*"Gem" is a term used to describe all five species on Ditee-ath: Gemmadites, Gemmismae, Undadites, Geludites and Ignisdites.

★ NEW!! From February 4th 2021 this species and the community will be 18+ only, which means you have to be 18 or older to be part of the community and own a Gem. The reason for this isn't for NSFW purposes, but purely personal from my end. If we find out that you lied about your age to get a Gem and get into the community, you will be banned from the species and be forced to either trade, sell or gift your Gems. (If you're part of the species before this new rule, under 18 and own a Gem before this update you are still allowed to be a part of the community)

★ If you trade/sell/gift a Gem to a minor, without checking their age, the transfer is invalid and the Gem has to go back to the person who traded/sold/gifted the Gem, or to Yuko-san (if the original owner doesn't want it back), who will then find a new home for the Gem within the community. The person who traded/sold/gifted the Gem will also get a strike.

★ You are not allowed to make your own Gem without my (Yuko-san) permission.

★ It is mandatory to become a member of the species group Gemmadite-Species (Or the TH world if you don't have a DA Ditee-ath). This is to keep track of all Gem owners and so you can keep up with the community.

★ You may not claim the five Gem species, and lore, as yours.

★ You may not use the five Gem species for commercial use.

★ Your Gem will be uploaded to the master list account Gem-Masterlist with the "Official Gem" stamp. This is to keep track of who owns what and to make the Gem official.

★ You may convert another cs or none cs character into a Gem if you have a MYO slot. However, if the other cs T.O.S., or none cs artist's T.O.S. states that you cannot convert the character into another species, you cannot convert the character to a Gem.

★ Do not harass any other members of the group, or guilt anyone into giving you their Gem/unused MYO/art.

★ Gems live in an open universe, meaning that they can interact with other species and none species, and don't have to live on Ditee-ath, so you can put your Gem in any universe you want, but you are not allowed to change the species, or take the Gem out of the species. If your Gem lives in another universe, they can still interact with other Gem characters.

★ While Gems can interact with other species/none species, and live in other worlds than their own, they can't interact with/live in fandom worlds. It also means that they can't interact with fandom oc's. This also applies to roleplaying games, such as D&D and other rp games like it.

★ If you move to another account, please let us know, so we won't assume that your Gem(s) was stolen (You have to join the group from your new account).

★ If you deactivate your account, or move to another without letting us know, your Gem(s), as well as any unused MYO's, traits and bank account in the group, will be voided.

★ If you should reactivate your account, which your Gem(s) has listed as owner, and they have been voided in the meantime, you can get them back. Getting back unused MYO slots/traits will need proof that you had them and didn’t use them. However! Should you have failed to inform us about moving accounts and come to us to get your stuff back from your new account, we need proof that it was originally yours.

★ Gems can have offspring with other species of similar anatomy, but if their mate is from another closed species you have to let me know that you would like to have a crossbreed child for your Gem and the other species. I will then contact the owner of said species and ask them if they are interested in making a crossbreed species with me (The reason for doing it this way is because there could be a conflict with the two species T.O.S., so to avoid that I will rather work out something with the owner). ★ If you are banned/black listed from the species you are allowed to keep your Gem(s), or trade/sell/gift them (The new owner has to agree to the T.O.S. before the trade/selling/gifting is done and I need proof of this + knowing who the new owner is.). If you keep your Gem(s) you have to change it to something that is not a Gem. Any unused free MYO slots you may have will be voided.

★ If you have done a charge back on a MYO slot or an adopt, you lose the right to the Gem and I will take it back! You will also be black listed from owning a Gem again.

★ We will not associate with banned/black listed members, meaning that anything of yours will be deleted from the group.

★ If you leave the species (aka. leave the group) you may trade/sell/gift your Gem(s) (Look under "Trading/selling/gifting" ). If you choose to keep your Gem(s) you have to change it to something that is not a Gem.

