A user by the name of @Sheller has been filing an insane amount of chargebacks on multiple people in a very short period of time, including one of my close friends (Sanviento). Please do NOT do business with them, and keep an eye on your accounts if you have ever sold to them. I'm serious. They've stolen over $2k worth of art, characters, etc. from people so far.

I've got like one dude in my trade folder if you wanna offer whatever on him. Other guys are hidden for now, because I don't want to even look at them anymore. Outside of that, if you were kind to me during my time in the ARPG, thank you. If we've had positive interactions before and you have anything you'd like to request on my account besides my characters, I will see what I can do for you. I have to take some time to decide what I will do with my characters now. It breaks my heart, but I cannot stay or feel safe after what has happened.

GENERAL RULES & BOUNDARIES

• I am not interested in friendships or personal conversations with people under the age of 16! This is for the sake of my own comfort. 
  • If you’re under 16, you can still follow me, ask me questions, comment on my characters, etc. Just be aware that I will be keeping interactions to a minimum.
    
    
• I wholeheartedly welcome fanart of ANY of my characters, (except, of course, for those in the UFS/T folder)! 
  • Please ask for permission before drawing these specific kinds of fanart (other kinds don’t require permission):
    • NSFW and/or suggestive artwork
    • Artwork depicting my character and the character of another user interacting
    • Artwork shipping any two characters who aren't explicitly and canonically in a relationship with each other
  • If you don’t ask me first about the aforementioned kinds of fanart before creating it, you risk being blocked, since certain scenarios can make me really uncomfortable.

• Outside of the realm of fanart or things made for me, my characters are not free to use for your own purposes. Please don’t use them for faceclaims, RPs, or anything else along those lines. 
  • In this same vein, any kinning of my characters is not okay! All of my OCs are very personal, so kinning them feels extremely violating.
  • The same goes for taking heavy inspiration with regard to my characters or stories. You would be surprised how much of my personal thoughts and feelings are inside of each and every one!

• I am open to RP with many of my characters! I prefer to RP through Toyhouse DMs/world forums for acquaintances and Discord DMs for individuals I have spoken to before and/or trust. You must be 16+ in order to RP with me.
  • Be aware that any RPs that occur will all be non-canon unless stated otherwise and agreed upon by both parties.
  • I have the right to refuse an RP for any reason. It’s nothing personal, really. 
  • If the character belongs to a specific fandom/closed species, I would prefer that they stay within that fandom/closed species. This means I am likely to turn down RPs involving other characters who don’t fit that description.
  • If neither character is part of a specific fandom or closed species, then it’s just kind of a toss-up and we’ll see how things might work.
  • I do not do NSFW RP with strangers. Please do not approach me for NSFW RP or initiate NSFW RP without my consent. Anyone who does so will have their RP with me dropped immediately, followed by my blocking them.
  • If you’re interested in RPing with me, please send me a DM first so that we can do a little plotting beforehand!

The first few parts of this TOS discusses the rules for commissions. If looking for design and usage rules specifically, scroll down a bit!

★ GENERAL ★

• All prices are based on the average amount of time a piece takes to complete, as well as its difficulty. Prices may fluctuate depending on how much time I have to work, as well as the demand for my art at any given time. DO NOT complain about my prices, please; said prices are non-negotiable, and if you find them to be too pricey, please commission somebody else.
• I can decline your commission request for any reason whatsoever. I am not obligated to give you an explanation as to why I am declining your commission. 
• I reserve the right to stop working on and refund a commission should the commissioner become rude, unreasonable, or otherwise impossible to work with. If the commission is partially completed by that point, a partial refund will be issued.
• I do NOT offer refunds by request. Once you pay me, you've paid me; your fiscal responsibility is not within my control, nor is it my business. HOWEVER, while it has never happened, in the event that I personally fail to complete your commission, you will be given a full refund no matter how much of it is already completed. You will also be given any WIPs and sketches in my possession at their currently completed state, and have my sincerest apologies.
• Please provide a clear digital reference of the character(s). No traditional reference sheets. No written descriptions (unless ordering a custom design). No blurry or artifacted images. Colors must be clear and concise. If your reference is shaded or has altered coloration, I will likely end up using those colors for your commission, and will NOT correct them should they be incorrect due to error on your part.
• Feel free to request that I change any aspect of your commission before sending payment. You will not be able to change your order after paying me (ie: adding more characters, complex objects, etc), though you will have a say in the process when sketches are sent.
• I may make other art before your commission, whether it be someone else's commission, personal art, or otherwise. This does NOT mean I have forgotten your commission or am putting it off, so please do not message me under that assumption. I complete commissions in the order received, and I almost always offer a window in which your commission should be completed; if I exceed this window, then you are more than welcome to question me, remind me, etc.
• Understand that I work at a slow pace. If you really want your commission to be done as soon as possible, you may want to consider commissioning someone else.

