By buying from or interacting with the group, or owning any FMN or CD you are agreeing to this TOS.
Anything not explicitly covered under this TOS is under the provision of the artist's TOS Please message the group with any questions so that your message can be handled in a timely manner.
FMN and CDs are closed species and may not be created without permission from the owners (Rikouryu and Mischief)
The CS owners and Guest Artists reserve the right to refuse service to anyone in such an event as they deem necessary.
Crediting
As per Rkzn’s request, all FMNs and CDs, including older designs, should be credited to Rikouryu @ DA or Toyhouse as species owner, with Rkzn listed as designer.
General
- Do not steal/copy/trace someone else's art for your FMN/CD
- Do not base your FMN/CD on a copyrighted character
- Do not base your FMN/CD off of someone else's OC
- MYO slots are not refundable
- Other people can design your MYOs for you as long as you provide proof of your slot
- A guest artist design that is turned into a FMN/CD with a MYO slot is still considered a MYO
Reselling and Trading Rules
- A FMN/CD must be listed under it's current owner on the masterlist to be eligible for trade/sale.
- Include a link to the masterlist when you make trade/sell journals so that everyone knows it's not a scam.
- Immediately after any ownership transfer occurs the masterlist entry must be updated in order to have a legal transaction.
- You may only do one of these things when transferring ownership, ex. reselling and asking for a design add on is not allowed.
- Please do not buy or trade for anything not on the masterlist, instead encourage the person to register their designs first before transferring ownership!
Resell
- Direct resale is permitted based on the price paid for the original design and may have the price of all paid for commissions added to it.
- Gift art, traded art, and any other art not paid for by the current owner may not be added to the overall price of the design.
- Traded designs may be resold for the price that the current owner has put into it only, the rest is to be gifted to the new owner, ex. a traded design has $200 dollars of commission since it was traded and therefore may be sold for $200 but comes with all art.
Trade
- Trades are acceptable in almost all cases, if you have any concerns please message the group.
Voucher
- Vouchers are considered trades for all future purposes, the price of the voucher is not to be constituted as the new monetary value of the design.
- Money may never enter the hands of the person seeking the voucher in order for it to be considered a proper voucher.
- Vouchers are not bound by monetary limits imposed upon sales, so you may voucher for something worth more than your design.
- A voucher is a direct, one-for-one trade for a specific item, commission, or adopt, wherein the person seeking the voucher receives the vouchered item and directly trades their design for it.
- When seeking a voucher, something specific must be named in return for the design.
Gift
- The sale, trading, or vouchering of a gifted design is between the gifter and giftee and will not be mediated by the group provided it adheres to the other rules lined out above.
MYO Slot Rules
- When designing a MYO, send it to the group and get it approved before posting it publically anywhere.
- MYO slots can’t be exchanged or upgraded after the fact, a new slot must be purchased.
- MYO slots can be traded and sold, but the group must be informed so the masterlist can be kept up to date.
- If your name isn’t the most current on a given slot then a MYO design will not be accepted without proof of exchange.
- MYO Slots cannot be sold if they were traded for, only traded again as there is no way to add value without getting it designed.
- Please do not trade or sell for any slots not currently registered on the MYO Tracker, please be sure to check before you buy! Please encourage the current owner to register their slot before you make the transaction!
Trait Upgrades/Addons
- In most cases, trait upgrades follow the MYO rules outlined above, with a notable exception.
- Trait upgrades and addons that have been attached to an FMN or CD are NOT transferable in any way, they are a permanent upgrade to that character.
- When purchased, you will be asked what character you wish to attach them to, and this attachment is permanent.
- If you happen to get an unattached upgrade then it can be traded but not resold, as no unattached upgrades will ever be sold.
- An unattached upgrade can be attached to a MYO slot or an existing FMN, but once it is attached to something it is considered used and no longer transferable.
Co-Owning
- Co-owning is allowed, however the group will not mediate disputes between co-owners.
- Both co-owners must be listed on the masterlist.
Redesigning
- You may redesign your FMN/CD as long as it still obviously resembles the original design.
- You may not change any traits of an FMN/CD with a redesign (including flower type), only other details.
- You may not edit the original art to do this redesign.
- You must keep the original version of the design so that it can be passed on to the next owner if need be.
- The original version of the design must go with the redesign and cannot be separated.
AU/Non-Species Versions
- You are allowed to make human/non-cs versions of your FMN/CDs.
- However, they must go with their CS form and cannot be separated for any reason.
- FMN/CD versions of other CS will be managed on a case by case basis by comparing TOS, please message the group or Rikouryu for these kinds of inquiries.
Discontinuing CS
TO CLARIFY: Voiding the FMN/CD form of your design does NOT void the entire design, only the FMN/CD traits and involvement with the species. This is primarily an out for people who no longer want their adopt to be a CS.
- You may not turn an official (non-myo) FMN/CD into a non-species permanently, however AUs are okay.
- You may not edit the original art to remove FMN/CD traits.
- If you want your MYO FMN/CD to be voided from it's CS form that is acceptable, provided you have permission from the original designer.
- The masterlist will be updated to indicate that the FMN/CD form has been voided.
- You must discontinue use of all art containing the FMN/CD form and not use it as an AU.
- If you do void your FMN/CD from its CS form, you must inform any other owners that such action was done so they knew not to use any CS art they may find floating around of that design.
- A voided FMN/CD may not be reinstated as a CS or put back on the masterlist as non-voided.
Commercial Use
FMN/CDs cannot be used commercially for any reason, there are too many people involved with different TOSes.
I reserve the right to change this TOS at any time provided I make it known the changes that were made - a changelog will be added for minor updates.