★ When you take your Gem(s) out of the species and redesign them to something that is not a Gem, I would like to see the redesign to make sure that it does not resemble a Gem.

★ From August 1st 2020, all newly adopted Gems from an official/guest artist, can no longer be taken out of the species without the official/guest artist's permission if you choose to leave! If the artist doesn't give you permission to take the Gem out of the species, you have to either resell, trade or gift it. This also goes for adopt designs you didn't buy yourself, but got through a resell, trade, gift or through a raffle. If you're unsure if the Gem is an official/guest artist adopt, you can see it on the Gem's masterlist entry. Gem adopt designs made by me (Yuko-san) and MintyTomato automatically do not have permission to be taken out of the species under no circumstances!

★ If you return to the species after leaving it, and you changed your old Gems into none-Gem species, you can make them into Gems again, but it requires a MYO slot to have them made into Gems again.

There is a discord server for you to join if you want to. It's not mandatory. If when you join you only have access to four channels: "Welcome", "Rules", "Introduction" and "Channel-guide". For you to get access to the other channels you need to follow the instructions given to you by the Mee6 bot upon your arrival in the "Welcome" channel.

★ Always credit me, Yuko-san and MintyTomato for the species, whether it is your own art, a commission, YCH, gifts, and so on.

★ Always credit the designer (If you had someone else design your MYO for you, or bought an adopt from one of the official/guest artists) of your Gem(s) as the designer.

★ When you get art of your Gem(s) you have to tell the artist to credit me, Yuko-san and MintyTomato for the species. It would be appreciated if they also linked back to the group, but it is not required.

★ If you upload your Gem(s) (MYO, custom or adopt) to Toyhou.se it is not required to put me (Or the official/guest artists) as the creator of the Gem(s) (It is appreciated though ^^), just credit me for the species in the info. But if it is a design I made (Adopt or custom), or an adopt from one of the other official/adopt artists, at least put us as the "Designer" of the Gem(s). (My TH is Yuko-san)

★ If you use my bases to make your MYO, remember to credit me for the base.

★ When I upload your Gem(s) to the Gem-Masterlist account, I will credit the respective designer and owner of the Gem(s).

These editing T.O.S. applies to MYO's, adopts and customs from Yuko-san, MintyTomato, as well as adopts from official artists and guest artists.

Editing your Gem(s) is allowed, but there are a few restrictions.

★ When doing any edits of your Gem(s) that changes their look (not including clothes and accessories), remember to send me a new file of your Gem(s) for the master list account.

★ You may completely redesign an approved MYO later on, but you can only use the same rarity traits, or lower, as the MYO has, and remember to send a new file for the master list.

★ You may edit a purchased adopt, but do not completely redesign the adopt. Changing things here and there is fine, but changing it so much that it looks like a different design is not allowed, unless you're given permission to do so from the adopt artist.

★ If you wish to upgrade traits, or add mutations, on an already approved MYO you will have to purchase the upgrade/mutation.

★ Trait upgrades for Gemmismae cannot be used on gemstones! Only on traits.

★ For Gemmadites, Undadites, Geludites and Ignisdites:
You are allowed to:
- Change the gender (unless the Gem is an adopt, and the adopt artist doesn't allow gender swaps)
- Change the gemstone to another of the same, or lower rarity, but you have to remember to change the color of their markings, hair and eyes as well, as they have to resemble the gemstone's color(s).
- Change the hair style/hair texture.
- Change/give your Gem new outfits and accessories.
- Give your Gem mutations

You are not allowed to:
- Change the color of the hair, eyes or markings to a different one. They have to resemble the color of the gemstone.
- Change the gemstone to a higher rarity than the one it was created with.
- Change the shape and placement of the markings.
- Change the rarity of the pupils and ears.
- Give your Gem mutations without purchasing them first or owning an add on.

