once the dispute goes out, as paypal will instantly refund that user "their money" even if you give receipts of your transaction.

The user in question currently is http://toyhou.se/Ikashima
:EDIT: their DA username was meltymilks, but the account has since today been deactivated.

They commissioned several artists the past two days, and all have receive chargeback to their accounts.
They had a deviantart, but that account seems to have been deactivated.
and they are not responding to pms.

Some people, like myself, have already spent the money they rceived, so now have a huge deficit in their paypal balance. Which means any commissions we do going forward, are solely going into paying off the "debt" we now owe paypal.

This is truely rude and unfair to the artists who've put in the effort to draw these pieces, AND who're now out the money.

If you have more to share on this subject, or know any other users who've done this in the past while, please share in the comments, so that everyone can be made aware of the situation.

:EDIT:  with an update to the situation.

Sooo, this is getting even worse, not only are just other artists coming forward letting us know they got scammed too, the adopt creators of the characters this person “purchased” ALSO got charged back.

The adopt artist so far that’ve gotten scammed were :
http://aoiku.deviantart.com/
http://soleilrune.deviantart.com/

(~surprise~)
So, now there’s an unpaid and now owner-less adopt floating around, with a butt ton of unpaid for art of it.

Just…. amazing…

SoleilRune is reopening an auction for the adopt Ikashima used to scam with! Do help to spread it so that the funds will be enough to divided fairly to the affected commissioners ;v;

In case anyone wants to warn others on Tumblr, I've made a post and gotten some traction which you can find here.
Currently contains a list of the characters listed on their toyhou.se, links to the current profiles that I know of that belong to them, as well as a link back to this discussion.

EDIT: KamaShi
Personally I use invoices, and for whatever reason was unable to dispute my chargeback from them.

SoleilRune

thank you @wancharm ;A;//

Hey everybody, scammer here. I have not said anything on my part due to feeling pressured and absolutely awful about the whole situation. Mentos' post here is the only evidence I can give for this.

But I didn't just 'suddenly' decide to screw over everyone because I was feeling a little down. Someone mentioned that I may be 16, and that's true (I even posted it here, although not directly). No, I did not steal 'mommy's credit card'. I could never do that. In fact, I asked for her to open a bank account for me since I was beginning an ROP session that paid money (filing documents) along with taking commissions in my spare time (I cannot give evidence as you have already seen, I deleted the majority of my accounts).

I often told her I would spend a lot of money on other artists (something I thought she thought nothing of) because I wanted to support them. So, yes, I spent quite a bit of my earnings on others. She didn't say a word until Wednesday, when she opened up the credit bill and freaked on me. Funny, considering that I knew how much I was spending and she probably did as well (she had access to my PayPal, as I had used her own for commissions before getting a credit card for myself). Following Thursday I felt like absolute shit (outside stuff) and when she came home from work early, she called to claim that 'someone was using my card without my permission'. A blatant lie, and before I knew it I got myself into a whole mess that I have no idea how to fix.

Was it my intention to ever do this? No, not ever, but now it has happened I don't think I could ever try commissioning again until I become independent.

Some things I wanted to clear up :

  • Any character on my 'For Sale' thread was not stolen. No chargebacks were issued to any of the artists for the characters on sale due to me having bought them before this year.
  • kittywitch I have not tried selling to you through PM or anybody else for that matter. Characters on my account are all categorized as 'Mains' for a reason- I would never let them go.
  • Along with this, I find it silly that I would 'Buy a bunch of adopts and art before stealing'. Reading through the thread, I think people miss the fact that I posted every single adopt and every single piece of art that I 'stole'. Why? Because I never intended to steal them, or anything. Ever.

Some things I'd like to mention :

  • Not all of the art or characters I mentioned were 'stolen'. Any character designs directing me as the creator were made by me, just as how any piece of art that points to me as the creator was, in fact, made by me.
  • So, to any of the people who bought any re-sold designs, feel free to point to me as the artists of those specific pieces.
  • Because 9/18 pieces of art was bought through money and not through digital currency/ made by me, I will put Cream for sale or auction to make up the funds. I created the design however and would like to be credited. If anybody would like to help setting something up (I don't know how to sell well) please tell me.
  • Unfortunately, about 56 of Prince's total pieces were created by me or obtained through art trades/ digital currency. Winston has only 1 bought piece, and I'd have liked to give him to a friend, but I'm not exactly sure what to do. If anybody has any idea as to what I can do with these two, please tell me.
  • Everybody in my 'Tertiary Mains' folders should be resold to make up for payments, but as someone mentioned before, they were made in a dollmaker. How to sell these, again, I'm not entirely too sure.

If anybody, anybody at all can help me sell off these characters (ones I've made) to pay back the artists, I'd be more than happy. Never in my life did I think I'd cause something so horrid.

By the way, I closed off many of my accounts because of the pressure of having to explain the situation to others multiple times. While I'm sure a lot of people will hate me regardless for what I have to say, I sincerely hope I can help fix this. This witchhunt has been making my nerves tangle up, and it pains me to think that I've spoiled an opportunity to become a part of the community to the worst degree possible.

I will not be replying to or looking at PM's because I feel like I won't be able to handle the onslaught of anger. Please understand.

