Terms of Service

1. The Founder has a right to refuse service for whatever reason, with or without explanation.

2. The Founder retains rights to the Closed Species itself. The Founder also retains rights to any adopts within the species.

3. The Founder has a right to upload the species artwork on any/ all social media (Twitter, DeviantArt, Toyhou.se, etc.).

1. Payment is to be made as soon as the Founder or Designer asks for payment. Failure to do so in the timespan of 48 hours will result in the adopt being put back up for sale.

2. The Client may make minor edits to the adopt purchased (ex. Cropping, Adding text/ borders, Changing Brightness/ Contrast/ Hue/ Saturation...).

3. The Client may use/ reupload the adopt for personal/ non-commercial use, but only if proper credit to the Founder (Lunaire), the adopt Designer, and a linkback to any of the Designer's AND Founder's social media (Twitter, DeviantArt, Toyhou.se) is provided.

• If the adopt includes artwork that do not belong the Founder, additional credit to the designer(s) of said artwork must be provided when using/ reuploading for personal/ non-commercial use.

4. The Client may not use the adopt for any commercial use unless discussed with the Designer beforehand.

• Adopts for commercial use will be charged more than personal/ non-commercial adopts. Prices are negoatiable.

5. The Client may not claim the adopt as his/ her/ their own work, whether (s)he/ they did or did not make any edits to the artwork of said adopt.

6. The Designer may only claim ownership for the artwork provided for the adopt itself, but may not claim any rights to the species provided or lore provided to the character by the Client.

7. The Founder may only claim ownership for the Closed Species of the adopt itself, but may not claim any lore given to said adopt by the Client.

8. Under specific circumstances (via blacklisting or banning of a member), the Founder has rights to reclaim an official adopt from it's owner, and raffle it off. The Founder may not do so with MYO designs.

9. Under NO circumstances can the Client back out of a bid they have placed. If caught doing so, the Founder or Designer may warn or conduct other consequences.

1. The Client is only allowed to make their own Solinox if they've purchased a MYO (make-your-own) slot and have permission from the Founder.

2. All rules must be followed when making their own Solinox. Failure to do so will result in the Founder asking the Client to fix their design or they will not be approved.

3. The Client may not use their design unless it has been approved.

4. The Client must follow all trait guidelines when designing their MYO.

• Failure to follow the trait guidelines will result in the Founder requesting design change.

5. The Client must submit their MYO design the correct way, through the Discord server approval channel. They must use the correct form and submit all proofs needed for the design to be approved. Failure to do so will result in the design not being approved.

6. If the Client has purchased their MYO slot, they are able to resell the slot for no more than it's worth. If it's brought to light that the Client has resold their slot for more than they paid for it, the staff will take action.

7. If the Client received their MYO slot through gift or trade, they are only allowed to trade or gift the slot. They are not allowed to resell the slot if they did not obtain it through initial purchase or resell.

8. The Client is allowed to commission custom designs from artists for their MYO designs, as long as credit is given when the design is turned in.

1. The Founder has the right to upload any adopts, MYO designs, or any sort of official species design to the Toyhouse masterlist.

2. Purchasing an official adopt OR creating a design via MYO means the Client is agreeing to their design being uploaded to the masterlist.

3. The Client is responsible for keeping track of their design and updating trades, sales, or gifts via the masterlist.

4. The Founder can and will enforce uploading to the masterlist, as all designs will be accounted for this way.

5. Species designs are only considered legitimate once uploaded to the masterlist.

1. The Client is only allowed to resell their design if they've purchased the design and have proof of doing so. If the Client is caught trying to resell their design without paying for it originally, there will be a warning. If it happens again, there will be further actions taken.

2. The Client is able to trade or gift their design at any time, as long as they document who they've transferred the design to and the method of transfer.

3. The Client is responsible for tracking their design's worth (for resell purposes).

4. The Client is required to document any sort of transfer, whether it's resell, trade, or gift.

1. The Client is allowed to resell their design as a voucher, as long as they follow these guidelines:

• You must document proof of the voucher itself.
• You must have proofs of the transfers, and of the worth of the design you received.
• All parties involved must be aware of the voucher and be aware of these TOS.

2. If the Client fails to follow the voucher guidelines, there will be additional precautions put in place to prevent further misunderstandings.

The Client may partially resell their design for co-ownership purposes.

1. It is recommended that the Client charge 50% when selling for co-ownership.

2. Both Clients that own the design must resell the design as one price.

3. If one Client wants to resell their co-ownership rights, they must only charge 50% of the designs total price.

4. It must be documented that the design is co-owned, otherwise it will not be know that the design has two owners.

1. The Client may have an alternate universe, or AU, for their Solinox/Lunalux character. Permission from the Founder is not needed.

2. It is required that the Client has permission from the Designer of the Solinox/Lunalux, as some designers may not like their work being edited.

1. The Client has every right to discontinue, or pull, a MYO Solinox/Lunalux design, as long as they have prior permission from the character Designer and the CS Founder.

2. The Client may not discontinue an official design.

3. The Client may return their design to the CS with a new MYO slot.