★ For Gemmismae:

You are allowed to:
- Change the gender (unless the Gem is an adopt, and the adopt artist doesn't allow gender swaps)
- Change the color of the markings.
- Change the markings.
- Change the traits to one of the same rarity, or downgrade the traits.
- Change the gemstone to another of the same, or lower rarity, but then you have to remember to change the color of their eyes and horns as well, as they have to resemble the gemstone's color(s).
- Change the hair style/hair texture.
- Change/give your Gemmismae new outfits and accessories.
- Give your Gemmismae higher rarity traits and mutations if you own, or have purchased trait upgrades and add ons.

You are not allowed to:
- Change the color of the eyes or horns. They have to resemble the color(s) of the gemstone.
- Change the gemstone to a higher rarity than the one it was created with.
- Change the rarity of the traits to a higher rarity without purchasing them, or owning the upgrade.
- Give your Gemmismae mutations without purchasing them, or owning the add on.

These trading/selling/gifting T.O.S. applies to MYO's, adopts and customs from Yuko-san, MintyTomato, as well as adopts from official artists and guest artists.

Trading/selling/gifting your Gem(s) is allowed, but look at these T.O.S. to see what you are, and are not allowed to do.

If it is an unused MYO you have to let me know so I can transfer the slot to the new owner's name, and I need proof that they read and agree to the T.O.S.

★ If a potential new owner does not accept and agree to the T.O.S. you are not allowed to trade/sell/gift your Gem(s)/MYOs with that person. If you do, both of you will be banned from the species.

★ There are no rules to what you can trade your Gem(s) for. It can be other oc's, closed species oc's, or art. The new owner just have to read and agree to the T.O.S. before the trade/gifting is done and I need proof of this through the transfer of the Gem on the master list entry.

★ When selling your Gem(s) you are allowed to sell it for the same, or lower price that you paid. If you have paid for art of your Gem(s) you may add the value to the price (This does not include free art).

★ Gems acquired through a free MYO, or through trading/gifting, may not be sold and can only be traded/gifted. You cannot make profit off of a free MYO/traded/gifted Gem. However! If you have paid for art of the Gem, then you may resell the Gem, even if it was made as a free MYO/traded/gifted.

★ Paid unused MYO slots may be traded/sold/gifted, but they cannot be sold for more than you paid. The new owner has to read and agree to the T.O.S. before the trade/selling/gifting is done and I need proof of this + I need to know who the new owner is.

★ Free unused MYO slots may only be traded or gifted! They cannot be sold, since they were obtained for free. The new owner has to read and agree to the T.O.S. before the trade/selling/gifting is done and I need proof of this + I need to know who the new owner is.

★ You are not allowed to trade/sell/gift your Gem(s) to a person on the black list! (You can find the link on the front page.)

These T.O.S. are the MYO T.O.S. You will have to also read and agree to the "General", "Crediting", "Editing" and the "Trading/selling/gifting" T.O.S.

★ No refund on paid MYO slots.

★ You are not allowed to start working on your Gem until your slot has been confirmed by me (Yuko-san).

★ Trait upgrades for Gemmismae cannot be used on gemstones! Only on traits.

★ You may use my bases for your MYO, but only use the traits that you have unlocked, and credit me for the base: Gem bases

★ If you have joined the discord server to unlock certain traits (from MYO events), and you leave the server before your MYO is done, the traits you earned from joining the server will be voided and you cannot use them.

★ Being inspired by copyrighted characters is fine, but don't copy a copyrighted character (Or someone else's oc). You will be asked to change the design of your Gem at any point if we find out you did this.

★ When you have completed your MYO upload it to your stash and send a note to the group (NOT me personally) or in the "MYO approval" channel in the server with your MYO for approval + proof that you got the MYO slot. Once it has been approved you can upload it (If your MYO is a Gemmismae, remember to include a list of the traits that you used).