★ PAYMENT★

NOTE: Paypal (USD) is my only accepted form of payment.

• You must pay for your commission before I start working. 
  • I will not begin work, nor transfer over a design, until payment has completely gone through. This means that pending invoices are considered unpaid invoices. Work will begin / the design will be sent AFTER the payment has cleared.
• Payment plans are an option for orders of $100 dollars or more.
• Additional characters WILL add to the price; how much depends on the commission type.
• I do not give refunds unless I am unable to complete your commission. No exceptions.
• Once you decide to commission me, you must give me your email so that I can send an invoice!
  
  
  

★ COMMISSIONS AND EDITS★

• I will not make major edits after the sketch stage; if you do not mention a major error in the sketch stage, and it carries over to the final piece, I will not fix it unless paid extra to do so.
• Minor edits are entirely free of charge, even in the more final stages of completion; major edits may require financial compensation after the sketch stage.

★ USAGE OF ARTWORK AND REPOSTING★

RULES:

1. My work may never be minted as an NFT, or involved in anything of the sort whatsoever. If you see someone using my work as an NFT, please notify me immediately.
2. Please ASK before reposting works you did not commission from me, or that you do not own! If you commissioned the artwork from me, were gifted the artwork by me, or are the owner of the character(s) depicted in the commission, you may repost/use the art as decoration/etc. as long as you link back to me, or credit me somewhere! In those cases, you do not have to ask.
3. You MUST credit me through a direct link to my page if you repost, making it clear that I was the original artist.
4. You may not use my work for profit or promotion of yourself unless you yourself own the character/piece itself, AND my permission has been given. I reserve the right to decline providing a commercial license for any reason if need be. 
5. You may NOT use my personal works, (ie depictions of my own characters/projects), on your page as decoration/avatars/etc. unless they are clearly labeled FTU or you are given permission directly.
6. You may not claim my work as your own, even if you commissioned it.
7. You may not remove my signature or watermark, draw on top of my works, or recolor any of my works if it is your intention to repost them elsewhere. Editing the work for decorative purposes, like icons and headers, is okay as long as it's still credited. When reposting publicly, I ask that you use the original watermarked image.
8. You may not claim my characters or the characters of others as your own under any circumstances, nor may you repost reference sheets of characters you do not own.
9. You may not publicly display my work in 'review' videos, blogs, etc. without my permission.
10. Remember: MY SILENCE IS NOT PERMISSION. If I do not DIRECTLY tell you 'Yes, you may use this work', do not assume that you have my permission! If I do not respond to you, do not see your message, etc, do not assume you have my permission!

Regardless of the circumstances, I retain the right to ask that reposted work be taken down for any reason whatsoever. Refusing to comply with my rules after your first warning may result in blocking, blacklisting, and a DMCA if possible. Note that DMCAs only occur if a piece or character is not being used by its rightful owner, or the owner does not have commercial permission.