Ikashima thank you for clearing it up!! I did think sometthing like that was probably the case, not that you stole anyones credit card, just that you got in trouble for spending regardless by someone who has authority over you to reverse it (because ive seen it happen recently with other mass chargeback issues)...

i do think its obviously understandable that people are upset and worried about their funds, tho im a little frustrated at peoples assumptions of jumping to shouting Scum and such... but obviously the priority has to be somehow getting people's money back to them. is there no way to explain to your mother that she cant just... take money back from all these freelancers who support on those funds to feed and house themselves and that theyve already done and provided the work paid for? it's really frustrating that people can have no concern for others just because theyre intangible internet identities and the goods arent physical... (i mean her here)

like its good there's no malicious intent but we still all do need to be paid...  you understand that all too well tho im sure, and i personally dont think its Super Productive to get hyper angry at you knowing the situation. i dont think closing all your accounts was a very responsible or mature response, thoughi understand the stress reaction. id recommend directly contacting all the artists affected to explain and work with them on how to get their money back to them

Muley, I've added this to the general PSA thread. ^^ http://toyhou.se/~forums/thread/13734.general-thread-for-psas-3-25-/1

@max @Ferbulo @chisairu @Sainvrier @wancharm @puubear @BakaBun @SoleilRune @ZaneTheMonster @thementosrabbit  @aoiku @miya @rooty @Glitchima @leo @Wicked @DrYuri @chuuiro @rkzn

I've found that the best means of winning a chargeback is as Puubear said, to call Paypal. It's probably because Paypal and the affected artist will be talking to each other as humans, instead of solely through text, which is more sterile. But yes, as soon as the chargeback occurs, I've seen (various journals where people managed to resolve their chargebacks) people immediately call Paypal and keep the company constantly updated. It is important to file a dispute through the online platform as well, but it is also equally important to talk to a person directly, and keep them updated with whatever every little piece of info and evidence. Date of purchase, proof of confirmation of purchase and acceptance of payment, transfer of files, etc.

Also, it is also important to let Paypal know you are not the only one. Let the people know online and through the phone, that Ikashima has harmed a community of artists, at least twenty people have been affected. This is not a one-time thing, or a small thing (and those are still bad of course!), but a large-scale matter.

As Banana-Bansee mentioned, awhile back, Pixlett harmed Witchpaws and dozens of other artists. However, due to all these artists banding together and keeping Paypal informed and aware that Pixlett was chargebacking multiple people, the artists won their cases and had their chargebacks reversed. It probably also helped that the amount Pixlett took from Witchpaws qualified the artist to potentially take Pixlett to court for grand larceny as well.

In this case, if everyone combines the total amount Ikashima has spent on all of them, it probably counts as a form of larceny as well. Thus, it is important to stress to Paypal representatives that Ikashima has hurt multiple people, for a cumulative total that is quite large and has hurt a large sum of people and affected their lives in potentially disasterous ways due to their irresponsibility. (Needing money to pay bills, food, medicine, etc)

Essentially, communication is important with Paypal, and to have a higher chance of getting the chargebacks overturned, everyone must work together to keep Paypal informed, both through phone and online, that Ikashima has hurt themselves and many others.

This is just my advice however. Good luck everyone. ;w;/

I was pinging everyone affected as I wrote up a general advice post on what to do to win your chargeback cases and make Paypal aware that Ikashima is harming multiple parties: http://toyhou.se/~forums/thread/30989.psa-scammer-ikashima/8#post-815960

Sorry for the assumption that you might have grabbed a hold of someone's credit card without permission. There was someone who did just that once before and I presumed it may have been the same situation. I'm glad there was no ill intent on your part, though not so glad that you're now in this situation and were powerless to stopping it. That sucks.

I think you explaining should help clear it up and that it's an unfortunate situation for everyone involved. But I think deleting your accounts made people even more suspicious and ignoring people's PMs definitely didn't help either. I'd try to work towards paying people - honestly that seems the only solution for this. I can see why your mom flipped when she saw you were spending so much but chargebacks were not the answer. It's not these artists fault :/

Muley

@Ikashima

Thanks for getting back to us, and I'm sorry for your situation.

But you have to understand.... What your mother did was not, by any means, a suitable punishement for what had happened. She affected soooo many more than just you in what she did.
If she can, she should read this and any of the other posts in this thread, and realise what she has done.

If this had happened 3 weeks ago, I'd have been furious. RLC was the only income coming into my house for three months. I was literally only eating potatoes for a week and a half by that point, and only once per day. I  was just starting a new job on the 14th of march, and it was a 2 hour there and back trip. So not only was this money to pay for what little food I was able to eat, but for the gas to go to work to make a living.

I had a feeling it was not totally on your doing, because each character had such long and loving backstories, and your communication back and forth was good. But... when I saw that more than 20 people had been affected by the chargebacks, and you were not saying a word, deactivated your DA, AND was logging in regularily to toyhouse, I had to wonder.

You could've said SOMETHING, even to just a few of us, maybe even copy pasted a concisely worded message to those who asked you about the situation. We would've still been a tad miffed, cause this is some people's livelyhood here, but we would've been FAR more understanding.

Also, this is just a tip to you, you might want to slow it down with getting commissions from people like that. Get like... 2 at a time. Your mom was completely right with being taken aback when she saw that about 400$+ was spent on art all at once.  (Though, she should've made you work hard to pay back that debt yourself, rather than snatch it out of the pockets of those that worked really hard for that money.)

I can only hope that everyone here is able to get their money returned....
sorry this is a bit blunt, but I know none else will say this. And I'm far too old to be coddling someone for a mistake they made.

Good luck everyone, and good luck to you ikashima.