★ From June 1st 2019 all free MYO slots (from MYO events, milestones, official/guest artist rewards, other events, purchased with SB and so on) will have a 6 months deadline. If the MYO has not been completed before the deadline you will be noted about the voiding of your slot. If you purchased a MYO slot with SB, the SB will be returned to your bank account. You can ask for an extension, but if you still don't make it to the deadline the MYO will be voided.

★ From April 16th 2020 there will be a cap on how many unused MYO slot one person can have. If you have 5 unused MYO slots, you cannot get new ones until at least one of them have been used.

★ If you have any purchased traits/mutations for a free and you don't make your MYO before the deadline, your purchased traits will be saved until you get another MYO slot.

★ Fully purchased MYO slots do not have a deadline.

★ I will save a copy of your approved MYO to put the "Official Gem" stamp on it and upload it to the master list account Gem-Masterlist to make your MYO official. You will of course be given credit for the design.

★ If you cancel the transaction of a paid MYO slot you will no longer own the slot! You will be banned from the group and black listed from owning a Gem, meaning you cannot take part in future MYO's, buy adopts from any Gem adopt artist, or take part in the group activities!

★ Add the word "Gem baby" to the comment to confirm you read and agree to the "General", "Crediting", "Editing", "Trading/selling/gifting" and "MYO" T.O.S.

These T.O.S. are the adopt T.O.S. for the adopts I, Yuko-san and MintyTomato make, and for any shared adopt batches. You will have to also read and agree to the "General", "Crediting", "Editing" and the "Trading/selling/gifting" T.O.S.

★ Important rule!!
- Your account must be at least two months old
- You cannot get the Gem if you are on the black list.

★ Set price adopts: First come first serve.

★ Auction adopts: Only bid if you are serious about wanting the Gem.

★ Auction adopts: Auction ends 24 hours after the last bid.

★ Auction adopts: Snipe guard is 30 minutes, which means you can't outbid the last bidder 30 minutes before the auction is set to end.

★ You cannot get a refund. What you see is what you get, so make sure you want the Gem before you buy it.

★ Pay within 24 hours (Negotiable). If the payment has not been received within time the adopt will go to the last bidder/be back for adoption.

★ Once your payment has been received and you've been given your adopt, the adopt will be added to the Gem-Masterlist with the "Official Gem" stamp on it.

★ If you cancel the transaction you will no longer own the Gem and it will be put back up for adoption! You will be banned from the group and black listed from owning a Gem, meaning you cannot take part in future MYO's, buy adopts from any Gem adopt artist, or take part in the group activities!

These T.O.S. Applies to both official artists and guest artists. Any differences between the two will be mentioned below.
- Official artists: Official adopt makers of the group. They will keep their role until they "retire" themselves, or if they go against the T.O.S.
- Guest artists: Temporary artists, who are allowed to make a certain amount of adopts. Their guest artist role will end once they have sold all of the adopts they were allowed to make, but are allowed to re-apply as guest artist if they wish.

★ Important info about how the Gems should be made can be found in the MYO Guide, but you can always ask me (Yuko-san) if you're in doubt of anything.

★ Official artists and guest artists are picked by me, Yuko-san, either through the application that I will open from time to time, Guest artist application, or if I note you directly and ask you. If you have not applied as a guest artist, or gotten a note from me, you are NOT allowed to make any adopts for any of my species.

★ You can price your adopts how you see fit and you get to keep what you earn. You can sell them how you see fit as well. Set price, auction, OTA, and so on.

★ Official artists and guest artists are not allowed to claim the five Gem species as theirs.

★ Being an official artist or guest artist does not give you permission to do work for the species or the lore! The role only gives you permission to do adopts, nothing else. The only time you are allowed to do work for the species is when I (Yuko-san) personally ask you if you will help out.

★ Official artists: Official adopt makers of the group. They will keep their role until they "retire" themselves, or if they go against the TOS They are allowed to make as many adopts per month as they wish, but have to make at least 2 adopts every second month. They can choose between the 5 species as they like. They can use all the common traits, but only allowed to use 2 uncommon, 1 rare, 1 legendary, 3 unique traits and 2 mutations trait per month.