★ DESIGN-SPECIFIC USAGE RULES★

In addition to the general rules stated above, these rules apply specifically to customs and designs--

1. DO NOT use the design for monetary or commercial purposes, unless you are given permission and/or it is negotiated with me. Essentially, when buying, you have exclusive rights to the design in all contexts save for commercial contexts by default.
2. Do NOT make the design into a closed/semi-open/open species without permission. Being a certain species in your personal story or work is fine; adapting them to fit your world and whatever else is A-OK. All I ask is that you do not build an entire community surrounding the design without asking and/or informing me, as with closed/semi-open/open species, ALL OTHER DESIGNS will be based upon them and SOLD, which can potentially conflict with the next rule.
3. Do NOT clone designs for profit. Do NOT breed your design with the intent to justify creating similar designs for sale.
4. DO NOT ALTER THE ORIGINAL ARTWORK SIGNIFICANTLY. Small changes, such as hue/saturation edits, cropping for icons or profiles, or removal/addition of small markings is fine. However, if you wish to substantially change an aspect of the design, or accessorize your design, REDRAW THE DESIGN YOURSELF. Do not draw on top of and/or 'correct' my work; it's a pet peeve of mine.

★ BUYING, SELLING, AND TRADING DESIGNS SECONDHAND★

1. Do NOT sell my designs for more than they are typically worth, unless they come with additional art, literature, development, etc. If you have commissioned works of the character, the character's worth becomes equal to the collective price of the artwork, literature, etc. you have commissioned, plus the character's original price.
2. My designs RETAIN THEIR ORIGINAL VALUE, regardless of if they were resold for a lesser amount, traded, etc. The original sale price is always the design's base price. If you know the value of the commissions the character has, even if you yourself did not commission them, you can add that as well. Characters obtained in non-money or non-point OTAs have a base price of $0.00. 
   • If the design I have created is a CS design, then the rules of the CS override my own personal rules. For example, if the CS rules say the base price of a design resets when traded, then the base price of the design resets when traded.
3. If you got one of my designs for free, you may NOT resell it, (unless you have commissioned additional artwork, literature, etc). You may trade it for other characters, art, physical items, etc. If you have commissioned works of the character, the character's worth becomes equal to the collective price of the artwork, literature, etc. you have commissioned.
4. I am not in charge of co-ownerships, and will not be involved if squabbles over designs occur. I will not make decisions for my designs after my designs have been sold or assign ownership if things go sour. Please be aware of this when co-owning designs.
5. I am not in charge of nor involved in secondhand trades, and therefore do NOT take responsibility for them. However, if a scammer is making use of my designs or has scammed you out of one of my designs, do feel free to notify me. I may not be able to actively stop the scammer, but I will do everything in my power to spread the word, and the scammer will be blocked/blacklisted across the board.
   • If the scammed design was a CS design, please take up the issue with the CS group itself. I have little control over designs in CS groups and what is done with them.
6. When buying, selling, or trading a design of mine, ALL RIGHTS to said design that the current owner has MUST be transferred to the new owner. You cannot partially preserve your rights to the design, nor add new rules to the transaction.
7. My TOS applies to my designs globally, regardless of the current owner. You may not change the rules of the design once it is in your possession. Through purchasing my designs and agreeing to my TOS, you are acknowledging that you are aware of this fact.
8. You do NOT have to notify me that a design of mine is being bought, sold, or traded; however, I am interested to know where my designs go, so try your best to credit me properly on Toyhouse when you can! That way I can see everyone under my designs tab.

Note: Many of my rules in this section function on the honor system. If you choose to break them, I will not attack you, nor come after you in any way whatsoever; however, I very well may not work with you again if I discover you've disrespected my personal wishes in regard to my art/designs. The exception to this is commercial use of my work without discussing it with me; if severe enough, I will pursue a DMCA or take legal action.

★ BLACKLIST★

This is a list of individuals who I am simply uncomfortable working for, and who I do not wish to associate with -- mainly for personal reasons, (which I will NOT discuss at any point in time, even if I am asked). By agreeing to my TOS, you are also agreeing that you will not sell or redistribute my work to any of these individuals, nor will you request work for them from me in particular:

This blacklist exists for the sole purpose of preserving my own safety and comfort -- nothing more, nothing less. Please make no assumptions, positive or negative, regarding the character of the individuals listed here unless stated otherwise. If anyone has a reason for blacklisting BESIDES personal preference, (eg. scamming, harassment, etc.), it will be listed next to their name.

Be aware that not all listed reasons for blacklisting someone have happened directly to me; I will also blacklist if I see crude acts towards other individuals in the community.

 No licensed character rips, un-credited, or "off-brand" OCs will be accepted.
