Howdy!

So on dA and Twitter i was considering making a Twitter handle or two for my characters.

And then noisechannelrocker made one for their OC.

And then @fisty had that bulletin about the grammar vigilante

So Now there's three accounts!

 23 == @BohemianHacker //  kasen == @VampHunterKasen

And a not yet uploaded OC at @TheRogueComma - they'll be my fourth wall breaking vigilante if you want to talk to anyone.

Feel free to drop them messages and stuff!

Also!

I'm still taking writing commissions. And trying to trim down my Pcs.

And an OC I bought has recently been revoked :/

Not a huge deal because I paid like 70or 100 dA points for it and I haven't used the design. But it was just kinda out of the blue so *shrug*

....it took me a while to figure out who you were and what you were having issues with.

if you have further issues with aquapyrofan, you might be best taking it up with him directly.

the issue (on my end) was resolved here back in april :/

It's fine o3ob

It's sorta settled haha. It's not a huge deal with the points but I'm hoping that the other party has learned about what is and isn't permissible in the adopts community and has a better idea of how to work with customers instead of against them *shrugs*

I'd just put out an artist beware if they're going to just scam people like this.

I'll make you a new gd character for free lmao. Or art. what the hell even is this kid.

I put up a PSA here. AB frankly terrifies me (I'm so shit at LiveJournal Idk why) so I probably won't.

Pfft it's fine~ I really don't need know characters haha

I'll draw u a thing of an existing character then. B )

Omfg no you're good hahaha. Thanks for the support 100%♡♡♡

Oh my lord, this is horrifying honestly;;

Who thinks it's actually okay to just randomly take a child away from a owner because they ACCIDENTLY didn't see a rule they decided to add out of nowhere >_>

Looks like you're not the only one who got affected by this

Geeze that's, wow.

That's the second shittiest customer relations gaffe of the past month barring trump

LMFAO for real

I can't help but wonder how this person keeps business? Do people even realize they don't truly own the OCs they buy from them? I'm sure many would be downright angry to hear their precious babe is nothing but a 'rental' ugh

I have no idea but I'm so effing glad the every time I tried to get art for this design it fell through

Someone was definitely lookin' out for ya

Yeah I guess hahaha

They gave me zero credit and posted a design they didn't have permission to post (I had explicitly stated those characters could not be used off DA)

My TOS clearly states to tell me if you're planning on trading, also, the design was improperly credited. I'm just protecting my intellectual property here.

Point of order - it's only "improperly" credited because I did not know of your TH account at that time. The image was still credited to your DeviantArt page, as was the design until you requested ownership of it. Your IP remained protected as it was linked backed to one of your accounts.

Your TOS was also updated on DeviantArt /after/ my purchase of the design to include the revokation of designs without warning or repayment. A warning that you would have liked the character image to also link to your TH would have been nice, as I would have been more than happy to credit you on-site. You also didn't mention your TOS during the purchase process and I didn't even know you had one since it was only linked on your main page - that was an oversight on my part because I never check a deviants home page unless given reason to, which I didn't since nearly all my interaction with you has been from my notifications page or the design itself.

Re: plans to trade - Eka (the design) was never one I actively tried to trade. As you've deleted the character page, I can't even tell you if I had improperly tagged her as such. This is especially true of my closed species designs since I don't generally trade them - but Eka's character icon was surrounded by designs that I normally do trade. :/ unless someone offered me a dainty for her (very doubtful) I probably would have declined all offers on her

It doesn't matter, as regardless of my TOS, I never gave permission to "own" the artwork or design. I only "rent" them, as part of games.

My issue is that you are claiming I failed to credit you, which isn't what happened - you were always properly credited to your DeviantArt which, up until now was the only place i knew where to credit you. I did not know you had a TH which you had never mentioned when I had made my purchase even though I made it no secret that I have an account and post my characters regularly. I would have been more than happy to credit you here had I known, and did do so after you requested ownership rights and I checked to make sure it was actually an account accredited to you.

I don't know of you realize this but I don't follow you on dA and have literally no way of knowing that you had created an account on this site. It would have been a nice courtesy to a buyer to at least inform them of such changes or that you had an issue with me posting your designs rather than you just claiming the design back without any reason as to why.

That other person refused to fix it and they weren't allowed to post the design on here in the first place.

You also never informed me that you wanted to have the art credited to your TH as well :D

It would have been simple enough for you to post or PM a "hey, you forgot to change the credit on the image too"

Also a lot of online games have the same business practice as me, and those aren't considered scams.

Those games also require you to agree to their terms of service prior to playing which you did not require.

They also require that they inform users of changes of TOS which you also did not do. :)

Ok but rather than gently saying "Hey, this goes again my TOS, ming taking it down?" You hardcore revoke. Which is a huge red flag for anybody against dealing with you.

Im quitting doing adoptables entirely.

I might still get points back, idk. It's legit been two years since I bought the design. If this was a character I actually use or got art for, I'd probably pull a bitch fit but tbh having that design gone means I don't have to try and get rid of it some other way *shrug*

Well I think you can see above how that's going

It's art theft to have a design be improperly credited, and I'm not going to stand for that. I still own the rights to the image, too. Plus rules were broken.

I'm not upset, I'm just explaining what happened.

Yeah, I saw, which is why I was clearing it up. My wording might've seemed angry because I don't like when people fail to read my TOS.

Point of order to what aquapyrofan said - I linked the design to his DeviantArt and not his Toyhou.se which I didn't knew he had until like... less than a week ago when he requested creator rights. I gave him those but hadn't gotten around to editing the art piece I had to point to them as well.

Can someone even take back a design like that after it's paid for?? Did you get a refund?

It depends on the TOS when you bought the design. I tens to steer clear of designers who have a TOS that says they can take back a design and not reimburse/compensate. I've got a few designs where if I ever want to get rid of them, the creator gets first dibs on offering.

No refund atm :/

well if it's not in their tos then you don't have to give em back.

Checked their TOS, which had since changed from when I adopted the design to include the fact that they can revoke ownership. They also never notified me of a TOS when purchasing or designing the adopt and it's only currently linked on their front page (and I have no idea if it's always there or it's a new edition)

I could just give them a huge FU and reupload the design - I haven't deleted the original artwork for it since that's on my drive at home and I don't want to root through dozens of folders on my phone - but I don't think I'm that salty over it yet

i would tbh. Especially if they changed it and didn't notify me.

It's an option I guess if they continue claiming I was /stealing/ their art - call a spade a spade, they're salty that the image was still linked to their dA instead of their Toyhou.se. They even had a journal on dA and everything without naming names. But like, they never said they had a TH and I don't follow them so how the hell would I know that they got one after I bought the adopt??? They're upset with improperly credited designs and want all of their designs to originate from them, sure, but instead of just talking to people like me they fly off the handle instead.

...okay so I'm a bit salty about this but I really take issue with them claiming I'm stealing their IP. Like I need to steal their IP - I have way too much shitty ideas on my own to want to go stealing someone else's.

If they don't sign over art rights, they're legally allowed to.

That's so rude though.

It's just how copyright law works.

Doesn't make them any less of a dick tbh.

Without cause, yeah, I agree. But copyright law does not side on the consumer's side.

The creator requested I send the design back. I asked them if there was a particular reason why but they haven't been on today since they revoked my ownership.

I asked at least. No idea if ill get a response though