★ Official artists: You will be offered a free rare MYO slot for any one of my species, as a "Thank you" for your work. The T.O.S. for "General", "Crediting", "Editing", "Trading/gifting/selling" and "Gem MYO" will apply to the MYO slot.
*NOTE!! The MYO slot will not be given to you until after you've made at least 2 adopts. Do not apply as official artist just for this perk!

★ Guest artist: Temporary artists, who are allowed to make 6 adopts. Their guest artist role will end once they have sold all of the adopts they were allowed to make. They can choose between the 5 species as they like, and are allowed to use all common traits, but only allowed to use 2 uncommon, 1 rare, 1 legendary, 5 unique traits and 2 mutations.

★ Guest artist: As of January 1st 2019, all newly accepted guest artist have to make at least 2 of the 6 adopts (can be done separately or in a batch) within 2 months. The last four adopts has to be made at least within 4 months after that, so you have a total of 6 months to make all 6 adopts. If you should not have completed making the first 2 adopts within the two months, or finished all 6 before the last 4 months period is over, your position as guest artist will end. You can apply again at a later time if you should want to.

★ Guest artists: You will be offered a free rare MYO slot for any one of my species, as a "Thank you" for your work. The T.O.S. for "General", "Crediting", "Editing", "Trading/gifting/selling" and "Gem MYO" will apply to the MYO slot.
*NOTE!! The MYO slot will not be given to you until after you've finished making all 6 adopts. If you don't finish all 6 adopts within the 6 months period, you will not be given the MYO slot!

★ Unused MYO slots gifted to you for being an official/guest artist cannot be traded, gifted or sold, as they were a gift to you for your work as an artist for the species. If you don't want the MYO slot it will be voided instead.

★ You may keep an adopt design, if you have a MYO slot that matches the highest rarity on the design. If you're a guest artist, and you've completed all 6 adopts, you have to make a new design to take the place of the one you're keeping. The reason for this is because you get your rare MYO once you've completed all 6 adopts, and keeping one means that you've only made 5.

★ When you are accepted as either official artist or guest artist, I will send you an invitation to become "Official artist"/Guest artist" of the group. It is required for both official and guest artists to be in the group, as they are part of the team. If you have no more room to be admin in a group I'll invite you to be a member in the group instead.

★ It is allowed to use my Gem bases for the adopts. You can also use premade bases from other artists. Just make sure that the base is allowed to be used for adopts, being edited and used for closed species. However, it is highly encouraged that you to use your own art/make your own base. Remember to credit the base artist!

★ When you finish an adopt, or a batch, you have to show them to me for approval before you upload them! (Remember to include what gemstone you used, and if you made Gemmismae adopts, the traits that you used).

★ If any rules in the "General", "Crediting", "Editing" and "Trading/selling/gifting" part of my species T.O.S. contradict with your adopt T.O.S. I reserve the right to say that my T.O.S. takes priority, as it is my species. If you are not okay with this, you can resign as official/guest artist.

★ I will save a copy of your adopts and add the "Official Gem" stamp to it and upload it to the Gem-Masterlist account. When the adopt has been sold I'll add in the buyer's name.

★ When you upload the adopt(s) it is highly important that you link to the Gem species T.O.S. (T.O.S.). The "General", "Crediting", "Editing" and "Trading/selling/gifting" section is relevant for your buyers.

★ When you upload your adopt(s) you must credit me, Yuko-san and MintyTomato in the description for the species, and link back to the group (Gemmadite-Species)

★ Remember to make sure that the buyer has accepted the species T.O.S. and joined the group before accepting payment and sending them the adopt.

★ When you sell an adopt you have to tell me who bought it, so I can add their name to the master list. Also show me proof that they accepted and agreed to my T.O.S.

★ When you have uploaded the adopt(s) you can add them to the "Adopt" folder in the species group Gemmadite-Species.
