General Thread for PSAs

Posted 8 years, 1 day ago (Edited 5 years, 6 months ago) by Vespisia

Hello!

8/9: New PSA added.

5/14: 2 new PSAs added.

4/8: New PSA posted and additional information on Squidribs added to relevant PSA.

It was suggested that there should perhaps be a general thread for PSAs which is a fine idea. A place that links to other PSAs and keep things organized.
You can link your threads/PSAs/etc, and I'll add them to the posts. :D
Please Note: I can only accept public PSAs. Anon PSAs are too much of a risk to accept, as they can be open to slander.

Things That Count for PSAs!
-Scams
-Illegally chargebacked (you did a commission, but person claims you never did, for instance)
-Being shifty on doing owed things (taking months on an icon for example, lack of contact or updates, etc)
-Tracing and profiting off of it...
-Etc...

Things That Don't Count!
-Someone has better art than you
-Rude behavior
-Subjective issues
-Dog ate your homework

Obviously, this is just the basic frame work. Each case is different. For instance, someone could go around harassing artists for art and customs, or for people to give up their adopts and whatnot, and that could almost certainly be considered for a PSA...

Of course, it would be great if no more PSAs occur, but in the case they do, I support people posting them because they keep the community safe and will link to them in this general thread. owo/

There'll be two posts, one for PSAs and one for resolved cases! ^^

I need a little advice I think...
Earlier I found a design that is so close to one of mine that I'm 99.9% positive it's a rip. I know of another design by the same designer that's highly suspect, but is rather plain, so, I'm not sure if I'm over thinking it because of the first one. I personally don't really care that one of the designs is 2 things off from a 1:1 match, but this person is somewhat known and sells adopts/customs somewhat often (I think at least). I'm afraid this might be a trend and there's more designs that I haven't noticed. They're rips of designs by two very well known humanoid/CS adopt artists. I'm fairly certain they know of the designs...or at least of mine lol. But, I don't want to involve myself in drama and I've never written a PSA or have the desire to... I just feel a bit rotten having noticed this bc I know OCs can be very personal and have an inkling there's more I'm missing...?
I'd like some advice/confirnation and I guess to collet my thoughts a bit, haha. If someone could shoot me a pm to talk to me about this (or reply here, but I rather keep this private in case I'm mistaken and don't want to jump the gun because I actually like the designer) or something I'd really appreciate it!

SeaSlugs Could you PM me this artist and the designs in question? If they're known and they're the type to lift designs without really transforming the ideas into their own work, I would like to avoid buying from them in the future.

Taebasco

SeaSlugs I'd like to know the name as well and see the comparison. I buy adopts often and so do my friends and I'd like to avoid them if they are ripping off designs

PaperTsubaki so after noticing they are Argentinian i decided to make a little research and o boi

in 2016 when i first joined DA i met jiumiingo we talked a lot and decided to make an art trade, i finished my part but she never did his part,, later on i decided to commission her for one of her sketch commissions here and it was kinda sketchy tbh since she told me she was collecting money to refound past commissions... but a few days past and she completely disappeared from DA
now, i decided to check on Chocomisu and compare their styles which i find a bit similar, ofc the style can change a lot in two years so i wasn't completely sure until i check Jiumiingo's instagram link and yeah.. that confirms that Chocomisu is jiumiingo.
They have a past of accepting commissions and disappearing so i think a PSA should be good to warn everyone else.. i feel like they are doing it again.
And tbh the photoshop thing is complete bs, with their jiumiingo account she told me a lot of excuses of why she couldn't complete her trade part and commissions.

I have an update regarding the unfinished art trade. Last time I got the time wrong. Today, 2 weeks ago we agreed on an art trade. I said I would finish mine in the weekend so I did. A few days later I messaged them that I finished my part of the trade. I also sent a very low res image as proof just in case they would doubt me.

I get no response. 2 - 3 days later I message them on deviantart too, asking them nicely to check their toyhou for my message. Still no reply.

Today, 15/12 -18 I saw that they updated their profile with a new icon, as well as making a bulletin containing an art raffle they joined along with some closed species post. They still didn't get back to me. No answer. Nothing. This is giving me so many red flags atm.

I sent them another message after this, a slightly more strict one. I asked why they updated their profile but didn't get back to me, as well as if they still want to do the trade or not, awaiting for a reply.

I've been in contact with another person who's in the middle of a trade with them and it seems like they've had no issues with the person. Though, it's not yet finished so I can't really say more about it.

What do I do? Is there something I can do?

PaperTsubaki sadly i don't have those notes anymore.. only that comment i made on her commission journal (the excuse she made on those comments, she was claiming that she needed founds to pay her new house and that she couldn't work on her part of the trade because her family broke all her things on her room?? and she was taking paypal to pay the house and the things broken, and points to refound other commissions)
the only other proof i have are two comments i made here and here

also sorry if i keep mixing she and he.. since on the account Jiumiingo she claimed to be a he ;;

I need some advice: I had blocked a user for personal reasons. I had done a trade with them on this site, and now I want them to take down my art from their profile/character gallery because I do not want my art associated with them any longer. I asked my sister who has an account in this site as well to contact them on my behalf as I have blocked them and do not wish to have any interactions with them any further, politely asking that they take down my art (I've also taken down the art that they draw for me for our trade).

The user used my art for their profile image, profile, and character gallery. I asked them to remove the image from all three. They have changed their profile image and removed the image on their profile; however, the image is still up in the character's gallery. When I checked again, they have blocked both me and my sister, preventing us from contacting them further to take down the art. As the artist, I really do not wish to have my art associated with them, and I have no idea on how to go about this further.

Thanks in advance for any input.

eh, well if there's nothing else i can do then i'll just move on, thanks for your comments!

EDIT 2 (17/12/18): This issue got resolved, and my art is no longer up. I would've posted a new comment, but it feels unnecessary since I just want to update + also give some information in the off chance that someone DOES experience a similar situation.

"You can not force someone to take down your art from their account" and "the user still has every right to your art" is false.

When you upload an image on Toyhou.se, there is a small blurb under the artist's credits saying "Do not use images you do not have permission to use." There is also a statement in the "Art Usage" category that says "We do not allow uploading of art, images or designs that you do not have  ownership of or permission to redistribute. Unauthorized reproduction  of other peoples' intellectual property will result in removal of all  relevant content. Repeat offenses will lead to temporary or permanent  suspension."

Even after giving the art piece from the trade and after some time, as the original artist of the piece I now no longer give them permission to use my art. After asking and giving my reasons to take down my art, they refused, blocked me to prevent further contact to try to explain and resolve the issue, and still at least had my image up in the character's gallery; thus violating one of Toyhou.se' Art Usage rules.

And so, you are able to file a ticket to ask for the image to be removed (while of course giving valid and enough information about the issue).
